I. DECISION This application was approved with the following conditions: 1. The applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties if either: the seating is expanded such that the site does not meet the required one parking space per four fixed seats, or if the parking demand cannot be met on the property and there are off-site parking impacts as determined by the department. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. 2. The Applicant shall adopt a Parking Management Program for special events that shall include the following: A. information and education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. B. Demand Reduction Strategies: Establish a preferred parking area for families and groups that carpool with four or more persons per car; C. Demand Management Strategies: Implement measure to ensure that sufficient parking is available. These measures could include agreements with the surrounding businesses; shuttles; establishing a team of parking attendants to help direct drivers to available parking. SEPA Determination: The City SEPA Responsible Official has: Determined that the project, as proposed does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to WAC 197-11-172, that the probable significant adverse environmental impacts of the project were adequately analyzed in the EIS previously prepared for the planned action and will implement the conditions and mitigation measures imposed by the planned action approval. Decision on Conditional Use Permit: The City Hearing Examiner has determined that the application for a Conditional Use Permit does comply with the applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision. III. YOUR APPEAL RIGHTS The Decision on this Application is a Type 3 decision Pursuant to Tukwila Municipal Code 18.104.010. Other land use application related to this project may still be pending. No administrative appeal of the decision is permitted. A party who is not satisfied with the hearing Examiner's decision may file an appeal in King County Superior Court. IV. PROCEDURES AND TIME FOR APPEALING Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's decision is properly filed Superior Court within such time limit, the Decision on this permit will be final. V. Department powerpoint presentation Introduction The applicant seeks a conditional use permit to allow a religious facility with an assembly area greater than 750 square feet within the Regional Commercial Mixed Use zone. A public hearing was held on the application on May 8, 2013, at the Department of Community Development, 6300 Southcenter Boulevard, Tukwila, WA. Represented at Hearing Examiner Decision L13-006 Vine Church CUP Page 2 of 5 the hearing were: the Department, by Courtney Johnson, Planning Intern, and Minnie Dhaliwal, Senior Planner; and the applicant, Vine Church Ministries, by Brandon and Linda Rainwater. No members of the general public testified at the hearing. After due consideration of the evidence presented at the public hearing, the following shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on this application. Findings of Fact 1. The subject site is addressed as 15439 53rd Avenue South, Tukwila, WA, and is an existing single story office building approximately 9,868 square feet in size. The lot is 39,603 square feet, and is striped with 32 parking spaces. The building is currently vacant. 2. The site takes access through three driveways along a private road that runs along the south side of the site. 53rd Avenue South is located east of the site. The site sits above the private road and 53rd Avenue South. 3. The site is in close proximity to I-5 to the east, and SR -518 lies to the south; the Tukwila Link Light Rail Station is located further west on Southcenter Boulevard. Bus routes are located along Southcenter Boulevard. 4. The site is zoned Regional Commercial Mixed Use (RCM), and the surrounding area is also zoned RCM. 5. The properties immediately north and west of the site are developed with multi - tenant office/retail buildings. The Extended Stay America Hotel is located further west of the property. Westfield Shopping Mall is located nearby to the east. 6. The site includes a number of trees. At some time, landscaping along 53rd Avenue South was removed; trees were replanted, but no shrubs or groundcover were installed. 7. The proposal is to locate a religious facility with an assembly area of 2,891 square feet. The applicant proposes to remodel the interior of the building, as shown in the record. No exterior changes to the structure are proposed. No tree removal is proposed. The proposal includes re -striping of the parking lot, installation of signage, and landscaping. 8. The proposal includes 150 fixed seats for church members, and provision of 42 onsite parking spaces, including two accessible spaces. Hearing Examiner Decision L13-006 Vine Church CUP Page 3 of 5 9. The applicant is currently located in the Wallingford neighborhood of Seattle, but its congregation members reside throughout King County, including areas within south King County. The church has 120 members, with an average weekly service total of 80 to 100 participants. Almost all of the church's activities occur at times other than Monday through Friday 9 a.m. to 5 p.m. 10. Under TMC 18.56.050, office use of the 9,868 square foot building would require 30 parking spaces, while 38 parking spaces are required for a religious facility with 150 fixed seats. 11. The Department received one comment letter by email on the proposal, from an adjacent property owner. The email requested that landscaping be addressed, that the easterly driveway be reconstructed, that the private street extension of 53rd Avenue South be painted to reflect no parking on the north side; and that peak parking demands be addressed. 12. The Department has reviewed the proposal and recommends approval with conditions as listed in the staff report at page 12. The Department has noted that in addition to the conditions of CUP approval, the applicant will be required to meet all applicable building and fire codes as part of the building permit review. The applicant is not required by the Code to bring the existing steep easterly driveway up to current standards. However, the applicant has indicated that it will be utilizing signage and information to church attendees to manage circulation on the site, including use of the steep driveway. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.104.010.3, which provides that a decision on a conditional use permit application is a quasi-judicial decision by the Hearing Examiner. 2. The proposed religious facility's assembly area would exceed 750 square feet, so conditional use approval is required under TMC 18.26.020. 3. The criteria for granting of a conditional use permit are set forth in TMC 18.64.050: (1) the proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity; (2) the proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy; (3) the proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; (4) the proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan; and (5) all measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The proposed use as a religious facility will result in only minor changes to the appearance of the site, with restriping of the parking area, and installation of landscaping along 53`d Avenue South. In contrast with the nearby office uses, the proposed use would occur primarily on weekends and evenings, minimizing potential traffic and parking impacts. The proposed use would not be materially detrimental to public welfare or injurious to the property or improvements in vicinity. 5. The proposal as conditioned would meet the applicable development standards, including those for onsite parking, and standards addressing air quality, noise, water quality, and hazardous materials. All building and fire code standards will also be met as part of the building permit review for the proposal. The Department's proposed conditions also provide for the applicant to provide additional parking through a shared or covenant parking agreement, if parking demand is not met on the site. The conditions also provide for a parking management program for special events at the site. 6. Only minor changes to the site and the building's exterior are proposed, retaining the existing compatibility with nearby office and retail buildings which are similar in design. The site has immediate access to the freeways, and also has pedestrian and bicycle connections to transit and light rail along Southcenter Boulevard. The proposed development would be compatible with surrounding land uses in terms of traffic and pedestrian circulation, and building and site design. 7. The proposed religious facility would be consistent with the Comprehensive Plan, including Goals 1.3 and 7.5; and Policies 8.1.3 and 8.4.2. 8. As conditioned, the proposal will incorporate all appropriate measures to minimize possible adverse impacts. Although no adverse impacts have been identified, the possibility of overspill parking demand has been addressed by the Department's recommended conditions for a parking management plan and a shared parking covenant. 9. The application would meet all criteria for a conditional use permit and should be approved. Decision The Conditional Use Permit is hereby granted with the following conditions: 1. The applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties if either: the seating is expanded such that the site does not meet the requirement of one parking space per four seats, or if the parking demand cannot be met on the property and there are off-site parking impacts as determined by the Department. Public Comments- email from Greg Diener BACKGROUND On March 6, 2013, the City received a Conditional Use Permit (CUP) application from the Vine Church Ministries at 15439 53`d Ave S Tukwila, WA 98188. Tukwila Municipal Code (TMC) 18.26.020 (38) lists religious facility with an assembly area less than 750 sq. ft. as a permitted use within the Regional Commercial Mixed Use (RCM) zone. Religious facilities with an assembly area greater than 750 sq. ft. are listed as a conditional use. The subject property is 39,603 sq. ft. and was initially developed as a multi -tenant office. The building area is 9,868 sq. ft. and is currently vacant. The applicant is proposing a change of use and interior remodeling to create an assembly area of more than 750 sq. ft. This requires a Conditional Use Permit (CUP). FINDINGS Vicinity/Site Information Project Description The applicant is requesting that the Hearing Examiner approve a CUP to: Allow a change of use from a multi -tenant office space to a religious facility with an assembly area larger than 750 sq. ft. in the RCM zone. No exterior alterations are being proposed except for re -striping of the parking spaces and new signs. Page 2 of 13 Existing Development The existing building was built in 1978 as a multi -tenant single story office building. The building is currently vacant. The existing single story building sits in the middle of the lot with two rows of parking to the west and one row along the east side. There is a public street to the east (53`d Ave S) and a private road that is 26 feet wide along the south side of the property. The site is accessed by three access driveways along the private street. The eastern most driveway is steep due to the grade difference between the property and the private road. The proposed sanctuary is 2,891 sq. ft. with fixed seating for 150 people. Figure 1 Aerial photo Surrounding Land Uses The surrounding area is zoned RCM. The properties immediately to the north and west of the subject site were developed at the same time as the subject property in early 1980's. The buildings on all three lots were designed as multi -tenant office/retail buildings. Extended Stay America Hotel is further west of the property. The general area is surrounded by freeways, I-5 is to the east and SR 518 is to the south. The grade of the first driveway is quite steep and is a one way access from the row of angled parking to the private road. Figure 4A landscaping; Vegetation Figure 4B before; Figure 4C final existing landscaping A significant amount of mature vegetation is located around the general area and in the alleyway. There are existing trees that are large, medium and small; no trees are proposed to be removed. In the past mature landscaping was removed along the 53`d Ave S and new smaller trees have been re -planted. However, shrubs and ground cover have not been replanted. The applicant shall be required to replant the shrubs and ground cover as part of the Building Permit review process. There is moss growing and covering the uneven lot area, it has not been repaved or maintained. The landscape island in the main parking area also lacks maintenance. Applicant has stated that they will hire maintenance employees to keep up with the existing vegetation that will improve the environment. Page 4 of 13 Access There is direct access to the property coming off I-5 using exit 154B. Westfield Shopping Mall and the proposed church will be located along Southcenter Blvd and are in close proximity. The property has convenient access to businesses, services, and the Light Rail Station that is just west of the property along the Southcenter Blvd. Bus routes are located along Southcenter Blvd for pedestrians who will utilize the church services and activities. If there are any visitors staying overnight for events they will have immediate access to the Extended Stay America Hotel, Westfield Mall, Green River Trail and many more attractions in the City. Conditional Use Permit Criteria: The applicant is requesting that the Hearing Examiner allow the operation of a church for the Vine Ministries and to remodel the interior of an existing multi -tenant office/retail space. A CUP is required for the use of a religious facility with an assembly area greater than 750 sq. ft. in RCM zone; the proposed assembly area is 2,891 sq. ft. The proposed project must comply with criteria detailed in TMC 18.64.050, (1-5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment A. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): 1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The subject lot is 39,603 sq. ft. with a building area of 9,868 sq. ft. and currently has 32 total parking spaces on site. The proposal is to restripe the parking lot to provide 42 parking stalls. The proposal is to convert the use of an existing building to a church use. No significant exterior changes are proposed. Per TMC 18.70.090 any non -conforming landscaping has to be brought up to compliance at the time a change requiring design review approval is proposed. No design review is required at this time; however in the past the property owner had removed existing mature landscaping along 53`d Ave S. Only new trees were replanted. The applicant shall be required to replant shrubs and groundcover Page 5 of 13 along 53rd Ave S., thus improving the appearance of the site. Additionally the applicant shall be responsible to maintain the landscaping for the life of the project per TMC 18.52.050(B). The interior of the building will be remodeled. The proposed floor plan includes a worship space, class rooms, a lobby and offices. A Building Permit is required for the change of use and the proposed remodeling activities. Applicant shall be responsible for meeting all fire and building code requirements to operate a church at this location. No exterior changes are proposed except parking lot restriping, signs and landscaping maintenance. The details of the parking lot shall be reviewed as part of the Building Permit review process. Applicant is required to obtain a Sign Permit prior to the installation of any signs and all proposed signs shall meet the City's Sign Code requirements. Washington i Figure 6 Private street along the south side of the property 2) The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. All uses, activities, and operations within the City shall comply with 1) standards adopted by the Puget Sound Air Pollution Control Agency for odor, dust, smoke and other airborne pollutants, 2) Page 6 of 13 TMC Chapter 18.22 "Noise" and 3) adopted State and Federal standards for water quality and hazardous materials. The applicant is proposing to change the use of an office building to a religious facility, which should not impact air quality or release pollutants into the environment. The project will be required to comply with the City's noise regulations during construction and during its regular operations. As part of the Building Permit review process the applicant will be required to meet all development standards within the RCM District and building, and fire codes. As stated above, the church is proposed to have 150 fixed seats for members of various ages. The applicant has planned to provide a total of 42 onsite parking spaces including two accessible spaces that are required by Americans with Disability Act (ADA); this meets the on-site parking requirements. Per Tukwila Municipal Code (TMC) 18.56.050, religious facilities are required to provide one parking space for 4 fixed seats and one bicycle parking space for 50 parking stalls. Therefore a total of 38 parking stalls are required. If the seating is expanded such that the site does not meet the requirement of one parking space per 4 seats; or if the parking demand cannot be met on the property and there are off-site parking impacts, the applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. Additionally, it is likely that parking demand will peak at special events. The applicant shall adopt a parking management program for special events that shall include the following: 1. Information and Education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. Also, the congregation shall be informed that no illegal on -street parking is allowed. 2. Demand Reduction Strategies: Establish a preferred parking area for families and groups that carpool with four or more persons per car. 3. Demand Management Strategies: Implement measures to ensure that sufficient parking is available. These measures could include agreements with the surrounding businesses; shuttles; establishing a team of parking attendants to help direct drivers to available parking locations. Page 7 of 13 The proposed use is anticipated to activate the area on weekends and evenings. This should complement the existing uses rather than have any adverse impacts. TMC 18.70.080 (B -C) governs the standards for non -conforming parking lots and states: "If a change of use takes place, or an addition is proposed, which requires an increase in the parking area by an increment less than 100%, the requirements of the Off-street Parking and Loading Regulations chapter of this title shall be complied with for the additional parking area. If a change of use takes place, or an addition is proposed, which requires an increase in the parking area by an increment greater than 100%, the requirements of the Off-street Parking and Loading Regulations chapter of this title shall be complied with for the entire parking area." There are 30 parking spaces required for a 9,868 sq. ft. office building and a religious facility with 150 fixed seats requires 38 parking spaces. Therefore the increase in parking area is less than 100% and the requirements of Off -Street Parking and Loading Regulations chapter shall only apply to any new parking spaces provided. Additionally, as previously stated, the church is responsible for instituting a parking management program for special events to ensure there no off-site impacts and no illegal parking occurs on adjoining streets. 3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The site is located in the RCM zone and accessed directly off exit 154B. The proposed location is close to the freeway and traffic circulation will not change. This building site is compatible with the other buildings because they were all constructed around the same time and appear to be similar in design. No significant exterior changes are proposed at this time. The purpose of the RCM District as stated under TMC 18.26.010 is: "intended to provide for areas characterized by commercial services, offices, lodging, entertainment, and retail activities with associated warehousing, and accessory light industrial uses, along transportation corridor and intended for high intensity regional uses." Page 8 of 13 The addition of a church to the district will benefit the experiences in the area, specifically on the weekends and evenings when the area seems to be less vibrant. The land uses directly around the property include: freeways, shopping centers, and other commercial uses. Vehicular access is convenient because this site provides immediate access to I-405 and I-5. There are sidewalks and bike lanes connecting this area to the Light Rail Station along Southcenter Blvd. 4) The proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan The proposed development is in keeping with the goals and policies of the Comprehensive Plan, specifically the following goals and policies: • Goal 1.3 Identifiable boundaries for Tukwila so that residents, workers, and visitors know they are entering the City. The proposed church is located at a freeway off -ramp and a major street intersection of Southcenter Boulevard and 53rd Ave S. • Policy 8.1.3 Develop parking standards that are (1) sufficient to meet typical daily demand, (2) reflect any significant shifts in transit usage in the corridor, (3) encourage shared parking between mixed uses and sites, and (4) includes off-site parking when impact to adjacent uses not affected. • Policy 8.4.2 Maintain the low scale, one to three-story, commercial character of Southcenter Boulevard east of 51st Avenue South. • Goal 7.5 encourages the creation of "Neighborhood Gathering Spots." The proposed church will create a neighborhood gathering spot. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. There are no possible adverse impacts expected of the proposed use, provided the applicant is able to manage the parking demand. At this time TMC requires 38 parking stalls for 150 fixed seats. The applicant has proposed 42 parking spaces on the property. If the seating is expanded such that the site does not meet the requirement of one parking space per 4 seats; or if the parking demand cannot be Page 9 of 13 met on the property and there are off-site parking impacts, the applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. Additionally, it is likely that parking demand will peak at special events. The applicant shall adopt a Parking Management Program for special events that shall include the following: 1. Information. and Education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. Also, the congregation shall be informed that no illegal on -street parking is allowed. 2. Demand Reduction Strategies: Establish a preferred parking area for families and groups that carpool with four or more persons per car. 3. Demand Management Strategies: Implement measures to ensure that sufficient parking is available. These measures could include agreements with the surrounding businesses; shuttles; establishing a team of parking attendants to help direct drivers to available parking locations. The Comprehensive Plan has goals that are aligned with the ability to provide flexible parking regulations and strategies. The proposed use is anticipated to activate the area on weekends and evenings when the surrounding properties are not in use. This should complement the existing uses rather than have any adverse impacts. The applicant has suggested creating an agreement with the surrounding property owners for parking covenants when customers aren't typically using them. Currently, most of the operations and services in the area are during normal business hours (Mon -Fri 9am-5pm) and the demand for parking for church use will be in the evenings and weekends. Also the applicant has stated that church staff will shuttle members from the light rail and bus depot to the church. (See attachment C). The change will benefit this area in terms of an increased pedestrian presence during typical evening and "off" hours. Pedestrian and vehicular access is convenient to this site as well as the other properties in the general vicinity. Additionally, the project will be required to meet all applicable development standards, as well as fire and building code requirements. Page 10 of 13 PUBLIC COMMENTS One email was received during the public comment period that ended on April 24,2013; see Attachment D. CONCLUSIONS 1. Religious institutions with an assembly area larger than 750 sq. ft. are permitted within the RCM zone provided a CUP is approved by the Hearing Examiner. (TMC 18.26.040 (4)). 2. According to the King County records the building was constructed in 1978. The applicant is proposing a change of use to the existing office building to a church use. 3. The church use is consistent with the City's adopted Comprehensive Plan goals and polices. The existing building design is consistent with other development in the area. 4. Landscaping is required to be brought up to code at the time design review is required. No design review is required at this time. However landscaping along 53rd Ave S was illegally removed. While trees were replanted but no shrubs or groundcover was planted. The applicant shall be required to replant shrubs and groundcover along 53rd Ave S., thus improving the appearance of the site. Additionally the applicant shall be responsible to maintain the landscaping for the life of the project per TMC 18.52.050(B). 5. There are 42 parking stalls proposed on the site and it meets the parking requirements of one space per 4 fixed seats. If additional seats are proposed or if parking demand is not met on the 4 W _ property, the applicant shall be responsible for obtaining Shared or Covenant Parking Agreements `AV by ,Lv�` -- `.... ,„,0 with the adjoining properties. Additionally, the applicant shall adopt a parking management program for special events. 6. The proposed use will not generate any noise, glare, or odors that may impact adjacent properties. The church will be primarily used when other businesses are not open. The church will not have any adverse impacts provided the parking management strategies will be in place and met. 7. A Building Permit is required for the change of use and the proposed remodeling activities. Applicant shall be responsible for obtaining a building permit and meeting all fire and building code requirements to operate a church at this location. Page 11 of 13 8. No exterior alterations are proposed except for the installation of new signs. Any proposed signs shall comply with the City's Sign Code. RECOMMENDATIONS The staff recommends approval of the Conditional Use Permit with the conditions set forth below. 1. The applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties if either: the seating is expanded such that the site does not meet one parking space per 4 seats requirement; or if the parking demand cannot be met on the property and there are off-site parking impacts. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. 2. The applicant shall adopt a Parking Management Program for special events that shall include the following: a) Information and Education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. b) Demand Reduction Strategies: Establish a preferred parking area for families and groups that carpool with four or more persons per car. c) Demand Management Strategies: Implement measures to ensure that sufficient parking is available. These measures could include agreements with the surrounding businesses; shuttles; establishing a team of parking attendants to help direct drivers to available parking locations. Informational Items 1. Building, Plumbing, Mechanical and Electrical Permits are required for remodeling. 2. The items on the Building Permit shall require the following: a. Square footage of each occupied area with the occupancy specified and number of occupants specified per code. Calculation totals of each occupied area and total building occupants shall be indicated on the cover sheet. ADA parking calculation shall be included on cover sheet. b. An emergency egress and emergency lighting plan shall be required. Show all required exits with exit signage specified. c. A Washington State Lighting budget form shall be required for all lighting. Lighting shall comply with Washington State Energy code (WSEC) and WSEC lighting compliance budget form shall be filled out and provided with the Building Permit application. 5. Plumbing Permit: all plumbing alterations shall be shown on plumbing plan. 6. A 2 inch Reduced Pressure Principal Assembly (RPPA) installed downstream of existing domestic water meter will need to be installed for premise isolation. 7. The project will require the installation of fire sprinkler per section 903 IFC. 8. Fire and park impact fees will apply for change of use, please contact the Fire Marshal and make all applicable payments. Our membership on record is 120 with an average weekly service total of 80 to 100. Currently, 95% of our corporate operations and services are not during normal business hours (Mon -Fri 9am- 5pm). Though parking does not stand to be a problem with the number of spaces in our lot, we are prepared to shuttle members coming from the Tight rail, train and bus depot. we are also prepared to seek an agreement with our neighbors for use of "overflow" parking in case it ever became a need. The need for overflow parking is slim considering all of the additional public street and easement parking bordering our facility. The interior design of our facility is excellent for safety, flow and maintenace. There are ample emergency exits, bathrooms in 3 different places and dedicated areas for general public, children and staff that can easily be secured/locked down in case of emergency. Our janitorial/maintenace team is excited about the facility and the opportunity to clean, maintain and beautify the grounds. We believe our consistent presence will drastically reduce litter, crime and violence in the area as we stand as a beacon of love, hope and peace. The Vine plans to invest in the Tukwila community long term. We plan to get rooted in the community with a long term approach and focus as a pillar in the advancement of Tukwila. I am the owner of the building directly west and uphill from the office Building proposed for the Vine Church. I would like to comment on the proposal. I note that the project description states that no exterior changes are proposed at this time.. The Landscaping in and around this building is not consistent with that of a professional office building. The trees along 53rd are barely surviving, there are weeds abundant throughout this area and all of the landscape islands on the property.. Landscaping needs to be addressed as part of this application. The access to the east side of the building is substandard by any measure.. One only needs to look at the severe scrapes in the pavement to know that the driveway was not constructed properly. Secondly, I am concerned about parking for this church.. How many members are there in this congregation and how much parking is anticipated in the lot and on the surrounding streets? If the parking demand associated with this church exceeds that of the use, then there needs to be some accommodation for the parking requirement.. Will the surrounding properties be inundated with cars due to the heavy demand on peak times - Sunday mornings, Sunday nights, Wednesday events or other heavy demand times? 53rd Avenue South is a public street and parking on both sides of that street are permitted.. The extension of this street uphill to the Extended Stay Hotel is private and owned by all three property owners, R&N Real Estate (Smiles @ Southcenter), Qestar II Partnership, and us, Qestar Three, LLC (Greg and JoAnn Diener). While parking may be permitted on one side of this street, parking on both sides will result in severely limited access for fire, police, and aid units. ( The street is 26 feet wide today - parking is prohibited on the north side of this private street and is presently marked - No Parking Fire Lane). As a neighbor I request that this proposal be approved but with the following stipulations: The landscaping be brought up to reasonable standards and maintained as such. Landscaping is required to be brought up to code at the time design review is required. No design review is required at this time. However landscaping along 53rd Ave S was illegally removed. The Property includes King County parcel number 15720-0033 situated within the City of Tukwila, King County, Washington State as legally described in Exhibit B. Section 2. Violation Acknowledgment by the Property Owner. The Property Owner acknowledges that the City has determined that the sign is non -conforming per TMC 19.36 and was refaced by the prior property owner without obtaining the required permits as required by TMC Title 19. The Property Owner further acknowledges that on April 20, 2011, the City issued a Notice and Order for the sign violation and an appeal of the Notice and Order was never filed. No fines or penalties shall be assessed against the Property Owner and/or the property for the subject violation. Section 3. Grace Period Established. The Sign shall be subject to the ten (10) year grace period established under TMC 19.36.020 (C). The grace period commenced on August 24, 2010, the date of adoption of the current Sign Code pursuant to Ordinance 2303. As provided in TMC 19.36.020, the Property Owner may, with a valid non -conforming sign permit, complete refaces, copy changes, and electrical repairs to the Sign, subject to all of the limitations listed in TMC 19.36.020 (D). Upon application by the Property Owner, issuance of a non -conforming sign permit will be not be withheld by the City. The grace period shall not extend beyond August 24, 2020 at 5:00 PM. After 5:00 PM on August 24, 2020, the Sign shall be subject to the provisions of TMC 19.36.020 (E) as the section currently reads or as hereafter amended. Section 4. Required Corrective Action. Within sixty (60) days of execution of this Agreement by the parties, the Property Owners shall submit an application for a Non - Conforming Sign Permit and a Freestanding Sign Permit application to the City to remedy the previous, nonconforming modifications to the Sign which have occurred. Such application shall not be denied, and the City will grant a Non -Conforming Sign Permit and Freestanding Sign Permit in accordance with the terms of this agreement. Within the context of these permits, the City will also allow the electricity to the Sign to be restored. Section 5. Release of All Claims by the Property Owner. The Property Owner hereby releases and discharges the City and its officials, employees, agents and representatives, from any and all claims, demands, liabilities, and causes of action of every kind that have arisen from or are related to the Sign under federal, state or local law. This release is intended to be all-encompassing and to fully resolve all claims, demands, liabilities, and causes of action between the Parties existing at this time. It is further understood and agreed that this Agreement is not to be construed as an admission of liability on the part of the City of Tukwila, or by its officials, agents, or employees, by whom liability is expressly denied. The Parties do not intend the release contained in this paragraph to release future claims, if any, for breach of this Agreement or any false representations herein. The Property Owner and every purchaser, assignee or transferee of an interest in the Property, or any portion thereof, shall be obligated and bound by the terms and conditions of this Agreement, and shall be the beneficiary thereof and a party thereto, but only with respect to the Property, or such portion thereof, sold, assigned or transferred to it. Any such purchaser, assignee or transferee shall observe and fully perform all of the duties and obligations of the Property Owner contained in this Agreement, as such duties and obligations pertain to the portion of the Property sold, assigned or transferred to it. Section 8. Effective Date. This Agreement shall be effective upon final execution by both Parties. Section 9. Assignment of Interests, Rights, and Obligations. This Agreement shall be binding and inure to the benefit of the Parties. No Party may assign its rights under this Agreement without the written consent of the other Party, which consent shall not unreasonably be withheld. This Agreement shall be binding upon and shall inure to the benefit of the heirs, successors, and assigns of the Property Owner and the City. Section 10. Incorporation of Recitals. The Preamble and Recitals contained in this Agreement are hereby incorporated into this Agreement as if fully set forth herein. Section 11. Specific Performance. The Parties specifically agree that damages are not an adequate remedy for breach of this Agreement, and that the parties are entitled to compel specific performance of all material terms of this Agreement by any party in default hereof. Section 12. Governing Law and Venue. This Agreement shall be construed and enforced in accordance with the laws of the State of Washington. Venue for any action shall lie in King County Superior Court or the United States District Court for Western Washington. Section 13. Attorney's Fees. In the event of any litigation or dispute resolution process between the Parties regarding an alleged breach of this Agreement, the prevailing party shall be entitled to any award of attorney's fees. Section 14. Entire Agreement and Amendments. This Agreement represents the entire agreement between the Parties with respect to the subject matter herein. This Agreement supersedes all other written and/or oral agreements between the Parties relating to the Sign or the Property. Either party may request changes in the Agreement. The Parties each represent and warrant that they have full power and actual authority to enter into this Agreement and to carry out all actions required of them by this Agreement. Notices. We have a heart to see families established, the youth rooted in purpose, and everyone to receive the life changing Love of God Through Jesus Christ. Our membership on record is 120 with an average weekly service total of 80 to 100. Currently, 95% of our corporate operations and services are not during normal business hours (Mon -Fri 9am- 5pm). Though parking does not stand to be a problem with the number of spaces in our lot, we are prepared to shuttle members coming from the light rail, train and bus depot. we are also prepared to seek an agreement with our neighbors for use of "overflow" parking in case it ever became a need. The need for overflow parking is slim considering all of the additional public street and easement parking bordering our facility. The interior design of our facility is excellent for safety, flow and maintenace. There are ample emergency exits, bathrooms in 3 different places and dedicated areas for general public, children and staff that can easily be secured/locked down in case of emergency. Our janitorial/maintenace team is excited about the facility and the opportunity to clean, maintain and beautify the grounds. We believe our consistent presence will drastically reduce litter, crime and violence in the area as we stand as a beacon of love, hope and peace. The Vine plans to invest in the Tukwila community long term. We plan to get rooted in the community with a long term approach and focus as a pillar in the advancement of Tukwila. I am the owner of the building directly west and uphill from the office Building proposed for the Vine Church. I would like to comment on the proposal. I note that the project description states that no exterior changes are proposed at this time.. The Landscaping in and around this building is not consistent with that of a professional office building. The trees along 53rd are barely surviving, there are weeds abundant throughout this area and all of the landscape islands on the property.. Landscaping needs to be addressed as part of this application. The access to the east side of the building is substandard by any measure.. One only needs to look at the severe scrapes in the pavement to know that the driveway was not constructed properly. Secondly, I am concerned about parking for this church.. How many members are there in this congregation and how much parking is anticipated in the lot and on the surrounding streets? If the parking demand associated with this church exceeds that of the use, then there needs to be some accommodation for the parking requirement.. Will the surrounding properties be inundated with cars due to the heavy demand on peak times - Sunday mornings, Sunday nights, Wednesday events or other heavy demand times? 53rd Avenue South is a public street and parking on both sides of that street are permitted.. The extension of this street uphill to the Extended Stay Hotel is private and owned by all three property owners, R&N Real Estate (Smiles @ Southcenter), Qestar 11 Partnership, and us, Qestar Three, LLC (Greg and JoAnn Diener). While parking may be permitted on one side of this street, parking on both sides will result in severely limited access for fire, police, and aid units. ( The street is 26 feet wide today - parking is prohibited on the north side of this private street and is presently marked - No Parking Fire Lane). As a neighbor I request that this proposal be approved but with the following stipulations: The landscaping be brought up to reasonable standards and maintained as such.
