Public Hearing: The Hearing Examiner held a public hearing on the application on May 8, 2013, at the Department of Community Development, 6300 Southcenter Boulevard, Suite 100, Tukwila, WA. The Examiner viewed the site on May 5, 2013. EXHIBITS: The following exhibits were entered into the record: 1. Department powerpoint presentation Introduction The applicant seeks a conditional use permit to allow a religious facility with an assembly area greater than 750 square feet within the Tukwila Urban Center (TUC) zone. A public hearing was held on the application on May 8, 2013, at the Department of Community Hearing Examiner Decision L13-007 Church of the Vietnamese Martyrs CUP Page 2 of 5 Development, 6300 Southcenter Boulevard, Tukwila, WA. Represented at the hearing were: the Department, by Courtney Johnson, Planning Intern, and Minnie Dhaliwal, Senior Planner; and the applicant, Church of the Vietnamese Martyrs, by Kien Nguyen and Kevin Broderick, project architect. No one from the general public testified at the hearing. After due consideration of the evidence presented at the public hearing, the following shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on this application. Findings of Fact 1. The subject site is addressed as 6801 South 180th Street, Tukwila, WA. The site is a 5.77 acre parcel that is developed with a 62,250 square warehouse and manufacturing structure, which is currently vacant. The site contains approximately 241 parking spaces. 2. The site takes access via Sperry Drive which connects to S. 180th Street, with freeway access nearby. The site is surrounded by a mix of commercial uses, including office and retail uses, including several adjacent bank properties, and Westfield Shopping Mall is five blacks away. The Green River Trail surrounds the building. The site is relatively flat, and is landscaped with trees, shrubs and groundcover. 3. The site is zoned Tukwila Urban Center (TUC), as is the surrounding area. 4. The proposal is to convert the existing building to a religious facility with interior remodeling as shown in the plans in the record. The proposed worship area of the church would be 8000 square feet, with seating area which is the equivalent of 733 seats. Classroom and office spaces are also proposed. Several spaces exceeding 750 square feet within the building are classified as assembly areas under the City's Codes. No exterior changes, other than signage and fencing, are proposed. The applicant notes that classroom and worship spaces would never be in use at the same time: The facility would be in use during the evenings and weekends, and there may be 1-2 special events a year. 5. Under TMC 18.56.050, a total of 183 parking stalls and 7 bicycle spaces are required. 6. The Department has reviewed the proposal and recommends approval with conditions. The Department has noted that in addition to the conditions of CUP approval, the applicant will be required to meet all applicable building and fire codes as part of the building permit review. Hearing Examiner Decision L13-007 Church of the Vietnamese Martyrs Page -3 of 5 Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.104.010.3, which provides that a decision on a conditional use permit application is a quasi-judicial decision by the Hearing Examiner. 2. The proposed religious facility's assembly areas would exceed 750 square feet, so conditional use approval is required under TMC 18.26.020. 3. The criteria for granting of a conditional use permit are set forth in TMC 18.64.050: (1) the proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity; (2) the proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy; (3) the proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; (4) the proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan; and (5) all measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. 4. The proposed use would not be materially detrimental to public welfare or injurious to the property or improvements in vicinity. The applicant will utilize the existing building and only minor exterior changes are proposed. The use will occur primarily on weekends and evenings, and poses no conflicts with existing uses in the vicinity. 5. The proposal as conditioned would meet applicable development standards, including those for onsite parking, and standards addressing air quality, noise, water quality, and hazardous materials. Building and fire code standards will also be met as part of the building permit review for the proposal. The Department's proposed conditions also require a shared parking or covenant parking agreement with adjacent bank properties, if parking demand is not met on the site, and a parking management program for special events at the site. 6. Only minor changes to the site are proposed, i.e., signage and a fence, and the proposed fence will be placed on the interior side of the landscaping. The site enjoys good access to the freeways, S. 180th Street, and the Green River Trail. Much of the activity at the religious facility will occur during weekends and evenings, when some of the surrounding uses are not active. The proposed development would therefore be compatible with surrounding land uses in terms of traffic and pedestrian circulation, and building and site design. 7. The proposed religious facility would be consistent with the Comprehensive Plan, including Goals 10.1 and 10.2, and Policy 10.2.6. The TUC zone is intended to contain a Hearing Examiner Decision L13-007 Church of the Vietnamese Martyrs CUP Page 4 of 5 diverse mix of uses, including residential and commercial uses; the proposed religious facility will help to diversify the uses in the zone. 8. As conditioned, the proposal will incorporate all appropriate measures to minimize possible adverse impacts. No adverse impacts have been identified but if the congregation increases in size, additional parking demand could be created. The applicant has indicated that it would seek parking covenants with the adjacent bank properties if the need arose. The Department's recommendations include conditions regarding parking agreements and parking management to address possible impacts from parking demand. 9. The application would meet all criteria for a conditional use permit and should be approved. Decision The Conditional Use Permit is hereby granted with the following conditions: 1. The applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties if either: the seating is expanded such that the site does not meet the requirement of one parking space per four seats, or if the parking demand cannot be met on the property and there are off-site parking impacts as determined by the Department. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. 2. The applicant shall adopt a Parking Management Program for special events that shall include the following: a) Information and education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. b) Demand Reduction Strategics: Establish a preferred parking area for families and groups that carpool with four or more persons per car; c) Demand Management Strategies: Implement measures to ensure that sufficient parking is available. These measures could include agreements with the surrounding businesses; shuttles; establishing a team of parking attendants to help direct drivers to available parking locations. Seating Plan BACKGROUND On March 7, 2013, the City received a Conditional Use Permit (CUP) application from the Vietnamese Martyrs Church at 6801 South 180 Street Tukwila, WA 98188. Tukwila Municipal Code (TMC) 18.28.020 (41) lists religious facilities with an assembly area less than 750 sq. ft. within the Tukwila Urban Center (TUC) District as a permitted use. However religious facilities with an assembly area greater than 750 sq. ft. are allowed as a conditional use. The property is currently occupied by a 62,250 sq. ft. warehouse and manufacturing facility. In the past the building was used primarily on week days and was unoccupied on weekends and the evenings. There were approximately 500 employees that worked in this building. It is currently vacant. The proposed use is a church with associated offices and classrooms with predominant use on the weekends and the evenings. FINDINGS Vicinity/Site Information Project Description The applicant is requesting that the Hearing Examiner approve a Conditional Use Permit (CUP) to allow a change of use from a manufacturing facility to a religious facility with an assembly area larger than 750 sq. ft. in the TUC zone. No exterior alteration except for the proposed addition of a fence and signs is planned at this time. Existing Development From the King County Assessor records, the property has a total lot area of 5.77 acres and the existing building is 62,250 sq. ft. The building was previously used as a warehouse and for a manufacturing facility. The surrounding buildings are not occupied on weekends. The change to this area will benefit from an increased pedestrian presence Page 2 of 10 • during typical "off" hours. Pedestrian and vehicular access is convenient to this site as well as the other properties in the general vicinity. Figure 1 Existing property on site Surrounding Land Uses Surrounding land uses include retail, office, and restaurants. The Green River Trail surrounds the building and provides recreational space for bike riding, walking, and viewing the water. The buildings in the immediate vicinity to the north are used for a banking facility. The site is located on the bank of the Green River and is surrounded by the Green River Trail. No changes to setbacks or height restrictions are proposed. No landscaping changes are proposed at this time. Figure 4 Surrounding vegetation creates a barrier between the building and Green River Vegetation A significant amount of mature vegetation is located around the property. Small medium and large trees exist and no trees are proposed to be removed. There is foundation landscaping in front of the building that helps break up the mass of the building and also provides shade. Figure 5 Existing routes of access Page 4 of 10 Access This location has access to all major highways, Westfield Mall, Green River Trail and many more attractions in Tukwila. 1-5, 1-405, Highway 167, and the city of Renton are all conveniently accessible from the site. Conditional Use Permit Criteria The applicant is requesting that the Hearing Examiner allow the operation of a church for the Vietnamese Martyrs and to remodel the interior of an existing manufacturing and warehouse facility. A CUP is required for the use of a religious facility in the TUC zone when an assembly area is larger than 750 sq. ft.; the proposed worship area is 8000 sq. ft. and there are multiple accessory areas in the building that are larger than 750 sq. ft. and that are classified as an assembly area under the International Building Code. The proposed project must comply with criteria detailed in TMC 18.64.050, (1-5), concerning Conditional Use Permits. The applicant's response to conditional use criteria is attached to this staff report as Attachment A. Staff makes the following findings under the City's Conditional Use Permit criteria (TMC 18.64.050): 1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The property is a 5.77 acre parcel currently occupied by a 62,250 sq. ft. warehouse and manufacturing facility. The applicant is proposing the conversion of the existing building into a religious facility that will utilize a worship space, offices, and classrooms. There are no exterior alterations proposed except the addition of a fence and installation of new signs. The fence shall not be installed on the river protection easement and shall be placed on the interior side of the required landscaping per TMC 18.52.040 (G). The applicant is required to obtain a Sign Permit prior to the installation of any signs and all proposed signs shall meet the City's Sign Code requirements. Applicant is also required to obtain a Building Permit for any interior alterations and shall comply with all building and fire requirements. Page 5 of 10 2) The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. Figure 6 Existing parking area The property is currently located in the Tukwila Urban Center (TUC) District. There are approximately 241 parking spaces on site. The worship space is designed with 733 seats. Per Tukwila Municipal Code (TMC) 18.56.050, religious facilities are required to provide one parking space for 4 fixed seats and one bicycle parking space for 50 parking stalls. Therefore a total of 183 parking stalls and 7 bicycle parking stalls are required. No landscaping improvements are planned. Per TMC 18.70.090 any non -conforming landscaping has to be brought up to compliance at the time a change requiring design review approval is proposed. No design review is required at this time; therefore no additional landscaping is required at this time. The existing landscaping is in good condition and the applicant shall be responsible to maintain the landscaping for the life of the project per TMC 18.52.050(B). 3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The site is located in the Tukwila Urban Center District, which has a diverse range of uses and users. The addition of a religious facility to the District will benefit the experiences in the area, specifically on the weekends and evenings when the area typically seems to be unoccupied. The land uses directly around the property include: numerous restaurants, shopping, banking and retail services. The subject site is only five blocks to Westfield Shopping Mall. Vehicular and pedestrian access is convenient for this site because there is access to all highways within a short distance of the location. The proposed use shall be compatible with the Page 6 of 10 surrounding land uses in terms of traffic and circulation. No changes are proposed to the building exterior or the site layout. 4) The proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan Tukwila's Comprehensive Plan outlines the purpose, future goals, and vision for the Tukwila Urban Center. The desire of this district includes high-density, regionally oriented and mixed use centers. The goals stated in the Comprehensive Plan for the Tukwila Urban Center are to contain diversity of uses; guide development of complementary supportive uses (expand range of allowable uses); provide flexible parking; and attract people to the area. The proposed religious facility is in keeping with the following goals and policies of Tukwila's Comprehensive Plan: Goal 10.1 Land Use The Tukwila Urban Center will contain an intense, diverse mix of uses, which will evolve over time. The character and pace of this evolution will have been set by a combination of guidelines, regulations, incentives, market conditions, and proactive private/public actions which reinforce existing strengths and open new opportunities, and the desire for a high quality environment for workers, visitors, and residents. Goal 10.2 Urban Development Encourage and allow a central focus for the Tukwila Urban Center, with natural and built environments that are attractive, functional, and distinctive, and support a range of mixed uses promoting business, shopping, recreation, entertainment, and residential opportunities. Policy 10.2.6 Parking Ensure an adequate supply of parking for visitors, employees, residents and customers. Provide a variety of flexible regulations, strategies and programs to meet parking demands. On-going needs shall also be assessed to ensure adequate parking requirements and to encourage efficient and effective use of land in parking design. When demand for parking is expected to be at its highest the church will seek the three adjacent bank properties for parking covenants on days of an event or overflow parking. The many services provided through the church will draw many visitors from outside Tukwila. This type of proposal will create a new, larger, customer base for surrounding local businesses. The goals of the district include retaining existing businesses and encourage easy access to the proposed facility for pedestrians, bicyclers, cars, and public transportation. Page 7 of 10 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The applicant has stated that in the future if the congregation grows and there is a need for additional parking they shall seek parking covenants with the three adjacent properties. At this time TMC requires 183 parking stalls for 733 fixed seats. There are currently 241 parking spaces available on the property. If the seating is expanded such that the site does not meet the requirement of one parking space per 4 seats; or if the parking demand cannot be met on the property and there are off-site parking impacts, the applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. Additionally, it is likely that parking demand will peak at special events. The applicant shall adopt a parking management program for special events that shall include the following 1. Information and Education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. 2. Demand Reduction Strategies: Establish a preferred parking area for families and groups that carpool with four or more persons per car. 3. Demand Management Strategies: Implement measures to ensure that sufficient parking is available. These measures could include agreements with the surrounding businesses; shuttles; establishing a team of parking attendants to help direct drivers to available parking locations. The Comprehensive Plan has goals that are aligned with the ability to provide flexible parking regulations and strategies. The proposed use is anticipated to activate the area on weekends and evenings when the surrounding properties are not in use. This should complement the existing uses rather than have any adverse impacts. PUBLIC COMMENTS The public comment period ended on April 24, 2013 and no comments were received. CONCLUSIONS 1. Religious institutions with an assembly area greater than 750 sq. ft. are permitted within the TUC zone provided a Conditional Use Permit is approved by the Hearing Examiner. (TMC 18.28.040 (4)). 2. The proposed use is consistent with the City's adopted Comprehensive Plan goals and polices. Page 8 of 10 3. The applicant is proposing a change of use to the existing building, which was used as a warehouse and a manufacturing facility, to a religious church use. 4. No exterior alterations are proposed except for the addition of a fence and signs. The fence shall be installed outside the river protection easement and inside of the required landscaping. Any proposed signs shall comply with the City's Sign Code. 5. There are 241 parking stalls available on the property and the property meets the parking requirements of one space per 4 fixed seats. If additional seats are proposed or if parking demand is not met on the property, the applicant shall be responsible for obtaining Shared or Covenant Parking Agreements with the adjoining properties. Additionally, the applicant shall adopt a parking management program for special events. 6. A Building Permit is required for the change of use and the proposed remodeling activities. Applicant shall be responsible for obtaining a Building Permit and meeting all fire and building code requirements to operate a church at this location. 7. The proposed use will not generate any noise, glare, or odors that may impact adjacent properties. The church will not have any adverse impacts provided the parking management strategies will be in place and met. RECOMMENDATIONS The staff recommends that the Hearing Examiner adopt the Findings and Conclusions of the staff report and approve the Conditional Use Permit as proposed with the conditions set forth below. Staff recommends approval with the following conditions: 1. The applicant shall be responsible for obtaining and recording a Shared or Covenant Parking Agreement between the subject property and the adjoining properties if either: the seating is expanded such that the site does not meet one parking space per 4 seats requirement; or if the parking demand cannot be met on the property and there are off-site parking impacts. The language of the Shared or Covenant Parking Agreement shall be approved by the City and shall be consistent with TMC 18.56.070. 2. The applicant shall adopt a parking management program for special events that shall include the following: a) Information and Education: Educate the congregation families to encourage them to carpool, use transit, bike, or walk to the church. b) Demand Reduction Strategies: Establish a preferred parking area for families and groups that carpool with four or more persons per car. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The property is a 5.77 acre parcel currently occupied by a 62,250 SF warehouse and manufacturing facility. We are proposing to convert the existing building into a religious facility that will encompass a worship space, offices, and classrooms. There are no exterior revisions proposed for this change of use. Benefits of this change include a shift in the days and time when the building will be occupied. Currently the area is relatively deserted in the evenings and on weekends, but with the change, this area will benefit from an increased pedestrian presence during typical "off" hours. This will only serve to increase safety in the area. Additionally, a religious facility is more apt to upkeep the property better than a manufacturing plant. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. The property is currently located in the desirable Tukwila Urban Center (TUC) district. There are currently approximately 241 parking spaces on site. The parking requirements for religious facilities are 1 stall per 4 fixed seats. The parking requirements for business are 3 spaces for each 1000 square feet of useable area. And the parking requirements for education/schools are 1.5 spaces per staff member. There are 17 proposed classrooms, therefore 17 staff to be factored for the amount of parking. The worship space will accommodate 762 people, requiring 191 stalls. The office spaces consist of 1,627 square feet, requiring 5 stalls. And the 17 classrooms (17 staff) factors out to 26 spaces. The total potential parking demand is 222 spaces. Therefore, the parking provided on site is more than adequate to fulfill our needs. In fact, there are 19 additional spaces to accommodate visitors and overflow. It is important to note that the classrooms and worship space will never be in use simultaneously. There are no changes proposed for any of the other development regulations that apply in the TUC district. No changes to setbacks, landscaping, or height restrictions are proposed. The proposed development shall be compatible generally with the surrounding land uses. As noted earlier, the property is located in the TUC district. The TUC district encompasses a wide mix of uses. Adding a religious facility to the mix will only serve to benefit and enhance the variety of people and experiences in the area, especially on weekends and evenings when the area typically tends to be more dormant. Some of the land uses directly around our property include: retail, office, hospitality, restaurant, warehouse, and manufacturing. The property is also located on the bank of the Green River and is surrounded on three sides by the Green River Trail. Pedestrian and vehicular access is convenient to this site as well as the other properties in the general vicinity, again, something that is particularly important in the TUC district. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The Tukwila Comprehensive Plan (c. 2008) outlines the purpose, vision, and future goals of the TUC district. "The Tukwila Urban Center (TUC) was designated one of the region's urban centers, in keeping with a desire for development as a high-density, regionally oriented, mixed- use center" (pg 109). "The existing Tukwila Urban Center is an economically vibrant, motorvehicle oriented area. It owes much of its success to a high level of regional accessibility and efficient local access roads" (pg 112). Stated goals found in the Comprehensive Plan for the TUC: contain diverse mix of uses, guide development of complimentary and supportive uses (expand range of allowable uses), provide flexible parking regulations and strategies, and attract people and their expenditures to the area. - Bringing a religious facility into the mix of already established uses accentuates and diversifies the TUC district. This, in turn, creates a more vibrant mix of businesses, customers, and residents. - A religious facility will support and compliment existing uses. Many of the uses already permitted in the district have people coming and going only on weekdays during work hours, a religious facility will attract people primarily on the weekends and evenings. As the TUC is also a place for residences and extended -stay living facilities, adding a church to the area will come as a boon to those looking to accentuate their residential experience. -Rather than building new unattractive expanses of blacktop for parking, the church will seek parking covenants for Sunday use (when demand for parking is expected to be at it's highest) with the three adjacent properties (all banks) to fulfill this demand (if needed). -This is a destination parish. A church of this magnitude will draw many visitors from outside of Tukwila on a regular basis, creating a new, larger customer base for surrounding local businesses. -The facility is located for easy access from pedestrians, bicycles, cars, and public transportation...all within keeping of the goals of the TUC. 5. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The real increase and benefit to the surrounding community comes on Sundays and weekday evenings when patrons can disperse after services or classes to surrounding businesses for food, coffee, and shopping. Although I recall speaking with you on the phone about the fence being out of the levy protection easement and inside the landscaping, this should also be reflected in the Building Permit plans as stated in the Conditional Use Permit Criteria: "There are no exterior alterations proposed except the addition of a fence and installation of new signs. The fence shall not be installed on the river protection easement and shall be placed on the interior side of the required landscaping per TMC 18.52.040 (G)." As you are probably aware, the parish will not be allowed on site with and un -approved use until the CUP is approved. Hence the next question from the Parish: once the CUP is approved can they immediately occupy the building? I have informed them that in order to occupy the building a building permit would need to be applied for to address the required upgrades associated with the new church use: barrier free access, emergency exiting , and that the permit would need to be signed off prior to occupancy. They seem to understand the overall picture and we will be in for a building permit before the CUP is approved. The real question is, what would it take to get the Sunday educational program, 120 kids for 1 1/2 hours on Sunday afternoon, down into the existing building as soon as the CUP is approved. Is there some type of permit / review either in conjunction with the overall building permit or separate avenue you might consider? The parish is desperately looking for some direction so they can plan out a direction for their spring / summer programs and do not want to mis-lead the congregation. Religious institutions with an assembly area greater than 750 sq. ft. are permitted within the TUC zone provided a Conditional Use Permit is approved by the Hearing Examiner. (TMC 18.28.040 (4)). 2. The proposed use is consistent with the City's adopted Comprehensive Plan goals and polices. 3. The applicant is proposing a change of use to the existing building, which was used as a warehouse and a manufacturing facility, to a religious church use. 4. No exterior alterations are proposed except for the addition of a fence and signs. The fence shall be installed outside the river protection easement and inside of the required landscaping. Any proposed signs shall comply with the City's Sign Code. 5. There are 241 parking stalls available on the property and the property meets the parking requirements of one space per 4 fixed seats. If additional seats are proposed or if parking demand is not met on the property, the applicant shall be responsible for obtaining Shared or Covenant Parking Agreements with the adjoining properties.
