A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, which is by July 10, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $515 plus additional fees if review time exceeds 5 hours. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Aerial Photos FINDINGS Vicinity/Site Information Project Description: The applicant is requesting approval of a Type 1 Wireless Facilities Permit to replace three existing antennas on the rooftop and install one new equipment cabinet on the ground.. Sprint proposes to remove two existing equipment cabinets located on ground level to install one new equipment cabinet in the existing enclosure. Existing Development: The property is approximately 200,471 square feet in size and there are currently three office buildings located on the site. The site also includes a large number of parking stalls and outdoor storage. The buildings on the site are 23 feet six inches in height. Surrounding Land Uses: The subject property is surrounded by commercial and light industrial uses. The project area is bordered to the south by an on ramp to Interstate 5. Martin Luther King Jr. Way borders the property to the east. On the east side of Martin Luther King Jr. Way is a self- storage business. To the north subject property is large commercial property currently used for warehouse operations. The Lindal Cedar Homes and Interstate 5 border the property to the west. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new stand alone Wireless Communication Facility (WCF) within the City. The applicant is proposing to replace existing antennas with new antennas located on building C. The proposed cabinets will replace two existing equipment cabinets located on the ground level, screened by a six foot chain link fence and existing landscaping. General Requirements (TMC 18.58.070) The City provides general design standards for the placement of WCF within the City of Tukwila. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 4. Sprint has a business license for this specific location as required by TMC 18.58.070 (2). The purpose of the business license requirement is so that City staff has contact information for the actual entity utilizing the WCF. DECISION The application for a Type 1 WCF is approved with no conditions. Sprint is licensed to operate in the United States by the Federal Communications Commission (FCC). This proposal describes the scope of the proposed project by providing specific information regarding the project location, zoning, specifications, and required services. It is Sprint's desire to work with the City of Tukwila to ensure that this project is consistent with local ordinances and zoning regulations while providing wireless coverage to Sprint's customers and provide critical communication services for emergency, business, and personal use. Project Goals The goal of the Sprint SE25XC333 McQueen site is to upgrade Sprint's existing network to provide better telephone service. Sprint intends to achieve these network goals consistent with all policies and ordinances of the City of Tukwila. Application Request Plan The applicant is requesting the following: ■ Type 1 Land Use Review ■ Commercial Building Permit Sprint Spectrum SE25XC333 McQueen Page 1 GENERAL PROJECT DESCRIPTION Project Overview The applicant, Sprint, proposes to modify an existing wireless facility at 14240 Interurban Avenue South. Sprint is proposing to replace/upgrade three (3) existing antennas and install one (1) new equipment cabinet to a rooftop wireless facility. After system testing, Sprint will remove two (2) existing equipment cabinets and install one (1) new equipment cabinet. Facility Specifications ■ Antennas - Sprint is proposing to replace/upgrade three (3) existing antennas at rooftop wireless facility. Please see Sheet A-2 and A-4 for additional information. • Facility Maintenance - The facility is generally serviced once a month. One (1) to two (2) employees are on site for an average of four (4) hours of maintenance checks. This check is typically for preventive maintenance purposes. In the event of a problem, a crew is dispatched to the site immediately. Sprint Spectrum SE25XC333 McQueen Page 2 GENERAL SITE ANALYSIS Zoning General Plan Designation The site is zoned Light Industrial (LI). Sprint's proposed telecommunication facility requires a Type 1 Land Use Review according to Tukwila Municipal Code (TMC) 18.58.050: A. Applications will be reviewed based on the type of wireless communication facilities requested to be permitted. Accordingly, Sprint is requesting the review and approval of a Type 1 Land Use Review and Commercial Building Permit approval. Noise According to TMC 18.58.070: Splint Spectrum SE25XC333 McQueen Page 3 1. Noise - Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise". A noise report, prepared by an acoustical engineer, shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. Sprint's equipment will meet all applicable noise standards. Business License Requirement According to TMC 18.58.070: 2. Business license requirement - Any person, corporation or entity that operates a wireless communication facility within the City shall have a valid business license issued annually by the City. Any person, corporation or other business entity which owns a tower also is required to obtain a business license on an annual basis. Sprint will maintain an active business license with the City of Tukwila. Signage According to TMC 18.58.070: 3. Signage - Only safety signs or those mandated by other government entities may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. No signs will be on-site unless required by either the FCC and/or FAA. Parking According to TMC 18.58.070: 4. Parking - Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of the proposed facility. Existing on-site parking provides adequate parking for the existing facility. Sprint Spec/rum SE25XC333 McQueen Page 4 Finish According to TMC 18.58.070: 5. Finish - A tower shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA or FCC, be painted a neutral color so as to reduce its visual obtrusiveness. The rooftop antennas and associated mounting hardware will be screened within a radome shroud. Design According to TMC 18.58.070: 6. Design - The design of all buildings and ancillary structures shall use materials, colors, textures, screening and landscaping that will blend the tower facilities with the natural setting and built environment. The rooftop antennas and associated mounting hardware will be screened within a radome shroud. Color According to TMC 18.58.070: 7. Color - All antennas and ancillary facilities located on buildings or structures other than towers shall be of a neutral color that is identical to or closely compatible with the color of the supporting structure so as to make the antenna and ancillary facilities as visually unobtrusive as possible. The screening shroud will be painted to match the existing building conditions. Lighting According to TMC 18.58.070: 8. Lighting - Towers shall not be artificially lighted unless required by the FAA, FCC or other applicable authority. If lighting is required, the reviewing authority shall review the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. No strobe lighting of any type is permitted on any tower. No lighting will be on-site. Splint Spcciruin SIs2.5XC333 McQueen Page 5 Advertising According to TMC 18.58.070: 9. Advertising - No advertising is permitted at wireless communication facility sites or on any ancillary structure or facilities equipment compound. No advertising is or will be on-site. Equipment Enclosure According to TMC 18.58.070: 10. Equipment Enclosure - Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building. Equipment will be located within an existing ground equipment enclosure. Height According to TMC 18.58.110: 1. Height - The proposed facility must meet the height requirements of the applicable zoning category. If the building where the facility is located is at or above the maximum height requirements, the antennas are permitted to extend a maximum of 3 feet above the existing roof line. Non -concealed building mounted facilities shall not qualify as "Rooftop Appurtenances" under TMC 18.50.080. According to TMC 18.30.080, the zone height maximum is 4 stories or forty-five feet (45'). Sprint is not proposing to exceed the existing antenna height or the zone height. Please see Sheet A-4 for more detailed elevation information. Antenna Aesthetics According to TMC 18.58.110: 2. Antenna aesthetics - The first preference for any proposed facility is to utilize flush -mounted antennas. Non flush -mounted antennas may be used when their visual impact will be negated by the scale of the antennas to the building. "Shrouds" are not required unless they provide a better visual appearance than exposed antennas. Antennas shall be painted to match the color scheme of the building(s). The antennas will be mounted within a radome screening shroud. Please see the enclosed Photo Simulations for more detailed information. Sprint Spectrum SE25XC333 McQueen Page 6 Feed Lines and Coaxial Cables According to TMC 18.58.110: 3. Feed lines and coaxial cables - Feed lines and cables should be located below the parapet of the rooftop. If the feed lines and cables must be visible, they must be painted to match the color scheme of the building(s). Any feed lines and/or cables visible will be painted to match the color scheme of the building. Cabinet Equipment According to TMC 18.58.110: 4. Cabinet equipment - If cabinet equipment cannot be located within the building where the wireless communication facilities will be located, then it must be located on the rooftop of the building. If the equipment can be screened by placing the equipment below the parapet walls, no additional screening is required. If screening is required, then the proposed screening must be consistent with the existing building in terms of color, style, architectural style and material. If the cabinet equipment is to be located on the ground, the equipment must be fenced with a 6 -foot -tall fence, and materials shall be used to screen the equipment from view. Barbed wire may be used in the TVS, LI, HI, MIC/L, and MIC/H zones. Sprint's proposed changes to existing equipment cabinets will be contained within the existing ground equipment enclosure. Access/Circulation The site will be accessed by the existing right of entry. There are no traffic impacts associated with these types of facilities as they are unmanned and require infrequent maintenance. Federal Requirements Sprint's proposed telecommunication facility modification will meet or exceed current standards and regulations of the FAA, the FCC, and any other agency of the Federal government with the authority to regulate towers and antennas. Sprint's site will conform to all FAA/FCC regulations, and because the maximum ERP is less than two thousand (2,000) watts and/or the height of the facility is greater than ten meters (10m), an environmental evaluation of radio frequency emissions is exempted per CFR Title 47 Part 24, Subpart E. WAY CITY OF TUKWILA KING COUNTY, WASHINGTON MAY 2013 1 2 INTRODUCTION Hatfield & Dawson Consulting Engineers has been retained by Smartlink, LLC, to evaluate the proposed modifications to the Sprint Nextel ("Sprint") personal wireless facility "McQUEEN", site designator SE25XC333, for compliance with current Federal Communications Commission (FCC) and local guidelines regarding public exposure to radiofrequency (RF) electromagnetic fields. The Sprint facility will be modified as follows: existing panel antennas will be replaced with new panel antennas for proposed LTE operations, and the new antennas will housed inside a cylindrical RF -transparent enclosure. The facility has antennas on the rooftop of the building at 10400 Martin Luther King Jr. Way, Tukwila, in King County, Washington 98178. DESCRIPTION OF EXISTING AND MODIFIED SPRINT OPERATIONS According to information furnished by Smartlink and Sprint representatives, all of the new Sprint panel antennas will be centered at about 30 feet above grade. Thus all of the roof -mounted Sprint antennas are well above head height for persons inside nearby structures, or standing at ground level near the McQUEEN site. All of the antennas on the roof are highly directional in the vertical plane, and they project the majority of the transmitted RF energy horizontally away from the building, and well above all nearby habitable areas. Very little energy is directed downwards towards the nearest occupancies. Therefore RF exposure conditions within the building, and on adjacent properties, due to the combined contributions from all of the Sprint antennas will be well below the FCC public exposure limit, and the limits given in King County code K.C.C. 21A.26.100 "NIER exposure standards." AH of the Sprint antennas are mounted near the southeast corner of the rooftop. Places where a person could stand and be within the active aperture height of the antennas should be designated as an "exclusion zone". It is unlikely that anyone standing outside of the exclusion zone could approach near enough to the Sprint antennas to cause that person's RF exposure to exceed FCC limits. Hatfield & Dawson Consulting Engineers 3 The operation of the modified Sprint facility, in combination with any nearby wireless facilities, will NOT create significant RF exposure conditions in any occupancy, habitable area or publicly accessible area outside of the exclusion zone. RF EXPOSURE ANALYSIS Sprint RF engineers have provided the following detailed information about the modified Sprint personal wireless operations at the McQUEEN site. The modified facility is authorized to transmit within the 800 MHz Enhanced Specialized Mobile Radio (ESMR) frequency band, approximately 851 — 866 MHz, and within the Broadband Personal Communications Service (PCS) frequency band of approximately 1870 — 1995 MHz. Installation of replacement panel antennas will enable new LTE operations in the Broadband PCS frequency bands. RF power densities and exposure levels are computed in accordance with methods described in Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, OET Bulletin 65, August 1997. Personal wireless and microwave facilities are required to comply with the FCC "Rules & Regulations" 47 CFR §1.1310, Radiofrequency radiation exposure limits. The OET Bulletin 65 describes the methods established by the FCC for predicting compliance with the FCC - specified exposure limits. The exposure limits shown in the table titled "NIER Exposure Standards (1) (6)" in K.C.C. 21A.26.100 "NIER exposure standards" are generally in agreement with FCC exposure guidelines and limits. In any case, since the FCC exposure limits supersede the limits shown in the aforementioned table, compliance is determined by comparing RF field predictions with the general population/uncontrolled environment (i.e., "Public") Maximum Permissible Exposure (MPE) limits allowed by the FCC rules, as specified in 47 CFR §1.1310. The following formula has been used to calculate the power densities at specific locations: S(mW/cm2) = 0.36 x ERP (watts) / (Distance in feet)2 Hatfield & Dawson Consulting Engineers 4 This formula is derived from Equation 9 on page 21 of OET Bulletin 65. It includes the effect of reflections. The Effective Radiated Power (ERP) in a particular direction depends on the vertical and horizontal antenna patterns. A composite vertical antenna pattern is used to determine the predicted power density. This composite antenna pattern is a worst-case envelope that encompasses the maximums of the downward lobes of the vertical patterns of the Sprint antennas. The RF exposure analysis is based on information provided by Smartlink and Sprint representatives, and known characteristics of typical wireless facilities. The analysis provides a "worst-case" model for calculating the maximum "uncontrolled" (i.e., general public) RF power density and exposure condition for a person standing at the nearest approach to the any of the roof -mounted antennas. A six-foot tall person standing at ground level near the McQUEEN building would be 24 feet or more from the center lines of any of the Sprint antennas. The Public RF exposure environment due to the proposed Sprint operations will be well below the FCC limits and the modifications to the Sprint facility will not significantly increase the Public exposure environment. Theoretical calculations and worst-case exposure predictions indicate that exposure conditions in unrestricted, publicly -accessible areas at ground level will be far less than the 100% FCC Public MPE limit due to the modified Sprint facility. It is expected that the Public exposure environment near the McQUEEN building will be less than 12.4% of the Public MPE limit due to all Sprint operations at the project site. Therefore the existing and modified Sprint wireless operations at the McQUEEN site will not have a significant environmental impact as defined by the FCC Public MPE limits. Furthermore, the modified Sprint facility will not cause any nearby existing wireless facility to exceed NIER exposure standards. Hatfield & Dawson Consulting Engineers .f 5 COMPLIANCE WITH FCC AND LOCAL REGULATIONS The FCC has determined through calculations and technical analysis that ESMR and PCS facilities, such as those operated by Sprint, are highly unlikely to cause human RF exposures in excess of FCC guideline limits in publicly accessible areas. However the proposed modifications to the wireless facility will cause areas of excessive exposure conditions on the roof deck because the center lines of the antennas are below head height for persons standing on the deck. Therefore the entire roof deck should be considered an exclusion zone for persons without RF safety training. If this exclusion zone is clearly demarcated and enforced then the modified Sprint Nextel facility will be in compliance with FCC RF exposure guidelines. COMPLIANCE WITH FCC REGULATIONS FOR RF EMISSIONS AND RF INTERFERENCE It is expected that the RF interaction between all of the Sprint wireless operations will be low enough to preclude the likelihood of localized interference caused by the modified Sprint Wireless facility to the reception of any other communications signals. All of the Sprint antennas are sufficiently high enough, and far enough removed from all occupancies, that they are unlikely to cause interference with nearby consumer receivers or other consumer electronic devices. Transmission equipment for the modified Sprint wireless facility is certified by the FCC under the equipment authorization procedures set forth in the FCC rules. This assures that the wireless facility will transmit within the desired base -station frequency bands at authorized power levels. The modified Sprint Wireless facility will operate in accordance with all FCC rules regarding power, signal bandwidth, interference mitigation, and good RF engineering practices. COMPLIANCE WITH LOCAL REGULATIONS Because the modified Sprint facility is expected to be in compliance with federal rules, it is also in compliance with local regulations concerning RF emissions per K.C.C. 21A.26.090 "Interference." Hatfield & Dawson Consulting Engineers I' 6 The following is the complete text of 47 U.S.C. § 332(c)(7)(8)(iv): "No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." CONCLUSIONS BASED ON CALCULATIONS AND REGULATIONS The modified Sprint Wireless facility "McQUEEN", site designator SE25XC333, will be in compliance with current FCC and local rules regarding radiofrequency interference and public exposure to radiofrequency electromagnetic fields provided that access to the roof deck is positively restricted to persons who have received the benefits of RF safety training. This conclusion is based on information supplied by Smartlink and Sprint representatives, and estimates of future RF exposure conditions due to the modified Sprint facility, combined with any existing nearby wireless facilities, in specific areas with the corresponding safe exposure guidelines set forth in the FCC rules, and in King County K.C.C. Chapter 21A.26. The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. Under the Commission's rules, licensees are required to ensure compliance with the limits for maximum permissible exposure (MPE) established by the FCC. These limits have been developed based on guidelines provided by the Institute of Electrical and Electronics Engineers, Inc. (IEEE) and the National Council on Radiation Protection and Measurements (NCRP). Both the NCRP and IEEE guidelines were developed by scientists and engineers with a great deal of experience and knowledge in the area of RF biological effects and related issues. To ensure full compliance with current FCC rules regarding human exposure to radiofrequency electromagnetic fields, the Sprint transmitters should be turned off whenever maintenance and Hatfield & Dawson Consulting Engineers 7 repair personnel are required to work in the immediate vicinity of the Sprint antennas. This safety procedure should apply to all existing and future wireless transmission facilities at the project site.
