I see that a code enforcement file had been opened (C14-0093). It looks like the case was closed last
week. My understanding is it was closed because, per City Attorney, we can't force them to remove it.
However, removing that sign was part of their design review process from file L13-037.
I am assuming we approved design review based on good faith that they would follow through.
This was Brandon's file and I am not sure if you want to talk with him about this or if we have to just
leave the issue dead. But I wanted to pass this information along.
Please let me know what ends up happening so I can make notes in my file.

Re: Your sign at 16201 W VALLEY HWY
Dear Property Owner,
In August 2010, the City of Tukwila adopted a new Sign Code. This new code was developed through a lengthy
process that included an advisory Committee with residents and businesses, public outreach and several public
hearings. The result of this in-depth update process was the creation of a flexible sign code that permits many
businesses and property owners to install more signs than were permitted under the previous sign code.
Recently, City staff completed an inventory of all freestanding (pole) signs within the City. Through this inventory,
the City has determined that the freestanding sign currently located on your property at 16201 W VALLEY HWY
was made non -conforming by the adoption of the new sign code. A picture of the non -conforming sign is enclosed
for your convenience.
Given that it appears that the sign located on your property complied with the provisions of the previous sign code,
a ten year grace period is provided to allow you to continue' to use the sign. During the ten year grace period you*
may, with a permit, reface and complete copy changes to the sign. Please note that during the grace period the
height and location of the sign cannot change. After the ten year grace period you can keep the sign indefinitely,
but any proposed refaces or copy changes will require the sign to come into conformance with the City's sign
regulations.
In order to preserve the non -conforming status of the sign, you must obtain a free non -conforming sign permit
within 180 days of this notice by completing and returning the enclosed permit application. As part of staff's review
of your permit, we will attempt to determine if the sign was legally installed and whether all changes to the sign met
the sign code in effect at the time. We may ask you for additional information to assist us. If you do not obtain
the required permit within 180 days of this notice, the non -conforming sign must either be removed or
immediately brought into compliance with the new Sign Code.

This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170 on the following project
and permit approval.

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§ 18.104.010.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing
Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 -days of the
issuance of this Decision, that is by April 8, 2014.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Hearing Examiner based on the testimony and documentary evidence presented at the open record
hearing. The Hearing Examiner decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is
properly filed in Superior Court within such time limit, the Decision on this permit will be final.
The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending
permit applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The
project planner is Brandon Miles, who may be contacted at 206-431-3684 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

Existing Site Conditions:
The site is currently developed as an existing hotel and consists of 11 separate buildings on the site. There
is also an outdoor pool, tennis court, and parking on the site. No changes are proposed to the site or
building layout.
Description of Proposal:
The applicant has proposed to complete exterior renovations to the buildings located on the site. The
exterior renovations consist of removing and replacing the existing siding and trim. The siding and trim
will have the same soft cream colors as the existing siding. The application also proposes to replace the
wooden guardrails on the balconies with aluminum.

Tukwila Municipal Code (TMC) 18.60.030 (2) (a) requires design review for the applicant's proposed
project. Given that the applicant was only proposing to complete minor exterior modifications to the site,
the City agreed to process a limited scope design review application. The City would only require that the
landscaping on the site be upgraded.

The project is categorically exempt from SEPA review.
IV. COMPLIANCE WITH DESIGN REVIEW REGULATIONS
A. Relationship of Structure to Site
i. The site should be planned to accomplish a desirable transition with streetscape and to
provide for adequate landscaping and pedestrian movement.
ii. Parking and service areas should be located, designed, and screened to moderate the visual
impact of large paved areas.
iii. The height and scale of each building should be considered in relation to the site.

C. Landscaping and Site Treatment
i. Where existing topographic patterns contribute to beauty and utility of a development,
they should be recognized, preserved and enhanced.
ii. Grades of walks, parking spaces, terraces and other paved areas should promote safety and
provide an inviting and stable appearance.
iii. Landscaping treatment should enhance architectural features, strengthen vistas and
important axis, and provide shade.
iv. In locations where plants will be susceptible to injury by pedestrian or motor traffic,
mitigation steps should be taken.
v. Where building sites limit planting, the placement of trees or shrubs in paved areas is
encouraged.
vi. Screening of service yards, and other places that tend to be unsightly, should be
accomplished by the use of walls, fencing, planting or combination.
vii. In areas where general planting will not prosper, other materials such as fences, walls, and
paving of wood, brick, stone, or gravel may be used.
viii.Exterior lighting, when used, should enhance the building design and the adjoining
landscape. Lighting standards and fixtures should be of a design and size compatible with
the building and adjacent area. Lighting should be shielded, and restrained in design.
Excessive brightness and brilliant colors should be avoided.

Staff Notes:
The site currently meets the City's landscaping requirements for perimeter landscaping; however, the site does
not comply with the City's standards for parking landscaping. In lieu of adding parking lot landscaping, which
would have likely required that parking be reduced, the City worked with the applicant to install landscaping along
the Green River, located along the subject property. Pursuant to TMC 18.70.090, the Director may waive certain
landscaping requirements when strict compliance would create substantial practical difficulties. Attachment A is
a landscaping plan that shows a significant amount of native vegetation being installed within the shoreline
environment of the Green River. Attachment A was prepared by a landscaped architect and was reviewed by the
City's Urban Environmentalist and the Muckleshoot Indian Tribe. The plantings along the River will assist in
providing additional shade and habitat for certain small mammals and birds.

D. Building Design
i. Architectural style is not restricted; evaluation of a project should be based on quality
of its design and relationship to its surroundings.
ii. Buildings should be appropriate scale and in harmony with permanent neighboring
developments.
iii. Building components such as windows, doors, eaves, and parapets should have good
proportions and relationship to one another. Building components and ancillary parts
shall be consistent with the anticipated life of the structure.
iv. Colors should be harmonious, with bright or brilliant colors used for accent.
v. Mechanical equipment or other utility hardware on roof, ground or buildings should be
screened from view.
vi. Exterior lighting should be part of the architectural concept. Fixtures, standards, and all
exposed accessories should be harmonious with building design.
vii. Monotony of design in single or multiple buildings should be avoided. Variety of
detail, form and siting should be used to provide visual interest.

Staff Notes:
As discussed above, the applicant is proposing to complete exterior renovations to several existing buildings on
the site. The proposed side is nearly identical to the existing siding. The colors are beige and are "harmonious"
and bright colors are not being used. Replacing the wooden rails of the balconies is being done for safety as well
as to upgrade the character of the building. The aluminum rails will provide a much more cleaner and fresh look
than wood.
E. Miscellaneous Structures and Street Furniture
i. Miscellaneous structures and street furniture should be designed to be part of the
architectural concept of design and landscape. Materials should be compatible with
buildings, scale should be appropriate, colors should be in harmony with buildings and
surroundings, and proportions should be to scale.
ii. Lighting in connection with miscellaneous structures and street furniture should meet
the guidelines applicable to the site, landscape and buildings.

As discussed above, the applicant is proposing to complete exterior renovations to several existing buildings on
the site. No miscellaneous structures or street furniture is proposed. All existing miscellaneous structures, such as
the basketball court, pickle ball court, and outdoor dining areas will remain.
V. Compliance with Other Citv Requirements
The site currently contains a non -conforming freestanding sign that faces towards West Valley Highway. This site
became non -conforming upon the adoption of the new Sign Code in August 2010.
The property owner has failed to register the freestanding sign as part of the City's non -conforming registration
process. Under TMC 19.36.040, a non -conforming sign loses its non -conforming status if the property owner does ofr
obtain a non -conforming permit within 180 -days of being provided notice that the sign is non -conforming. The
City provided a certified letter to the applicant on August 15, 2012, that the sign needed to be registered and the
applicant did not submit the non -conforming sign permit application.
VI. Conclusion
The applicant is proposing to complete exterior renovations to several existing buildings. No new building
footprints, parking or other site work is proposed as part of the project. The various sections of the code that
discuss site layout and building design are not applicable to the applicant's proposed project. As discussed above,
the project does not comply with the City's landscaping requirement for parking lot. In lieu of tearing up the
existing parking lot and adding landscaping, the applicant has proposed to install landscaping within the shoreline
environment of the Green River. The Director has the authority to allow this deviation, pursuant to TMC
18.70.090. This approach seems practical and logical in that it reduced costs to the applicant and provides for
greater public benefit in that it provides vegetation along the shoreline.
The existing freestanding sign is subject to removal because the applicant has not secured a non -conforming
permit as required by TMC 19.360.040. Removal of the sign is a separate action and a Notice and Order will be
issued by Code Enforcement.

3. Applications. Applications for a non -conforming
sign permit shall contain the name and address of the sign user,
the sign owner and the owner of the property upon which the sign
is located, and such other pertinent information as the Director may
require to ensure compliance with this chapter. The Director may
waive specific submittal requirements determined to be
unnecessary for review of an application.
4. Permit Issuance. Any person submitting an
application for a non -conforming sign permit shall use the forms
provided by the Department. The Director shall issue
nonconforming sign permits upon a determination of eligibility. The
Director may require the filing of plans or other pertinent
information where such information is necessary to determine
compliance with this chapter. Appeals shall be filed in accordance
with Section 19.12.120.
C. Loss of Legal Non -conforming Stains. Non -conforming
signs shall either be removed or immediately brought into
compliance with this chapter upon the occurrence of one or
more of the following events:
1. When a non -conforming sign permit is required but
not obtained within 180 days of notice of non-conformance.
2. When an application is submitted to the City for a
project that is subject to design review, on any non -conforming
building -mounted signs on the premise affected by the construction
and all non -conforming free-standing signs lose their non-
conforming status.
3. When any panel or copy changes are proposed after
the expiration of the grace period.
4. When the sign meets the definition of abandoned.
5. Damage of 25 percent or more in the value of either
the non -conforming sign or the structure to which it is affixed.
D. IV1iintenance. Ordinary maintenance and repair of a sign
shall be permitted without loss of nonconforming status if the cost
of all maintenance and repair over a two-year period is less than
25 percent of the cost of replacing the sign.

19.36050 Existing Freeway Interchange Signs
Signs classified as freeway interchange signs under the
previous Sign Code are permitted to remain for a five year
grace period starting from the effective date of this ordinance.
During the grace period, freeway interchange signs may have
unlimited refaces and copy changes provided the area, height,
and location of the sign remain unchanged. Relocation or re -
erection of the sign during the grace period is not permitted.
Application for a non -conforming sign permit is required for all
sign face or copy changes to a freeway interchange sign. After
the grace period has terminated, application for and issuance of
a sign permit that complies with the Sign Code is required for
any relocation, re -erection, alteration, replacement or change in
any way to the structure or sign panel/face/copy.

1a3fi060 Non -Conforming Temporary Signs
A. Non -conforming temporary signs must be removed
within 30 days of the adoption of this code or the expiration of
their sign permit, whichever comes first.
B. Commercial real estate signs in existence in the City
prior to the adoption of this code are permitted to remain for up
to three months, after which time the signs must be removed
and any future signage must comply with the terms of this code.

sign. No additional permanent freestanding signs are permitted
on a premises that contains a non -conforming freestanding

19.36080 Financial Incentives - Tukwila International
Boulevard Corridor
In order to assist with the removal of non -conforming signs
within the Tukwila International Boulevard Corridor, the City
Council may develop a grant program to provide financial
incentives to property owners and businesses.
1. Applications to the grant program shall be re-
viewed quarterly and approved by the Director, subject to the
availability of allocated funds.
2. In order to be eligible for grant funding the project
must comply with the following requirements:
a. Sites must be located within the Tukwila
International Boulevard Redevelopment Area, Zoning Code
Figure 18-9.
b. Removal of non -conforming signs listed in
Section 19.36.030 shall have a higher priority than removal of
non -conforming signs listed in Section 19.36.020.
c. Payment of the grant award shall not occur
until after the sign has been removed and properly disposed of.
d. No applicant or business shall receive more
than $2,000 from the grant.
e. The Director is hereby authorized to develop
written procedures for award and administration of the grant
funds.

This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170 on the following project
and permit approval.

Administrative Design Review application does comply with applicable City and state code requirements
and has approved that application, with no conditions.

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§ 18.104.010.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing
Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director' s decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 -days of the
issuance of this Decision, that is by April 8, 2014.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Hearing Examiner based on the testimony and documentary evidence presented at the open record
hearing. The Hearing Examiner decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is
properly filed in Superior Court within such time limit, the Decision on this permit will be final.
The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending
permit applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The
project planner is Brandon Miles, who may be contacted at 206-431-3684 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

Existing Site Conditions:
The site is currently developed as an existing hotel and consists of 11 separate buildings on the site. There
is also an outdoor pool, tennis court, and parking on the site. No changes are proposed to the site or
building layout.
Description of Proposal:
The applicant has proposed to complete exterior renovations to the buildings located on the site. The
exterior renovations consist of removing and replacing the existing siding and trim. The siding and trim
will have the same soft cream colors as the existing siding. The application also proposes to replace the
wooden guardrails on the balconies with aluminum.

Tukwila Municipal Code (TMC) 18.60.030 (2) (a) requires design review for the applicant's proposed
project. Given that the applicant was only proposing to complete minor exterior modifications to the site,
the City agreed to process a limited scope design review application. The City would only require that the
landscaping on the site be upgraded.

C. Landscaping and Site Treatment
i. Where existing topographic patterns contribute to beauty and utility of a development,
they should be recognized, preserved and enhanced.
ii. Grades of walks, parking spaces, terraces and other paved areas should promote safety and
provide an inviting and stable appearance.
iii. Landscaping treatment should enhance architectural features, strengthen vistas and
important axis, and provide shade.
iv. In locations where plants will be susceptible to injury by pedestrian or motor traffic,
mitigation steps should be taken.
v. Where building sites limit planting, the placement of trees or shrubs in paved areas is
encouraged.
vi. Screening of service yards, and other places that tend to be unsightly, should be
accomplished by the use of walls, fencing, planting or combination.
vii. In areas where general planting will not prosper, other materials such as fences, walls, and
paving of wood, brick, stone, or gravel may be used.
viii.Exterior lighting, when used, should enhance the building design and the adjoining
landscape. Lighting standards and fixtures should be of a design and size compatible with
the building and adjacent area. Lighting should be shielded, and restrained in design.

Staff Notes:
The site currently meets the City's landscaping requirements for perimeter landscaping; however, the site does
not comply with the City's standards for parking landscaping. In lieu of adding parking lot landscaping, which
would have likely required that parking be reduced, the City worked with the applicant to install landscaping along
the Green River, located along the subject property. Pursuant to TMC 18.70.090, the Director may waive certain
landscaping requirements when strict compliance would create substantial practical difficulties. Attachment A is
a landscaping plan that shows a significant amount of native vegetation being installed within the shoreline
environment of the Green River. Attachment A was prepared by a landscaped architect and was reviewed by the
City's Urban Environmentalist and the Muckleshoot Indian Tribe. The plantings along the River will assist in
providing additional shade and habitat for certain small mammals and birds.

D. Building Design
i. Architectural style is not restricted; evaluation of a project should be based on quality
of its design and relationship to its surroundings.
ii. Buildings should be appropriate scale and in harmony with permanent neighboring
developments.
iii. Building components such as windows, doors, eaves, and parapets should have good
proportions and relationship to one another. Building components and ancillary parts
shall be consistent with the anticipated life of the structure.
iv. Colors should be harmonious, with bright or brilliant colors used for accent.
v. Mechanical equipment or other utility hardware on roof, ground or buildings should be
screened from view.
vi. Exterior lighting should be part of the architectural concept. Fixtures, standards, and all
exposed accessories should be harmonious with building design.
vii. Monotony of design in single or multiple buildings should be avoided. Variety of
detail, form and siting should be used to provide visual interest.

Staff Notes:
As discussed above, the applicant is proposing to complete exterior renovations to several existing buildings on
the site. The proposed side is nearly identical to the existing siding. The colors are beige and are "harmonious"
and bright colors are not being used. Replacing the wooden rails of the balconies is being done for safety as well
as to upgrade the character of the building. The aluminum rails will provide a much more cleaner and fresh look
than wood.
E. Miscellaneous Structures and Street Furniture
i. Miscellaneous structures and street furniture should be designed to be part of the
architectural concept of design and landscape. Materials should be compatible with
buildings, scale should be appropriate, colors should be in harmony with buildings and
surroundings, and proportions should be to scale.
ii. Lighting in connection with miscellaneous structures and street furniture should meet
the guidelines applicable to the site, landscape and buildings.

As discussed above, the applicant is proposing to complete exterior renovations to several existing buildings on
the site. No miscellaneous structures or street furniture is proposed. All existing miscellaneous structures, such as
the basketball court, pickle ball court, and outdoor dining areas will remain.
V. Compliance with Other City Requirements
The site currently contains a non -conforming freestanding sign that faces towards West Valley Highway. This site
became non -conforming upon the adoption of the new Sign Code in August 2010.
The property owner has failed to register the freestanding sign as part of the City's non -conforming registration
process. Under TMC 19.36.040, a non -conforming sign loses its non -conforming status if the property owner does
obtain a non -conforming permit within 180 -days of being provided notice that the sign is non -conforming. The
City provided a certified letter to the applicant on August 15, 2012, that the sign needed to be registered and the
applicant did not submit the non -conforming sign permit application.
VI. Conclusion
The applicant is proposing to complete exterior renovations to several existing buildings. No new building
footprints, parking or other site work is proposed as part of the project. The various sections of the code that
discuss site layout and building design are not applicable to the applicant's proposed project. As discussed above,
the project does not comply with the City's landscaping requirement for parking lot. In lieu of tearing up the
existing parking lot and adding landscaping, the applicant has proposed to install landscaping within the shoreline
environment of the Green River. The Director has the authority to allow this deviation, pursuant to TMC
18.70.090. This approach seems practical and logical in that it reduced costs to the applicant and provides for
greater public benefit in that it provides vegetation along the shoreline.
The existing freestanding sign is subject to removal because the applicant has not secured a non -conforming
permit as required by TMC 19.360.040. Removal of the sign is a separate action and a Notice and Order will be
issued by Code Enforcement.

Works Department and the Department of Community Development. Please contact each Department if you feel that certain
items are not applicable to your project and should be waived. Application review will not begin until it is determined to be

PUBLIC NOTICE MATERIALS:
7. If the project requires SEPA review: Payment of a $365 notice board fee to Fast Signs Tukwila OR
provide a 4' x 4' public notice board on site within 14 days of the Department determining that a complete
application has been received (see Public Notice Sign Specifications Handout). Mailed notice is not
required.
PROJECT DESCRIPTION AND ANALYSIS:
8. Concurrency test notices for water, sewer, surface water and traffic unless the project is exempt
from SEPA (see SEPA Application Packet).
9. Sewer and water availability letters are required from the provider district if additional plumbing
fixtures are proposed and the area is not serviced by the City of Tukwila. Forms are available at the
DCD office.
10. A written discussion of project consistency with decision criteria. (See Application)
11. Provide two copies of sensitive area studies such as wetland or geotechnical reports if needed per
Tukwila's Sensitive Areas Ordinance (TMC 18.45). See Geotechnical Report Guidelines and Sensitive
Area Special Study Guidelines for additional information.

(f) Storm drainage design at least 90% complete, which meets the King County Surface Water
Design Manual (KCSWDM). Include a Technical Information Report (TIR) including feasibility
analysis if required by the Manual. Call out total existing and proposed impervious surface in square
feet. Include all storm drainage conveyance systems, water quality features, detention structures,

(g) Locate the nearest existing hydrant and all proposed hydrants.
