Parks and Recreation Director. Mayor Van Dusen asked Council to approve his reappointment of Leo Sowinski to a third term on the Planning Commission MOVED BY PHELPS. SECONDED BY BAUCH, THAT COUNCIL CONFIRM THE REAPPOINTMENT OF LEO SOWINSKI TO THE PLANNING COMMISSION. MOTION CARRIED. Mayor Van Dusen noted that the Board of Appeals has been inactive for the past few years. Recently it seems advi- seable to activate the Board. He recommended that Thomas A. Sconzo, Robert B. Fadden. and Robert Rohrback be appointed to serve on the Building Division Board of Appeals. MOVED BY PHELPS. SECONDED BY BAUCH, THAT THOMAS A. SCONZO BE CONFIRMED AS THE MAYOR'S APPOINTMENT TO THE BOARD OF APPEALS. MOTION CARRIED WITH PHELPS VOTING NO. MOVED BY PHELPS. SECONDED BY DUFFIE, THAT COUNCIL CONFIRM THE APPOINTMENT OF ROBERT B. FADDEN TO THE BUILDING DIVISION BOARD OF APPEALS. MOTION CARRIED. MOVED BY PHELPS, SECONDED BY BAUCH. Attorney Martin asked Council to call a brief Executive Session to discuss the N.A.A.C.P. Lawsuit. MOVED BY DUFFIE. SECONDED BY PHELPS. THAT COUNCIL CALL AN EXECUTIVE SESSION AS AGENDA ITEM 9F. MOTION CARRIED. Dennis Robertson said he is representing a group of citizens on McMicken Hill that would like to annex into the City. They have turned in a petition with about 77 signatures. The area covered is between State Highway 518 and South 164th and from the City Limits to 42nd Avenue South. There are approxi- mately 350 voters. Mr. Robertson asked Council to approve their annexation and, secondly. he asked what the best proce- dure is to use. Attorney Martin noted that the election method for annexation would be used. The processing is started by filing the peti- tion with the prosecuting Attorney's Office. He suggested that Council. by resolution. express their intent to annex and that they hold a Special Meeting next Monday to act on this item. MOTION CARRIED. Councilman Bauch said that he would like to discuss the legal matter on annexation during the Executive Session. Mayor Van Dusen presented a plaque to Deanna Skelton for eight years of faithful service as an employee of the City of Tukwila. Mayor Van Dusen declared the Public Hearing open on the pro- posed annexation of property in McMicken Heights adjacent to the City of Tukwila along 51st Avenue South. He asked for comments from the audience. Mr. Eugene Fincher said that he has worked on the annexation and is in favor of it. There being no further comments from the audience. THAT THE CITY ATTORNEY BE DIRECTED TO DRAW AN ORDINANCE PROVIDING FOR THE ANNEXATION OF THE PROPOSED PROPERTY SUBJECT TO THE APPROVAL OF THE BOUNDARY REVIEW BOARD AND TO HOLD A SPECIAL MEETING ON APRIL 9 TO CONSIDER THE ORDINANCE. Public Meeting was called to furnish information and allow questions on the Renton Treatment Plant Project. Terry Monaghan, Manager of Construction Division. with Metro introduced the staff members with him. He explained that the project called the Effluent Transfer System is to remove effluent from the Renton Treatment Plant that is now being discharged into the Duwamish River to Puget Sound. This pro- ject is based on a State Department of Ecology requirement. Three alternative routes are being considered Southern Seahurst Alignment, Northern Seahurst Alignment and Duwamish Alignment. Recently the Metro Water Quality Committee selected the Duwamish Alignment as the preferred alternative. On April 5, the Metro Council of the Whole is scheduled to make a decision on the preferred alternative. The Duwamish Alternative is an 8 foot diameter pipe requiring about 62,000 feet of cut and cover ditch. It goes throughfour jurisdic- tions. Generally, it will cross Fort Dent Park and run up the east side of Interurban Avenue. The outfall proposed in the preliminary engineering is about 600 feet deep and 8,000 feet from shore at Duwamish Head. The cost of the project is estimated to be $202,000,000. Mr. Monaghan said they would continue to be in touch with Tukwila Community Groups and the Planning and Public Works Departments of the City. Where there is a need, private lan- downers will be contacted. Mr. Monaghan answered questions concerning the project. He noted that the railroad right -of -way east of the river was considered but found to be more lengthy and more costly. The minimum depth necessary to bury the pipe is 16 feet with 32 feet being a maximum. Cris Crumbaugh expressed concern about disruption to the com- munity and to business during construction. He asked if the design stage will involve alternative route studies within the designated corridor and would citizens have an oppor- tunity to give input on the exact location of the pipe. Mr. Wilcox. Metro Staff. agreed there would be. They will be out in the community to talk with the groups that would like to participate in the design work as well as the jurisdic- tional agencies. Louise Strander. audience. read from the Environmental Impact Statement. The construction will cause considerable disrup- tion during normal traffic hours and have a serious effect on the firms in the area conducting business. Mrs. Strander said she didn't feel that asking for some alternatives on the Duwamish Alternative is out of line. Other jurisdictions have amenities they are expecting to receive from the project. Mr. Crumbaugh questioned the process once the design within the corridor is started. He asked if the Metro Council will decide the route. Mr. Wilson said it will be done through the detail technical study with input from the jurisdiction. citizens and businesses. Mr. Crumbaugh said the Chamber would like to work with them in this process. Mr. Wilson assured him that business and the public would be included in the process. MOVED BY PHELPS, SECONDED BY DUFFIE. THAT COUNCIL RECESS FOR 10 MINUTES. MOTION CARRIED. Mayor Van Dusen called the Regular Meeting back to order at 8 :15 p.m. with Council Members present as previously reported. Mayor Van Dusen announced that he will be on vacation for four days and Council President Phelps will be the Mayor Pro -Tem. Mayor Van Dusen asked to have discussion on the appraisal of the water tower site on the Executive Session. MOVED BY PHELPS, SECONDED BY DUFFIE. THAT DISCUSSION ON THE APPRAISAL OF THE WATER TOWER SITE BE ON THE EXECUTIVE SESSION. MOTION CARRIED. Councilman Duffie said he has talked with Mr. Monaghan and Metro is willing to have another informal meeting on the Effluent Transfer System for anyone else who has questions. It is important to get more input from the City and business along Interurban. Council President Phelps presented a plaque from the City Council to George Hill for his eight years of service to the City of Tukwila as Councilman. Mr. Hill said he appreciated the new plaque. He has a pre- vious one for four years of service. He said since he is no longer on the Council, there is something else in life. He told Council that the City will endure; you need to spend time with your family. MOVED BY MORGAN, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Attorney Martin read an ordinance of the City of Tukwila, Wash., creating a Sister Cities Committee; designating the qualifications for appointment to the Committee; empowering the Mayor to appoint members to the Committee with the Council's concurrence; and providing for certain duties and responsibilities of the Committee in the fulfillment of its purpose. Authorize purchase of 6 vehicles and 1 motorcycle for Police Department Proposed Ordinance Adding a new Chap- ter 2.42 to the TMC entitled "Civil Service Commission EXECUTIVE SESSION 9:30 P.M. 7 7 Council Member Morgan said she was pleased to see that the cars not used for patrol will be sub compact vehicles and this is the way the order is made out. MOVED BY MORGAN, SECONDED BY PHELPS. THAT COUNCIL ACCEPT THE PACKAGE FOR THE PURCHASE OF VEHICLES FOR THE POLICE DEPARTMENT AS PRESENTED AND AUTHORIZE THE CITY TO PURCHASE SAID VEHICLES. MOTION CARRIED WITH BAUCH VOTING NO. MOVED BY PHELPS, SECONDED BY BAUCH. THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Attorney Martin read an ordinance of the City of Tukwila. adding a new Chapter 2.42 to the Tukwila Municipal Code entitled "Civil Service Commission establishing a system of Civil Service for police officers and firefighters employed by the City of Tukwila; repealing Chapters 2.40 and 2.44 of the Tukwila Municipal Code and establishing an effective date. MOVED BY PHELPS. SECONDED BY MORGAN. THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Council President Phelps noted that Section 2,42.040. Persons included. excludes from Civil Servoce coverage. all clerical. dispatchers, fire inspectors, and mechanics. Mayor Van Dusen said there was no official action by Council to remove this sentence from the ordinance. Council Member Morgan asked the City Attorney to review the role of the Civil Service Commission. Attorney Martin said the role of the Civil Service for Police and Fire is to provide a regular systema- tized method of dealing with demotions, terminations. disciplinary actions. etc.. and to deal with the hiring pro- cess in a fair manner. The statute was created primarily for the protection of the Uniform Services. Chief Lowery said this ordinance, as written, would remove seven positions out of Civil Service. MOVED BY MORGAN, SECONDED BY BAUCH. THAT THE LANGUAGE IN 2.42.050 (PAGE 6) AND THE TABLE OF CONTENTS (PAGE 2) BE CHANGED TO "EXISTING PERSONNEL."
