Dear Mr. Steinburg:
Your approved lot consolidation is enclosed. This document must be recorded at the King County Recorder's office, after
which the recording number must be provided to the City for the process of lot consolidation to be completed.
During a meeting with a mobile food truck owner, Camilo Gutierrez, on July 7, 2013, various options were discussed to
resolve the issue of an unpermitted dining structure the vendor erected on the lot. With the lot consolidation an
accessory structure may be built on the property, but there are limitations on the size, placement and use of any
accessory structure, and related permitting requirements.
The discussion with the Mr. Gutierrez included a proposal to install an accessory shed for dining that did not require a
City of Tukwila building permit, once the lot consolidation was complete. In Tukwila, without a building permit, while a
property owner may install an accessory shed for storage of equipment and tools that is no more than 120 square feet in
floor area, the shed cannot be occupied or used as a dining room. Regardless as to the size of the shed however, if
electrical work or plumbing improvements are included, a City electrical and/or plumbing permit and inspection is
required. In addition, the accessory shed must be built within the lot setbacks which, for your particular lot, are 20 feet
from the front property line and 10 feet from the side property lines.
The City does have property use standards for mobile food vendors that provide for outdoor dining limited to a picnic
table, chairs and an umbrella or temporary membrane structure for shade and weather protection. To discuss or
explore options and requirements for installation and construction of temporary or accessory structures on your
property please call me at 206-431-3675. I would be pleased to meet with you and the vender onsite if you feel it
would be helpful. In the interim, I will follow up with a call once the lot consolidation process is complete. Thank you.

The Short Subdivision Committee has completed their review of the above -referenced lot consolidation application.
Preliminary approval of the lot consolidation is approved, subject to the following conditions. These conditions are to
ensure compliance with the City's Zoning, Fire, and Public Works requirements. All conditions must be satisfied prior to
final approval and subsequent recording of the lot consolidation documents.
General Conditions
1) Provide a Lot Consolidation Survey Map for review including file number, vicinity map, declaration,
approval block, land surveyor's certificate, Notary block, etc. — see enclosed sample Boundary Line
Adjustments / Lot Consolidations.
2) Show and label on Lot Consolidation Survey Map all existing Easements. See enclosed recorded easements
and agreements for your information.
Once the above conditions are satisfied you may submit for final approval of the lot consolidation. You may submit
drafts of the lot consolidation document for review in advance if you would prefer. When you resubmit, please
provide four copies of the lot consolidation document, one document must contain the original signatures of all
individuals and entities which have an interest in the property.
Recording
It is your responsibility to record the City approved lot consolidation document with the King County Department of
Records. The lot consolidation is not complete until the recording occurs and copies of the recorded documents are
provided to the Department of Community Development.
After recording, the County returns the recorded originals to the City within four to six weeks at which time your lot
consolidation is considered complete and you can obtain individual building permits for each lot. You can shorten this
process by hand delivering a copy of the recorded lot consolidation with parcel numbers to the Department.
Do not fold or bend the final sheets that will be recorded with King County.
Expiration
The final lot consolidation must be filed with the King County Department of Records by November 21, 2014, exactly 12
months from the date of this preliminary approval, or the application will expire. Please keep this date in mind in the
coming months. The City is in no way obligated to remind you of this expiration date.

A. Grantor is the owner of the property described in the attached Exhibit A
("Burdened Land"), which by this reference is incorporated herein. Grantor has agreed to
grant an easement over under and through said land in favor of Grantee for purposes of

("Benefited: Land"), which by this reference is incorporated herein and desires to obtain an
easement under, over and through the.land owned by Grantor for the purposes of creating a
utilities easement, including conrrectingznto and using the already constructed sanitary sewer
line and:installing a'storm drain pipe:withhin ,an already existing easement on the Burdened
Land as describedin this agreement.";;
NOW, THEREFORE,:.in consideration of the foregoing recitals and the mutual
undertakings ofthe.patties Set forth below, the undersigned parties agree as follows:
1. Grant of Easement. In consideration of themutual proriises set forth herein,
Grantor conveys and grants to Grantee, their heirs 'and successors a non-exclusive easement
over, under and through the Burdened Land iii favor ofthe Benefited Land as shown cross-
hatched on the attached Exhibit C and legally described in* Easement for Sanitary Sewer
recorded under King County Recording Number 4$62263 which Iegal.deseription in
incorporated herein by this reference ("Easement") °ftifthe purpose of constructing a storm
drain line within the Easement, together with the right to use the already'existing Val' Vue
sanitary sewer line located within the Easement.
Notwithstanding the above Easement location or those shown inthe exhibits hereto, itis
agreed -that Grantor may relocate to another location on the Burdened. Land the Easement
granted hereunder and the Sewer and/or Storm drain line, in Grantor's discretion. grantor
shall procure any required.consents and easements with respect to the Easement, storm drain
line and .aanitary sewer line. -Such relocation may be necessary because'of possible future
development of Grantor's -Burdened Land. The cost to relocate said sewer and;storm dram
line will be at Grarttor's''expense. The parties shall cooperate with each other in executing
and recording thenecessary documents to: relocate the sewer and storm drain lines.
2. Purpose and Maintenance. The purpose for this easement is to allow the
Grantee to connect iifto:and use the existing Val Vue sewer line located with the Easement
and to construct and maintaikstonn, drain pipes and utilities over, under and through the
Easement as shown by the cross -hatched area on the attached Exhibit "C". Grantee shall at
all times have full responsibilitkfor the installation andmaintenance of the Easement
sanitary sewer and storm dram system and to the,exterit that any such installation or
maintenance shall require excavation on the Easement, the Grantee shall bear the full risk,
cost and expense thereof and return the Easement to its' original;eondition or better upon
completion of the work.. Grantor hereby grants a temporary 90°calendar day nonexclusive
easement for purposes related to the construction and maintenance of;the Easement under
and through the Burdened Land, provided that, to the extentor,maintenance
requires activity on portions of the Burdened Land other than the Easement, Grantee shall
return such land to the same condition as prior to such work. The Grantor also grants to the

Grantee the right to use only the sanitary sewer and storm drain located on the Easement for
thepassage of sewage and storm drain water from the Benefited Land and for that purpose
atsothe right to install, repair and maintain pipes sufficient to carry such sewage and install

to connect future storm water pipes and systems to,, and use, the storm drain system and
sewer line's which:Grantee is insta11i4hereunder5 provided however, that the additional
flows can be accommodated by the 'System Grantee *stalls. No fee of any kind shall be
charged for said ConneCtion. This Easement is conditioned upon Grantee's assignment to
Grantor of a right to use a portion ofGrantee's capacity obtained under the Easement
Agreement recorded under .King County Recording Number 20051028902375 and the
continued consent of Val Vue to Use its easement : for Sanitary Sewer recorded under King
County Recording Number 486263,•.' IrGrantor is unable to connect into and use the
sanitary sewer and/or drain system; by reason ofthe failure:Of assignment or revocation of
consent, Grantor shall provide Grantee with written notice of his intent .to 'cancel the
Easement and, if Grantee is unable to provide acceig'Within.iix (6) months ofsuch written
notice, Grantor may cancel the Easement upon recording of an EasemeriTermination.
3. SuccessorS. This Agreement shall be binding upon these parties and shall inure
to the benefit of and be binding upon their respective successors: and assigns, heirs and
administrators for all time. For the purposes of this agreement relating 10 future duties and
benefits, the terms Grantor and Grantee shall refer respectively to the then owner of the
Burdened Land and the Benefited Land.

:..4. Indemnity. Each p.arty shall indemnify the other from any and all claims of any
kind or nature, including all costs and attorneys' fees associated with the defense of any such
claims arising directly or indirectly on account of acts or omissions of such party, its agents,
contractors or invitees in the use ofthe 'gasement and construction and maintenance of the
utilities authorized herein; provided that; this section does not purport to indemnify against
liability for damages arising Out of injury to persons or damage to property caused by or
resulting from the negligence of the party seeldng indemnification.

5. Attorneys Fee. In the event a party is obliied to seek judicial.relief to enforce the
terms of this agreement, then the prevailing party shall be entitled to recover his or her actual
attorney fees and cost, including those incurred in arbitration and or on appeal, from the
other party.

6. Running Covenants. The covenants, terms and conditions contained in this
agreement touch and concern the land described in the attached Exhibits A and B and benefit
and burden those lands, and all subdivided portions thereof, and shall bind all future owners

together;with the right to connect into and use the already existing Val Vue sanitary sewer
:line easement: located on the Burdened Land and described in the easement recorded under
King County Recording number 4862263 ("Val Vue Easement') and install and maintain a
storm drain line within the Val Vue Easement. Notwithstanding the above Easement
locationor those shown in the exhibits hereto, it is agreed that Grantor may relocate to
another location on -the Burdened Land the easements granted hereunder and the sewer
and/or storm drain line, it Grantoei discretion Grantor shall procure any required
consents.and easements With respect to the Val Vue Easement. Such relocation may be
necessary because of passible future development Of Grantor's Burdened Land, The cost
to relocate said sewer an:istorm drain line will beat Grantor's expense. The parties shall
cooperate with eaefi other in executing and recording the necessary documents to relocate
the easement(s), sewer:: and storm.:drain.lines.
2. Purpose and Maintenance..;' The purpose:for this easement is to allow the
Grantee to construct and maintain:.:a sanitary sewer line, and storm. drain pipes and utilities
over, under and through the Easementin order to install a'storm drain.system on the
Easement and within the existing Val Vue Easeme ►t.as well: as a sanitary sewer line
with the Easement in order to connect with and use the:already existing• Val Vue sanitary
sewer line easement located on the Burdened Land. and as shown by:the,cross-hatched`area
on the attached Exhibit "C". Grantee shall at all timeshave full responsibility for the
maintenance of the Easement sanitary sewer and storm drain system and to.;the:: extent that
any;such installation or maintenance shall require excavation on the Easement; the Grantee
shall bear the:full risk, cost and expense thereof and return the Easement; to its original
condition or better upOn completion of the work. Grantor hereby grants'a temporary 90
calendar easement for purposes related to the construction and Maintenance
of the Easement under and through the Burdened Land, provided that, to the.extent such
installation or maintenance requires•'activity on portions of the Burdened Land other than
the Easement, Grantee shalt return such land to the same condition as prior to such work.
The Grantor also. grants to, the Grantee the right to use only the sanitary sewer and storm
drain located on th+e..Val. Vue Easement:for the passage of sewage and storm drain water
from the Benefited Land and for that purpose also the right to install, repair and maintain
pipes sufficient to carry such sewage and. install utilities at Grantee's expense; provided
however, that upon Grantor's substantial future development of the Burdened Land, future
maintenance and repair costs of the Val Vue Easement sanitary sewer and/or storm drain
(if used by Grantor) shall be shared equally by Grantor and Grantee: Grantee hereby
consents and assigns to Grantor at Grantor.'.s'expense to connect future storm water pipes
and systems to, and use, the storm drain system and•sewer lines, which Grantee..is
installing hereunder; provided however, that the additional flows can be accommodated by
the system Grantee installs. No fee of any kind shall` be charged for said: connection. This
Easement is conditioned upon Grantee's assignment to Grantor ofa right to.;usea portion.`
of Grantee's capacity obtained under the Easement Agreement recorded under King
County Recording Number 20051028002375 and the continued corsent of:Val Vue to use...,

Ofconstructing„: rePairipgand maintaining a storm drain and for utilities. Tho Grantor
grants to the Grantee the right:to install, repair and maintain pipes sufficient to carry such
sewage and storm dram water arid install utilities at Grantee's expense.
3. Successors This Agreement shall be binding upon these parties and shall inure to
the benefit of and be binding upon their respective successors and assigns, heirs and
administrators for all time. For the purposes of this agreement relating to future duties and
benefits, the terms Grantor and Grantee shall refer respectively to the then owner of the
Burdened Land and the Benefitted Land .
4. Indemnity. Each party shall indemnify thebther from any and all claims of any
kind or nature, including all costs and attorneys' fee associated with,the defense, of any
such claims arising directly or indirectly on acesount:. of acts or omissions Of.sticii party, its
agents, contractors or invitees in the use of the Easement, provided that,.this section does
not purport to indemnify against liability for damages arising Mit of injury to persons or "

COMPLETE APPLICATIONT CHECKLIST
The materials listed below must be submitted with your application unless specifically waived in writing by the Public
Works Department and the Department of Community Development. Please contact each Department if you feel that certain
items are not applicable to your project and should be waived. Application review will not begin until it is determined to be
complete. ADDITIONAL MATERIALS MAY BE REQUIRED.
The initial application materials allow project review to begin and vest the applicant's rights. However, the City may require
additional information as needed to establish consistency with development standards.
City staff are available to answer questions about application materials at 206-431-3670 (Department of Community
Development) and 206-433-0179 (Department of Public Works).

PROJECT DESCRIPTION AND ANALYSIS:

7. Clearly establish status as separate legal lot(s) of record (per TMC Title 17 and RCW Chapter
58.17), showing all known easements and encumbrances.
8. Provide any required maintenance agreements, easements or other documents ready for recording.
Items 9 through 11 NOT required for lot consolidations or BLAs without vacant lots
9. Provide King County Health Department approval if there are any septic systems on site.
10. Sewer and water availability letters are required from the provider district if the area is not serviced
by the City of Tukwila. Forms are available at the DCD office.
11. Provide two copies of sensitive area studies such as wetland or geotechnical reports if needed per
Tukwila's Sensitive Areas Ordinance (TMC 18.45). See Geotechnical Report Guidelines and Sensitive
Arca Special Study Guidelines for additional information.
RECORDING DOCUMENT: Templates are available from the City
2. (a) The recording document must meet the King County Assessor's recording format requirements
(letter, legal or record of survey format). Only documents prepared by a surveyor may be in record of
survey format (18" x 24").
(b) Drawing must include a graphic scale, space for the City of Tukwila file number and north
arrow. It shall include the elements listed at TMC 17.08.030(B).

(c) Provide legal descriptions of all lots before and after the proposed changes.
(d) The recording documents must include signature blocks for the owner(s), Short Subdivision '
Committee, Assessor, and Recorder (listed on the template, see TMC 17.04.060).
(e) Existing and proposed lot lines shall be shown solid with new lines called out and lot lines to be
removed shall be shown dashed.

gas, telephone, cable).

13. (a) Location of all sensitive areas (e.g. streams, wetlands, slopes over 20%, coal mine areas and
important geological and archaeological sites). For stream frontage provide existing and proposed top
of stream bank, stream bank toe, stream mean high water mark, and base flood elevation (i.e., 100 yr.
flood). Maximum sheet size 24" x 36".
(b) Location of all required sensitive area buffers, setbacks, tracts and protection measures.
(c) Show all significant trees (4" or more in diameter measured 4.5 feet above grade), indicating
those to be retained and those to be removed. A tree permit will be required for removal of any
significant trees within a sensitive area or its buffer.
(d) Show proposed lot and tract lines.
CIVIL PLANS:
NOT required for lot consolidations or BLAs without vacant lots
14. (a) Include a graphic scale and north arrow. Maximum sheet size 24" x 36".
(b) Vertical datum NAVD 1988 and horizontal datum NAD 83/91. Conversion calculations to
NGVD 1929, if in a flood zone or flood prone area.
(c) Existing and proposed utility easements and improvements, on site and in street (water, sewer,
power, natural gas, telephone, cable). Schematic designs to be provided regardless of purveyor (e.g.
site line size, location, and size of public main). No capacity calcs, invert depth, valve locations or the
like are needed.
(d) Storm drainage design at least 90% complete, which meets the King County Surface Water
Design Manual (KCSWDM). Include a Technical Information Report (TIR) including feasibility
analysis if required by the Manual. Call out total existing and proposed impervious surface in square
feet. Include all storm drainage conveyance systems, water quality features, detention structures,
maintenance access and safety features. For additional guidance contact Public Works or go to

(e) Locate the nearest existing hydrant and all proposed hydrants.
(f) Show the 100 yr. flood plain boundary and elevation as shown on FEMA maps.
(g) Plan, profile and cross-section for any right-of-way improvements.
(h) Show planned access to lots, driveways, fire access lanes and turn-arounds.
(i) Show the location and distance to proposed property lines of all existing structures, indicating
those to be removed.
(j) Show proposed lot and tract lines.
