AN ORDINANCE OF THE CITY COUNCIL OF THE CIITY OF TUKWILA, WASHINGTON, ADOPTING T HE BIENNIAL. BUDGET OF THE CITY OF TUKWILA FOR T HE 2021-2022 BIENNIUM, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN IEJIFFECTIiVE; DATE. Ordinance 2641 was amended or repealed by the following ordinances. WHEREAS, the preliminary budget of the City of Tukwila forthe 2021-2022 biennium was submitted to the City Council in a timely man nerfortheir review; and WHEREAS, a Public Hearing on the proposed budgetwas advertised and held on November 9, 2020; and WHEREAS, as budget oversight is one of its key legislative responsibilities, the City Council conducted a thorough process to deliberate the proposed 2021-2022 Biennial Budget; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section1. The City Council hereby adopts the documenten titled "City of Tukwila 2021- 2022 Biennial Budget," incorporated by this reference as if fully set forth herein, in accordance with RCW 35A.34.120. Section 2. Cost of living adjustments (COLAs) for non -represented employees shall be implemented perthe City Council's Compensation Policy. Section3. Staff is authorized togo to bid on Phase 1 of the Pu blicWorks Shop Project improvements to the former Heiser facility, at the current estimate of $8,567,000.00, funds forwhich are reflected in the proposed budget dollars shown. The City Council retains final decision on this project once the bids are received and the actual cost is known. A complete copy of the final budgetfor2021-2022, as adopted, together with a copy of this adopting ordinance, shall be kept on file electronicallyby the City Clerk and accessible from the City's website in accordance with Washington State records retention schedule requirements and City policy, and shall be made availableto the public upon request. A complete copy of the final budget for 2021-2022, as adopted, together with a copy of this adopting ordinance, shall be transmitted by the City Clerk to the Division of Mu n icipal Corporations of the Officeof theState Auditorand to theAssociation of Washington Cities. Upon approval of the City Attomey, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules, or regulations; or ordinance numbering and section /subsection numbering. Section 8. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance orits application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 9. Effective Date. This ordinance ora summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five days after passage and publication as provided by law. Christy O'Flaherty, MMC, City Clerk Published Seattle Times: December 10, 2020 Scrivener's Error — Ordinance 2641 On April 26, 2021, it was determined there had been a version control issue associated with Ordinance No. 2641, which adopted the 2021-2022 budget, passed at the December 7, 2020 City Council meeting. The version that was signed and put in the City's Digital Records Center did not reflect the Council's intent based on the agenda packet and minutes from the December 7, 2020 Council meeting, The ordinance to be adopted appeared in the agenda packet for that meeting. It was the correct version in draft format, showing a few additional revisions made during a 2021-2022 Budget Workshop. Following passage at the meeting, an incorrect (earlier) version of the ordinance was circulated for signatures and added to the Digital Records Center. Upon noticing the incorrect version on April 26, 2021, conversations occurred between the City Clerk and the Finance Director and City Attorney, all of whom agreed this was a version control issue and would be treated as a Scrivener's Error. Changes were then made to Pages 1 and 2 of the signed version—to reflect the correct version as it was adopted on December 7, 2020—and the ordinance in the Digital Records Center was updated on May 3, 2021 with the correct version.
