M I N U T E S
Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge of
Allegiance.

MOVED BY HARRIS, SECONDED BY DUFFIE, THAT ITEM 8A BE
CONSIDERED AT THIS TIME. MOTION CARRIED.
MOVED BY PHELPS, SECONDED BY BOHRER, THAT THE PROPOSED
RESOLUTION BE READ. MOTION CARRIED.
Attorney Martin read, in its entirety, a resolution of the
City of Tukwila, Washington, thanking the Andover Terrace
Garden Club for their thoughtfulness.
MOVED BY PHELPS, SECONDED BY DUFFIE, THAT RESOLUTION 908 BE
ADOPTED AS READ.*
Councilman Bohrer requested that, in the future, the Mayor's
signature and the Council President's signature appear at the
same level on the ending format for resolutions since the two
branches of government are independent.

Mayor Van Dusen presented a copy of the adopted resolution to
members of the Garden Club.
Mayor Van Dusen noted the Fire Prevention Show to be held at
Southcenter. He read a Proclamation concerning Fire Service
Recognition Day, May 12 and urging the citizens of Tukwila to
visit the Fire Service Exhibition at Southcenter Mall.
Mayor Van Dusen announced the resignation of Steve Phelps
from the Civil Service Commission.
The Council Committee Chairmen reported on the items being
considered by their respective committees.
Doris Phelps, Council President, reported that there will be
a Public Meeting on Metro's proposal to construct a transit
center in the Tukwila business district. This meeting will be
Monday, April 23, 1984, from 5:30 p.m. to 7:30 p.m.
Mayor Van Dusen reported on his meeting with the driver from
Animal Control. He assured the Mayor that they do regularly
patrol the City. They are trying to keep the problem with
dogs running at -large under control.
Councilman Bauch reported that John Anderson, President of
the School Board attended the Parks and Recreation Committee
meeting. It was suggested that the School Board and the City
Council hold a joint meeting.

purchase 80 stacking chairs and ten 8 foot folding tables
for the upstairs meeting room at Foster Golf Links.
d. An ordinance of the City of Tukwila adopting a new long
range park and open space plan and repealing ordinances

e. Authorize public works to negotiate contracts with con-
sultants for the 1984 Industrial /Commercial Street
Projects. (Christensen Road and Minkler Blvd.)
f. A resolution of the City of Tukwila fixing the time when
the petition will be heard on the vacation of a street.

ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED.
Attorney Martin read an ordinance of the City of Tukwila,
Washington, adding a new Chapter 2.42 to the Tukwila
Municipal Code entitled "Civil Service Commission
establishing a system of Civil Service for Police Officers
and Firefighters employed by the City of Tukwila;repealing
Chapters 2.40 and 2.44 of the Tukwila Municipal Code and
establishing an effective date.
Councilman Bauch noted that this item was brought back on
the agenda for reconsideration. At the Regular Meeting of
April 2 a motion to adopt the ordinance failed by a vote of
3 -yes, 2 -no. The passage of an ordinance requires four
affirmative votes.

BE ADOTEPD AS READ.*
Mayor Van Dusen noted that Section 2.42.040 excludes from
coverage under this chapter all clerical, dispatchers, fire
inspectors, mechanics and other employees of either the
Police Department or Fire Department who are not fully paid
commissioned employees.
MOVED BY PHELPS, SECONDED BY BOHRER, THAT THE ORDINANCE BE
AMENDED BY DELETING THAT PORTION OF SECTION 2.42.040 WHICH
REFERS TO THE CLERICAL AND NON UNIFORM PERSONNEL.

NEW BUSINESS
Council President Phelps said she would like to consider an
extension of the decision since it is a change to the current
situation that we have in the Police Department until a
recommendation comes from the new Police Chief after he is
hired. There is enough disruption within the department
right now.
Attorney Martin made the comment that the trend in Police and
Fire Departments seems to be to have some of the duties not
done by commissioned personnel done by civilians. Anybody
presently employed by the City would continue under Civil
Service. It would only change the status of new employees.
Council President Phelps said she would support this at a
later date; after all, it was inadvertently included in the
ordinance when it was drafted.

Council Member Morgan asked, at Regular Council sessions, who
is the appropriate maker of motions. Is it the Chair of the
Committee that brought the items forward or is it the
Council President? Council President Phelps said tradition
has been that the Council President makes motions in
response to the Mayor's call for action.

Management Agreement
Attorney Martin read a resolution of the City of Tukwila,
Washington, authorizing the Mayor to execute the Green River
Management Agreement.
MOVED BY HARRIS, SECONDED BY MORGAN, THAT THE PROPOSED
RESOLUTION BE ADOPTED AS READ.*
Councilman Bauch said he is against the resolution as they
have taken the financial obligation and divided it by five
without any look at the responsibility.

Authorizing the
Mayor to execute
the Green River
Management Agreement
Mr. Sneva, Public Works Director, said the costs associated
with the agreement are those costs for planning and admi-
nistration of any program agreed upon to study. The
agreement provides that each year the proposed planning stu-
dies and programs are funded for only that year; they are not
carried over. Since 1978 there have been five cooperative
agreements.
Mr. Sneva said the matter of studying the levee from I -5 to
Auburn will determine the levee elevations. All five agen-
cies will share in the study equally.
Council President Phelps said the entire drainage picture of
the Green River Valley System effectsthe City of Tukwila. A
coordinate approach to the river is the only way that Tukwila
could support a study.
Councilman Bauch said the funding should be based on the
benefit derived. He said he can't see that we are getting
20% of the benefits based on the total area involved.
Council Member Harris said the whole welfare of the City
depends on what happens. She would like to make sure we are
part of the study and are protected.
Mr. Sneva said what can be pumped is limited in this
agreement. The cooperating cities would have to increase
their internal systems. They are limited to new modifications
to the river. This agreement does not give anyone the right
to pump into the river. Until more knowledge is obtained,
no one is going to know what will happen. At this point, the
most important thing is to agree and proceed to find out what
height to construct the levees. One of the work items in the
program is further gauging to determine what is happening at
other points along the river. The plan does not include a
line item to specifically address reduced flows from Howard
Hanson Dam.
Councilman Bohrer said that beginning to establish a general
policy that addresses the issue of cost sharing in a more
rational manner than just dividing it in five equal parts is
a worthwhile thing to look at. He questioned why pumping out
of P -17 should cease when the river reaches a certain level
when pumping will be continued at the P -1 station.
Mr. Sneva noted that P -1 drains about 100 acres of Tukwila.
Councilman Bohrer summarized that some further definition of
cost sharing needs to be added; the issue of pumping from
P -17 Channel could be more reasonably defined to assure that
pumping from P -17 is not discontinued while pumping from
other places continues, and a comprehensive study of opera-
tions for potential improvements of the Green River Basin
should be an item in this study.
Mr. Sneva said it is hard to get the Corp of Engineers to
respond until there is a united front to address them.
Council President Phelps asked that the points raised during
this discussion be pursued.
Councilman Bohrer noted that this agreement will be binding
on the City for six years.

Councilman Bauch said the agreement said the first year's
work plan has to be adopted by November, 1984, but it does
not address the subsequent work plans. He said he wanted to
be assured that Council isn't approving any future money.
Attorney Martin said he doesn't believe this agreement would
commit future funding. Section 5.1 says that the parties
agree to present to their legislative bodies the request for
funding equivalent to their respective shares by November,
1984. This is the funding request for 1985.
MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THE MOTION BE
AMENDED TO CONSIDER THIS RESOLUTION AT THE NEXT REGULAR
MEETING AND URGE THE ADMINISTRATION TO CONTACT THE OTHER
JURISDICTIONS FOR THEIR COMMENTS ON THE RESOLUTION AND TO
ALLOW THE CITY ATTORNEY TO REVIEW IT. MOTION CARRIED.
*MOTION CARRIED.
Council Member Morgan requested that Administration draft a
letter to the other participant cities citing the points made
by Council this evening for their consideration.
Councilman Bohrer asked for a summary of the total basin
area, both river frontage and the portion that each of the
five jurisdictions have.
Councilman Bauch said he is not against the study itself;
there are just some open -ended parts in it that will set a
precedent.
