CONSTRUCTION WITHOUT PERMITS
IBC 105.1 (as adopted by TMC 16.04,020) PERMITS REQUIRED
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move,
demolish, or change the occupancy of a building or structure, enlarge, alter, repair,
remove, convert or replace any electrical, gas, mechanical or plumbing system, the
installation of which is regulated by this code, or to cause any such work to be done, shall
first make application to the building official and obtain the required permit. (Emphasis
added)
On February 16, 2021, I observed siding being installed, stacks of siding throughout the
property, dimensional lumber being measured, cut, and taken into the house, piles of
shingles in front of the house, plastic sheeting covering the interior of all windows, and a
new sliding glass door installed on the north side of the house. I also observed a trailer filled
with cut sheetrock, empty boxes of spackling, insulation, an interior door, scrap
dimensional lumber, and other rubbish and garbage.
Researching the City's permit tracking system, I did not find any submitted applications for
building, electrical, plumbing and gas, mechanical, or any other required permits for this
property. I also did not find any issued permits for building, electrical, plumbing and gas,
mechanical, or any other required permits for this property.
Researching a June 28, 2000 building permit 02000-209 for "REPAIR FOUNDATION ON SW
CORNER AS ITIS CONSIDERED A LIFE SAFETY ISSUE," This permit expired on April 14, 2002
without all required inspections completed and was not flnaled.
Researching King County Recorder's Office and discovered the house had sold on December
16, 2020.
Researching Redfin and Zillow provided an overview of the house stating in part "...down to
studs...". The interior list states, in part, "there are three (3) bedrooms, one (1) bathroom,
one (1) full bathroom, daylight basement, and heating features: none". The construction
details list states, in part, "property condition: fixer".
Observation of the photographs attached to the listings depicted the following:
1. Entrance to the house is a single door with a sidelight on the left side of the door.

Corrective Action:
2. Electric meter on the front of the house, left of the front door.
3. There is a chimney located in the front of the house, almost in line with the front
door, approximately three-quarters the way up the roof. I did not observe this
chimney during my February 16, 2021 site visit.
4. The north side of the house has one window on the main floor and a man door for
the daylight basement.
5. The main floor has very little electrical wiring, an electrical panel at the base of the
stairs, insulation, no drywall throughout this floor, no plumbing, no kitchen or
bathroom fixtures, no hot water tank, and no heat source — ie. baseboard or vents,
no furnace.
6. The second floor has drywall throughout, no exterior windows, and the ceiling
appears to be low.
7. The daylight basement has one door and one window, multiple walls that create
individual rooms, no electrical, no drywall throughout this floor, no insulation, a
portion of the slab was removed arid a trench created, no heat source — le,
baseboard or vents, no furnace.
Researching King County Assessor's Analytics, April 25, 2019 provided the following:
1. On the east side of the house there are two windows for the daylight basement,
three windows for the main floor, and significant damage to the roof over the
window located in the middle of the east facing wall.
2. On the north side of the house there is a man door for the walk out basement and
one window on the main floor.
3. On the west side of the house, facing the street, are two windows and a door with
a sidelight on the left side of the door. The electric meter is located to the left of
the door by the corner of the house.
4. On the south side of the house there is one window on the main floor. The
remaining south side of the house is obscured by a tree.
5. The December 23, 2020 Analytics shows two windows on the south side of the
house.
Researching Google Street View, May 2018, shows an entry door located on the south side
of the house with a roof overhang. This door is in the northwest corner of the house. On the
February 16, 2021 site visit, I did not observe this door.
Researching Code Enforcement Case CE20-0112, an August 25, 2020 photograph shows an
entry door located on the south side of the house with a roof overhang. This door Is in the
northwest corner of the house. Another photograph shows several different sidings
attached to the front of the house and the exposed plywood is weathered, There is also a
chimney located in the front of the house, almost in line with the front door, approximately
three-quarters the way up the roof.
Researching Code Enforcement Case CE19-0198, a September 24, 2019 photograph shows
an entry door located on the south side of the house with a roof overhang. This door is in
the northwest corner of the house. There is also a chimney located in the front of the
house, almost in line with the front door, approximately three-quarters the way up the
roof.
1. Immediately stop ALL work which includes, but is not limited to, installation of
drywall, windows, doors, sliding glass doors, electrical, plumbing and gas,
mechanical, kitchen cabinetry, lighting, new walls, the removal of existing walls in
the interior of the house, and work which includes, but Is not limited to,
installation on the exterior of the house of siding, windows, window trim, gutters,
roof (e.g. decking, shingles) decks, roofs over doors, lighting, and 6M work on
the property that requires a permit.
2. No work of any kind can commence untilALL. applicable permits are issued which
include, but is not limited to, Remodel Permit, electrical, plumbing and gas,
mechanical.
3. Submit a Single Family Residential remodel and addition permit application and
Building Plans for the complete remodel / alterations of this house.

UNAUTHORIZED REMOVAL OF CITY NOTICE
TMC 8.45.020 VIOLATIONS
A. Failure to comply with any applicable civil provision of the Tukwila Municipal Code shall
be enforced through the procedures set forth in TMC Chapter 8.45....
B. In addition to specific civil violations enumerated throughout the Tukwila Municipal
Code, the following actions are unlawful and are subject to enforcement through this
chapter: (Emphasis added)
1. It is unlawful for any person to Initiate, maintain, or cause to be initiated or
maintained, the use of any structure, land or property within the City without first
obtaining the permits or authorizations required for the use by the applicable provisions
of any of the Tukwila Municipal Code (Emphasis added)
3. It is unlawful to remove or deface any sign, notice, complaint or order required by or
posted in accordance with TMC Chapter 8.45.
International Property Maintenance Code, Section 108 SECTION 115 STOP WORK ORDER
(adopted by TMC 8.28.020)
[A] 115.3 Unlawful continuance. Any person who shall continue any work after having
been served with a stop work order, except such work as that person is directed to
perform to remove a violation or unsafe condition, shall be subject to penalties as
prescribed by law. (Emphasis added)
On February 17, 2021, I posted a Stop Work Order on the front of the house, next to the
front door. It states, in part:
"VIOLATION: Installation /Alteration of, but not limited to, siding, sliding glass door,
windows.
CORRECTIVE ACTION REQUIRED:
1. Cease all work immediately on the interior and exterior of the house until all
applicable permits have been issued.
2. Submit a Remodel Permit and Building Plans for the work to be performed in / on
the house. This includes but not limited to the following permits: building, electrical to
rewire the house, plumbing and gas, and mechanical by March 17, 2021.
Permits are required for but not limited to siding, windows, rewiring of the house,
plumbing and gas, hot water tanks, decks 30 inches above grade, removal/adding interior
walls."
The Stop Work Order states at the bottom of the document:
"Any violation of a Stop Work Order may be prosecuted with a Notice of Violation and
Order and is hereby declared to be a public nuisance, subject to the assessment of
penalties of $250.00 per day for each violation and costs and legal fees necessary for
abatement (See TMC 8.45.090 and TMC 8.45.120.A.2.a).

Corrective Action:
On February 24, 2017, I observed new shingles on the entire roof and additional siding
has been installed.
On March 3, 2021, a City employee observed workers in the house. He stopped and
informed the workers of the Stop Work Order posted on the front of the house and that
no work is allowed until all permits are issued. He told the workers to stop all work and
leave the premises. He observed the Interior of the house and that all the walls have been
drywalled on the first floor, He also observed that the workers were starting to put in the
kitchen cabinetry in place.
I reviewed the photographs the City employee sent me, and I saw a sliding glass door has
been installed in the kitchen.
Refrain from removing any lawfully posted Notices or letters by the City. These Notices and
letters must be left on the house until an inspector from the City removes these Notices
and letters,
Compliance Date: March 4, 2021
This is a notice that your property is in violation of the Tukwila Municipal Code. You must complete the corrective
action noted above by the compliance date indicated.
FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY OF UP TO
$250 PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PURSUANT TO TMC
8.45.120(2).

NOTICE OF VIOLATION AND ORDER - Per TMC § 8 45 1)70
Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1.The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
