Any owner or authorized agent who intends to construct, enlarge, alter, repair, move,
demolish, or change the occupancy of a building or structure, enlarge, alter, repair,
remove, convert or replace any electrical, gas, mechanical or plumbing system, the
installation of which is regulated by this code, or to cause any such work to be done, shall
first make application to the building official and obtain the required permit.
TMC 8.45.080 Repeat Violations
A. DEFINITION: "Repeat violation" means a violation of the same or similar regulation in
any location by the same person responsible or on the same property for which either: (1)
voluntary compliance previously has been sought within two years; or (2) a Notice of
Violation and Order has been issued within two years.
The City of Tukwila issued a Notice of Violation and Order on May 7, 2019, requiring
building permits for observed renovations to a detached accessory structure (4004 5 1
St) on this property.

Building permit application #D19-0229 expired on January 15, 2020 without having been
approved or issued by City staff.
As of today's date there is no new permit application on file, and thus, any renovations to
the structure are unpermitted and have not been inspected and/or approved by City staff.
Immediately discontinue all use and occupancy of the detached accessory structure
located at 4004 S 150th St,
Submit complete plans and all applicable building permit applications for any renovations
to the structure located at 4004 5 150th St. Renovations include but are not limited to:

Comply with all requirements and stated deadlines of the permitting process, including
prompt response to corrections required by City staff for clarification of the permit
application materials.
Permits are not considered complete until permit is approved and issued, and all required
inspections, including Final, have been approved by a City inspector.
Immediately discontinue occupancy of 4004 5 150th St. until all required building permits
and inspections have been obtained from the City.
Submit complete plans and permit applications for any renovations by February 5, 2021.
Comply with all requirements and stated deadlines of the permitting process.

action noted above by the compliance date indicated.
THIS IS A REPEAT VIOLATION SUBJECT TO IMMEDIATE ISSUANCE OF A NOTICE OF VIOLATION PURSUANT TO
TMC 8.45.080(B). FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY
PURSUANT TO TMC 8.45.080(C) AS FOLLOWS:
1. For the first repeat violation, the penalty may equal up to $1,000 per day;
2. For the second repeat violation, the penalty may equal up to $2,000 per day;
3. For the third repeat violation, the penalty may equal up to $3,000 per day;
4. For the fourth repeat violation, the penalty may equal up to $4,000 per day; and
5. For each additional repeat violation that may occur beyond the fourth repeat violation, the
penalty may equal up to $5,000 per day.

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1,The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any supporting facts;
and
4.A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
