TMC 18,50.220 Accessory Dwelling Unit (ADU) Standards
A. General Standards.
5, Detached ADUs may be a maximum of 800 square feet. If built over a detached garage,
the detached garage would not count toward the area limit for the ADU.
6. Detached ADUs may be up to 20 feet in height, except that an ADU built over a
detached garage may be up to 25 feet in total height.
9. The ADU may not be sold as a condominium or otherwise segregated in ownership from
the primary single-family dwelling.
10. ADUs may not be rented for periods of less than 30 days.
D. Failure to comply with any of the requirements of this section shall be subject to
enforcement and penalties as prescribed in TMC Chapter 8.45 and the issuance of a Notice
of Violation and Order in accordance with TMC Section 8.45.070,
TMC 18.50.230 Accessory Dwelling Unit (ADU) Registration Procedures
A. To gain the City's approval to establish an ADU, a property owner shall submit a
registration form, sign and record an affidavit of owner occupancy, and obtain a building
permit for any necessary remodeling or construction.
C. Illegally -created ADUs must be brought into compliance with the life safety
requirements of the Tukwila Municipal Code, International Residential Code and
International Property Maintenance Code or they must be removed.
D. If either the primary single-family dwelling or the ADU will be rented, a Residential
Rental Business License per TMC Chapter 5.06 must be obtained prior to occupancy of the
unit by a tenant.

On October 13, 2020 City staff found a listing for a short-term rental on the AirBnB
vacation rental website for the accessory structure on this property, known as 4004 S 150th
St (see details from the website listing enclosed below). This detached accessory structure
is part of the same parcel as the primary house 4010 5 150th St, according to King County
Assessor records,
The property is actively listed on the AirBnB website with stated availability for December
11-13, 2020, a period of less than 30 days. The unit is also listed with a rate for nightly
rentals, indicating a short-term rental. The listing states the unit has "3 bedrooms and 1
bath and a huge loft with a king bed." King County Assessor records show 4004 S 150th
("Building 2" on the parcel record) as a 1 bedroom, 1 bathroom 640 square foot unit on
the second floor. King County does not indicate a loft level in this structure.
The City previously issued a Notice of Violation and Order on May 7, 2019 for observed
unpermitted renovations to the detached accessory structure 4004 5 150th St. An
incomplete building permit application #D19-0229 expired on January 15, 2020 without
approval or issuance, and thus any proposed renovations to the structure were not
permitted nor inspected by the City.
As of today's date, there are no active building permits or permit applications for any
renovations to this detached accessory structure, and thus the accessory dwelling unit is
not verified to be in compliance with the life safety requirements of the Tukwila Municipal
Code.
As of today's date, there is no current ADU Registration nor a complete Rental Business
License on file with the City for the detached accessory dwelling unit.
Immediately discontinue all use and occupancy of the accessory structure located at
4004 S 150th.
Submit complete ADU registration form as required by TMC 18.50.230: Accessory Dwelling
Unit (ADU) Registration Procedures,
Comply with all requirements of the ADU Registration process, to include obtaining all
applicable building permits, inspections and approvals.
For a long-term rental unit (over 30 day stays), complete the Rental Business License
process as outlined in TMC Chapter 5.06.
Compliance Date: Immediately discontinue occupancy of 4004 S150th St. until all required registrations,
permits and inspections have been obtained from the City.
Submit complete ADU registration form by January 4, 2021.
Comply with all requirements of the ADU registration process, to include obtaining all
required permits, inspections and approvals.

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1.The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
