Minnie Dhaliwal, Deputy Director, Department of Community Development went over the virtual meeting protocols. Commissioner Martinez moved to adopt the 1/28/21 minutes as written. Commissioner Mann seconded the motion. Motion passed. Chair Strander called the work session to order for: CASE NUMBER: L19-0115 PURPOSE: Segale Properties LLC, the applicant, requests amendments to Title 18, Zoning Code of the Tukwila Municipal Code (TMC) to set standards for residential uses. The proposed amendments are to adopt development standards and guidelines for residential uses in all of Tukwila South; these would apply to all lands and underlying zoning within the TSO district, including replacing those adopted in 2018 for the underlying LDR zone. LOCATION: Properties within Tukwila South Overlay District Max Baker, Senior Planner, Department of Community Development gave an overview of the project. He provided history on the development standards and design guidelines, as well as gave explanation on the current proposal and the intent of the development standards and design guidelines, and the difference between them. Next steps, the public hearing will be held on the proposed project on March 18th followed by deliberations on March 25th for the Commission to make their recommendation to be forwarded to the City Council for their review and decision. Mike Pruett, for the applicant, provided some clarifying comments on the history of the project and intent for the current proposal. He also addressed questions from the PC. He also addressed questions from the PC. Chair Strander opened the public hearing and swore in persons wishing to speak. CASE NUMBERS: L20-0129, L20-0138 PURPOSE: Subdivision Preliminary Plat and Public Hearing Design Review of the Riverton Cascade Homeownership Project. The proposal is to subdivide one lot into 18 unit lots for development of four single-family homes and 7 duplexes. The homes will be for sale to households making less than 80% of the area median income. Associated improvements include recreation space, landscaping, parking, access, and utilities. LOCATION: 3118 S. 140th St. (undeveloped lot north of Riverton Park United Methodist Church on parcel 41623049060) Jaimie Reavis, Senior Planner, Department of Community Development asked the Commissioners the Appearance of Fairness questions and gave the presentation for staff. Commissioner Strander, Simmons and Mann disclosed they had exparte communications; there were no objections to them hearing the case. SUBDIVISION PRELIMINARY PLAT An overview was provided for the proposed project, background information was given on the site, project, and criteria. Explanation was given on the approval process. A Development Agreement was approved for the project in the Fall 2020 by the City Council, which allowed an increase in the allowable density and lot coverage in the Low Density Residential (LDR) zone; decreased lot width and setbacks; sets the number of parking spaces to 36; allowed reduction in impact and permit fees; designated the project go through design review; allowed for additional standards, such as the development of home homeownership project, and energy efficient designs. The project complies with the Comprehensive Plan. Staff is recommending approval with conditions, as listed on pages 93 and 94 of the 2/25/21 staff report. DESIGN REVIEW An overview was provided on site planning criteria, there is circulation for safe walkways for students; clustered parking; crime prevention through environmental design; elements include porches, lighting, fencing, and landscaping, two trees will need to be removed, which will be replaced by the landscaping trees. The project includes energy efficiency and sustainability. Staff recommends approval of the application. Following are some comments / questions from the PC - addressed by staff and Valerie Thiel, the applicant. Commissioner Mann -Expressed concern with fire access to several lots. Staff noted the driveway will be widened and the Fire Department are working with staff to meet access requirements; concern was expressed regarding maintenance of the development, Commissioner Mann said she would like to see the homeowners' association be responsible for all maintenance. She asked when the PC would see the CC & R's; she expressed concern with the parking; suggested security; suggested minimizing use of shingle siding as a building elevation treatment; and suggested metal for the trash screening treatment. He also expressed concern with the lack of natural gas on the development. He said it should be the homeowner's choice and it needs to be added as part of the conversation. Commissioner Simmons said she appreciates and loves the design; she inquired whether the safe walk path would be lit at night; inquired whether there is a place where delivery vehicles can park and stated there will be delivery vehicles accessing the development. Commissioner Stark said she agreed with the other Commissioner's comments; she said if the signage size is increased more lighting needs to be added; she said there is no coverage within the recreation space for bad weather; questioned whether there are enough parking stalls for delivery or emergency vehicles; inquired on lack of storage, etc., and suggested more thought on the issue; she also expressed concern with solar panels and potential lack of electricity and heat. Commissioner Reay stated how important this project is to build equity and for creating generational wealth within the community and how important homeownership is to that purpose. She inquired on the partnership and collaboration with the Tukwila Pantry and Church and asked whether there is an agreement, etc.; she also asked for confirmation there are ADA parking stalls. Karen Kiest, Landscape Architect for the applicant, also addressed questions. Eric Pravitz, Director, of Real Estate Delvelopment for Homestead Community Land Trust, thanked the Commission for their time and addressed Commissioner Martinez's comments regarding natural gas and explained the energy efficiency and quality of the homes being developed. Commissioner Stark and Martinez had follow up questions regarding backup power to homes. Commissioner Strander asked who is responsible for the maintenance of the safe route to school pathway. She asked staff to provide some clarity regarding maintenance. She asked if the police department looked at this project through the crime prevention environmental design. She is questioned whether the proposed trees would block the view on the pathway and said she would like to have that looked at again through the crime prevention environmental design. She inquired whether there are wheel stops along the parking stalls that face the pathway. PUBLIC TESTIMONY Graydon Manning spoke in support of the project. Reverend Jan Bolerjack spoke in support of the project. There were no additional public comments. The public hearing was closed. There were no comments for deliberation. Commissioner Martinez seconded the motion. Motion passed. Commissioner Mann moved to approve Case Number L20-0138, Design Review, based on staffs findings and conclusions, as amended at the meeting tonight with the added condition. Commissioner Stark seconded the motion. Motion passed. Commissioner Mann moved to approve Case Number L20-0129, Subdivision Preliminary Plat, based on staffs findings, conclusions, and conditions as listed in the staff report dated 2/25/21. Commissioner Stark seconded the motion. Motion passed. DIRECTOR'S REPORT: Staff informed the PC that a discussion regarding the land acknowledgement statement took place with Kari Sand, City Attorney to get legal opinion on whether there were any concerns reading the statement at PC meetings due to land owned by the public. The City Attorney said there are no legal concerns. Staff said City Council recommended reading the land acknowledgement statement, but it is not a mandate. Commissioner Mann asked if City Council had decided not to read the statement prior to their meetings. Staff said to their knowledge City Council are reading the statement. Commissioner Mann said she wanted to think about whether the statement should be read, and Commissioner Simmons was in favor of the statement being read.
