Bolger Revocable Trust, and the Lessee Optionee, First In-
terstate Bank of Washington, N. A., for and in consideration
of the sum of ONE DOLLAR ($1.00) in hand paid, receipt
whereof is hereby acknowledged, do hereby grant, sell and
convey to the City of Tukwila, Washington, a municipal cor-
poration, Grantee, its successors and assigns, a perpetual
easement and right-of-way over, across and upon the follow-
ing described real property situate in King County, Washing-
ton, TO WIT:
herein.
PUBLIC PEDESTRIAN EASEMENT
See ATTACHMENT A annexed hereto and incorporated
The purposes and uses of said easement shall be
limited to public pedestrian access to, and the con-
struction, operation and maintenance of, a recreational
trail and for all purposes reasonably necessary and related
thereto.
This easement is granted with the understanding
that the property affected hereby will be restored by
Grantee as nearly as possible to its original condition upon
completion of the construction of said recreational trail.
This easement is further granted with the under-
standing and upon the limitation that motorized vehicles
(except such as are used by physically handicapped persons)
shall be not permitted access to, or use of, said recre-
ational trail and that no structures shall be erected
thereon.
Grantee shall have the right to install, maintain
and use electrical lighting standards for the illumination
of the recreational trail; provided, however, all electrical
lines servicing such lighting standards shall be located
beneath the surface of the ground, and provided, further,
that each such lighting standard not exceed a height of 20
feet from the surface of the ground. Upon the installation
of any such light standard Grantee will restore the premises
affected thereby as nearly as possible to its original con-
dition.
Grantee hereby agrees to indemnify and save harm-
less Grantor from and against any loss, damage, claim or
liability arising out of the construction, operation, main-
tenance or use of the pedestrian trail or arising out of the
exercise by Grantee of any right granted to Grantee here-
under.
