BROTHERS, a partnership, and the INDEPENDENT WATER COMPANY, a
Washington corporation
That in consideration of ten (10) dollars and other good and
valuable consideration, some of which aro contained herein below, the
Grantor (W1itrhy Brothers) grants to the Grantee, (Independent Water
Company) an easement for a water main over a :;trip of land ten (10)
feet in width along the west boundary (running in a northerly southerly
direction) of the following described property;
The easement to be confined to the west ten (10) feet of the
following described real estate belonging to the Grantor:
A portion of Section 24, Township 23, Range 4, E.W.M., which
includes three structures presently leased to Mueller Brass
Co., Harvey Cole Co., Inc. and E. I. DuPont De Nemours,
described as follows:
That portion of government Lot 8, in Section 24, Township 23
north, Range 4 east, W.M., in King County, Wash. and of
that portion of the Henry Meader Donation Claim No. 46, in
said Section 24, lying easterly of the right -of -way of
the Puget Sound Electric Railway and lying westerly of
the right -of -way of the Chicago Milwaukee St. Paul Ry.
and lying southerly of the following described line:
Beginning at a point in the fence line that marks the north
margin of an easement for road purposes referred to under
auditor's file No. 3480349, records of said county, from
which the intersection of said margin with the easterly
boundary of the Puget Sound Power Light Company's right
of -way (formerly Puget Sound Electric Railway) bears
south 87 west 28.83 feet° thence north 01 2413"
west 352.00 feet; thence north 08'24'13 west 225.00 feet
to the northwest corner of the Harvey Cole Co., Inc.
lease; thence continuing north 08 west 40 feet; thence
north 23 18'24" west 140.00 feet; thence south 66 21'36
west 40 feet; thence north 23 18 24" west 140.00 feet;
thence south 66 24'36" west 40.7' feet, more or less, to
the easterly line of said Puget Sound Electric Railway
right -of -way, and the true poin of bagirming of said
described line; thence north 66 east to the
westerly line of said Chicago, Milwaukee St. Paul Railroad
right -of -way and the end of said described line; together
with an easement for road purposes over a strip of land
35 feet in width adjoining said premises on the south and
running westerly from the southeast corner of said premises
to the east line of secondary State Highway No. 5 -M as
described in instrument under auditor's rile No. 3480349
except that portion of said easement within the right -of -way
of the Puget Sound Electric Railway right -of -way, now Puget
Sound Power Light Co.'s right -of -way as conveyed under
auditor's Pile No. 216 -A.
The purpose of the easement is to operate and maintain a ten (10)
inch water main constructed in the year 1963. Said facility consists
of a cast iron pipe, hydrants and water meters serving three (3)
buildings and may eventually serve a fourth building.
As further consideration of this grant of easemen restore to agrees
that it shall, at its cost and expense,
condition when entered by them thereon any improvements of the easement
area end will further, at its cost and liability and expense,maintain
and keep in good repair this water line back to and including the
water meters and.meter boxes servicing the main.
