TMC 1431.050 Discharge Prohibitions
A. PROHIBITION OF ILLICIT DISCHARGES.
1. No person shall throw, drain or otherwise discharge or cause or allow others under its
control to throw, drain or otherwise discharge directly or indirectly into the stormwater
drainage system and/or surface and groundwaters any materials other than stormwater.
2. Examples of prohibited contaminants include, but are not limited to, the following:
a. Trash or debris.
c. Petroleum products, including but not limited to oil, gasoline, grease, fuel oil and
heating oil.
d. Antifreeze and other automotive products.
f. Flammable or explosive material.
k. Degreasers, solvents or drain cleaners.
m. Steam cleaning wastes.
n. Soaps, detergents or ammonia.
q. Heated water.
y. Silt, sediment, concrete, cement or gravel.
On March 10, 2021, I observed soil and gravel dust brought from the subject property onto
S 102nd St.
Stop all illicit discharges from this property onto S 102nd St, S 104th St, E Marginal Way S,
the adjacent properties, and into the Duwamish River.

TMC Title 18, Zoning - Exhibit A —Table 18-6: Land Uses Allowed by District
Automotive services, gas (outside pumps allowed), washing, body and
engine repair shops (enclosed within a building), and alternate fueling
station (not wholesale distribution facilities). (Emphasis Added)
On March 10, 2021, I observed a semi -tractor being serviced. The hood was raised, parts
from the semi -tractor were laying on the ground, and a blue tarp was placed on the
ground under the engine compartment.
All washing, body, and engine repair must be performed in an enclosed building with the
correct water filtration system to prevent pollutants leaching into the soil or entering the
Duwamish River. If this can not be accomplished these services must be performed at an
approved facility.

UNSOUND ACCESSORY STRUCTURES (FENCES)
IPMC 302.7 (as adopted by TMC 8.28.020) ACCESSORY STRUCTURES
All accessory structures, including detached garages, fences and walls shall be maintained
structurally sound and in good repair.
On March 10, 2021, I observed semi -trailers are pushing chain link fencing over along S
102nd St on the north side of the property and along 5 104th St on the west side of the
property. In some areas, fence posts, railings and chain link fencing are pushed past the
fog line on the edge of the roadways, thus creating a roadway hazard.
Repair all broken or structurally unsound components (fencing)* Maintain fencing to ensure it
it is always structurally sound and in good repair.

STORAGE OF JUNK VEHICLES PROHIBITED
TMC 8.24.020 STORAGE OF JUNK VEHICLES PROHIBITED It is unlawful for any person to
keep, store or park, or permit any other person to keep, store or park, any junk vehicle
upon any privately -owned property in the City of Tukwila. This ordinance shall not apply
to:
1. A junk vehicle or part thereof that is completely enclosed within a building....
TMC 8.24.010 DEFINITION as used in TMC chapter 8.24, the following definitions shall have
the meanings set forth below: ...
3. "Junk vehicle" is a vehicle that meets three or more of the following requirements:
a. Is three years old or older
b. Is extensively damaged, such damage including but not limited to any of the following:
a broken window or windshield; or missing wheels, tires, motor, or transmission;
C. Is apparently inoperable;
d. Is without valid, current license plates or is un registered; or
e. Has an approximate fair market value equal only to the approximate value of the scrap
in it. (Emphasis added)
"Junk Vehicle" also includes a partially disassembled vehicle or individual parts of vehicles
no longer attached to one another.
On March 10, 2021, I observed several semi -tractors and automotive vehicles damaged
and/or parts removed which included but not limited to hood, engines, bumpers, tires,
broken windshields. Two semi -tractors are extensively damaged.
Store these vehicles In an enclosed structure or remove them from the property.

ACCUMULATION OF GARBAGE AND RUBBISH
IPMC 308.1 (as adopted by TMC 8.28.020) ACCUMULATION OF RUBBISH OR
GARBAGE
All exterior property and premises shall be free from any accumulation of rubbish or
garbage.
Garbage is defined as the animal or vegetable waste resulting from the handling,
preparation, cooking and consumption of food.
Rubbish is defined as combustible and noncombustible waste materials, except garbage;
the term shall include the residue from the burning of wood, coal, coke and other
combustible materials, paper, rags, cartons, boxes, wood excelsior, rubber, leather, tree
branches, yard trimmings, tin cans, metals, mineral matter, glass crockery and dust and
other similar materials....
On March 10, 2021, I observed truck tires, brake drums, truck air filters, mattresses and
pillows, cardboard boxes, loose and bagged garbage, plastic Jugs, and rubbish throughout
the perimeter of the property.
Properly dispose of all rubbish and garbage, or store rubbish and garbage in approved
leakproof containers with close -fitting covers or inside an enclosed structure until garbage
and rubbish is removed from the property. Properly dispose of tires, brake drums, air filters
or store these items in an enclosed structure until they can be removed from the property.
Maintain the property to this standard at all times.

WEEDS AND OVERGROWTH
IPMC 302.4 (as adopted by TMC 8.28.020) WEEDS.
Premises and exterior property shall be maintained free from weeds or plant growth in
excess of 12 inches. Noxious weeds shall be prohibited. Weeds shall be defined as all
grasses, annual plants and vegetation, other than trees or shrubs provided; however, this
term shall not include cultivated flowers and gardens.
On March 10, 2021, I observed weeds and blackberries over 12 inches In height
throughout the perimeter of the property.
Trim back overgrowth to a height of 12 inches or less on entire property and remove
trimmings from the property. Maintain the property to this standard at all times.
This is a notice that your property is in violation of the Tukwila Municipal Code, You must complete the corrective
action noted above by the compliance date indicated.
FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY OF UP TO
$250 PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PURSUANT TO TMC 8.45.120(2).

NOTICE OF VIOLATION AND ORDER - Per TMC § 8.45.070
Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1.The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
