TOLLING AGREEMENT
This Tolling Agreement (hereinafter, the "Agreement"), is by and between New Cingular Wireless
PCS, LLC ("Applicant"), and the City of Tukwila, Washington ("City") (collectively the
"Parties").
WHEREAS, Applicant filed applications to site three small wireless facilities within the
City;
WHEREAS, the City is in the process of reviewing the applications;
WHEREAS, the City has identified that the applications are inconsistent with certain City
public works standard requirements, and modifications to the applications are necessary
prior to approval; and
WHEREAS, the Parties believe that completion of such review will extend beyond the FCC
presumptive review timelines.
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. The Parties are entering into this Agreement to toll the time period for the City's
action.
2. The City shall until 11:59pm on May 24th, 2021 to either grant or deny Applicant's
applications to site three small wireless facilities.
3. This date may be further extended by mutual written agreement of the Parties.
4. This Agreement may be signed in counterparts.
IN WITNESS WHEREOF, this Agreement has been executed by the duly authorized
representatives of the parties as set forth below and is effective as of the Applicant's date of
signature.
