MABEL J. HARRIS, JOE H. DUFFIE, EDGAR D. BAUCH, WENDY A. MORGAN, CHARLES E. SIMPSON. Mayor Van Dusen reported that the interviews have been completed for the position of Police Chief. The committee has presented him two names and the background investigation is being done on these candidates. He will be back to Council later with a recommendation. a. City Attorney Martin read a resolution of the City of Tukwila, Washington, approving the proposed McMicken Heights election method annexation. Ordinance #1323 Provide for the appropriation of un- anticipated revenues for storm drainage rehabilitation on Andover Park West NEW BUSINESS Ordinance #1324 Establishing a Muni- cipal Court System pursuant to the Court Improvement Act Ordinance #1325 Amending the Tukwila Traffic Code by adding a new section pro- hibiting inattentive driving and providing the punishment Clarification of Section 1.3 and 1.4 of the Green River Management Agreement MOVED BY HARRIS, SECONDED BY MORGAN, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Martin read an ordinance of the City of Tukwila, Washington, amending the 1984 budget adopted by ordinance No. 1310 passed by the City Council on December 22, 1983, to provide for the appropriation of unanticipated local retail sales and use tax revenues for storm drainage rehabi- litation on Andover Park West and establishing an effective date. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1323 BE ADOPTED AS READ.* Mayor Van Dusen read a letter from the Chamber of Commerce notifying Council of the Chamber's support of the proposed improvements to Andover Park West, south of Strander Boulevard. The street floods every year and it is disrup- tive to businesses in the area. *MOTION CARRIED. MOVED BY MORGAN, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Martin read an ordinance of the City of Tukwila, Washington, establishing a Municipal Court System pursuant to the Court Improvement Act of 1984, Chapter 258, Laws of 1984. MOVED BY MORGAN, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1323 BE ADOPTED AS READ WITH THE TITLE AMENDED TO INCLUDE "AND DECLARING AN EMERGENCY. Council Member Morgan explained that during the 1984 Legislative Session they passed the Court Improvement Act. It was unclear when the requirements were to take effect. The attorneys determined that the effective date was July 1, 1984. In order to maintain continuous service of our Municipal Court, the ordinance needs to be passed this evening. *MOTION CARRIED. MOVED BY MORGAN, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Martin read an ordinance of the City of Tukwila, amending the Tukwila Traffic Code, Title 9 of the Tukwila Municipal Code by adding thereto a new Section 9.40.070 prohibiting inattentive driving and providing the punishment. MOVED BY MORGAN, SECONDED BY SIMPSON, THAT ORDINANCE NO. 1325 BE ADOPTED AS READ. MOTION CARRIED. Councilman Bauch asked to have this item removed from the Consent Agenda so he could cast a NO vote. Mr. Sneva reported that King County, Kent and Tukwila have authorized their Mayors to sign the Green River Management Agreement. The City of Renton is withholding approval until clarification is made on pumping from the P -1 Station. The L/13> TUKWILA CITY COUNCIL, REGULAR MEETING July 2, 1984 Page 3 NEW BUSINESS Cont. Labor Negotiations 9:32 P.M. ADJOURNMENT 9:33 P.M. City of Auburn is putting the signing off until they resolve their surface water management problem. The proposed changes to the agreement clarify current language. MOVED BY HARRIS, SECONDED BY SIMPSON, THAT COUNCIL AUTHORIZE THE MAYOR TO SIGN THE DOCUMENT, AMENDED TO INCLUDE THE REVISED LANGUAGE. MOTION CARRIED WITH BAUCH VOTING NO. MOVED BY BAUCH, SECONDED BY HARRIS, THAT R. W. BECK AND ASSOCIATES BE APPROVED AS THE CONSULTANT FOR THE SEWER PROJECTS. MOTION CARRIED. MOVED BY BAUCH, SECONDED BY SIMPSON, THAT CH2 M HILL BE AWARDED ALL OF THE WATER PROJECTS.* Councilman Bauch said that Council has been following the Administration's rating policy. This time after the rating was completed, they decided to pick someone who was not rated the highest. This is a violation of past procedure. The Committee sent this forward without recommendation. Councilman Simpson noted that staff is hired to do these things and this firm can do aS comparableajob as the first choice. Mr. Sneva commented that they are trying to distribute the work among different firms. MOTION CARRIED WITH HARRIS, BAUCH AND DUFFIE VOTING YES; MORGAN AND SIMPSON VOTING NO. Councilman Bauch noted that the Staff Meeting minutes state that mileage allowance reimbursement rate will be increased to 21.51 per mile effective July 1, 1984. He said this should be an action of the Council and offered that the Finance Committee should look at it. Mayor Van Dusen agreed. MOVED BY SIMPSON, SECONDED BY MORGAN, THAT COUNCIL GO INTO EXECUTIVE SESSION. MOTION CARRIED. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE EXECUTIVE SESSION BE CLOSED. MOTION CARRIED.
