WITNESSETH
WHEREAS, the GRANTOR hereto warrants that he/they own the parcels of
property listed and described on Exhibit "A" attached hereto and incorporated by this
reference
WHEREAS, the GRANTOR desires to grant to the GRANTEE, its respective heirs,
executors, administrators, agents or assigns a PERPETUAL EASEMENT AND
DECLARATION OF COVENANT FOR PRIVATE ROAD AND UTILITIES, with right
of immediate entry and continued access to construct, improve, maintain and repair all
aspects of the road, its pavement for any and all utilities located over, under, upon and
across the real property situated in the City of Tukwila, Washington, described in Exhibit
"B" attached and incorporated by this reference,
FURTHERMORE, it is agreed that the responsibility and cost of repairs of the private
road and any and all utilities not otherwise the responsibility of others shall be the joint
responsibility of all present and future owners of the described subject property
NOW THEREFORE, this Perpetual Easement and Declaration of Covenant is executed
and shall be a covenant running with the land and shall be binding on all subsequent
heirs, executors, administrators and assigns
IN WITNESSETH THEREOF, the GRANTOR hereto has executed this Agreement on
the date first above written
