For and in consideration of the mutual covenants, an agreement hereinafter expressed and other
good and valuable considerations, in hand paid, receipt of which is hereby acknowledged, the
parties hereto agree as follows:

1. The owner of the above described land does hereby define, grant and convey to the present
and future owner(s) (Grantee) of the land described as follows:
An exclusive perpetual Private Drainage Easement over, across, along, in, upon and under that
portion of said Grantor's land described as follows:

LEGAL DESCRIPTION OF PRIVATE DRAINAGE EASEMENT AREA:
THAT PORTION OF TRACT 6, BLOCK 3, ADAMS HOME TRACTS, ACCORDING TO
THE PLAT THEREOF RECORDED IN VOLUME 11 OF PLATS, PAGE 31, RECORDS OF
KING COUNTY WASHINGTON, DESCRIBED AS FOLLOWS:
BEGINNING AT A CONCRETE MONUMENT MARKING THE INTERSECTION OF 42ND
AVENUE SOUTH AND SOUTH 144TH STREET; THENCE SOUTH 87°4910" EAST,
ALONG THE CENTERLINE OF SAID SOUTH 144TH STREET, 659.69 FEET; THENCE
SOUTH 01°08'52" WEST 20.00 FEET TO THE SOUTH MARGIN OF SAID SOUTH 144TH
STREET AND THE NORTHWEST CORNER OF SAID TRACT 6; THENCE SOUTH
01°08'52" WEST, ALONG THE WEST LINE OF SAID TRACT 6, 184.12 FEET TO THE

2. This easement is for the sole purpose of the construction, use and maintenance of a Private
Drainage Easement.
3. Infiltration trench was installed under PW 14-007 permit on Lot 7 and the owner of Lot 6 shall
maintain the infiltration trench and shall continue to maintain and bear all cost of repair and
maintenance of said Private Drainage Easement.
4. Grantee of Lot 6 shall hold Grantor harmless from and against any and all claims which may
be made against Grantor arising out of the installation, operation, maintenance or repair or said
Private Drainage Easement.
5. The herein easement and agreement may be amended only with the written agreement of the
Grantee herein, his heirs and/or assigns.
6. It is the intent of the grantor that this agreement shall not be extinguished by the doctrine of
merger.

This easement agreement shall run with the land and shall be binding on all parties having or
acquiring any right, title or interest in the land descried herein or any part thereof.
