Assessor's Tax Parcel ID No.: 7340600480 Instrument Numbcr: 20210709002625 Documcnt:COV Rcc: 8177.50 Pagc-2 of 75 Record Date:7/9/2021 5:01 PM King County, WA DocuSign Envelope ID: 778D21E5-1500-49D8-8A2D-B0996C937CCE DECLARATION OF COVENANT FOR INSPECTION AND MAINTENANCE OF STORMWATER FACILITIES AND BMPS IN CONSIDERATION of the approval and issuance ofthe City of Tukwila Public Works Permit No. PW 19-0047 relating to the real property as described in Exhibit "A" attached hereto and by this reference incorporated herein ("Property"), King County, a home rule charter county and political subdivision of the State of Washington (the "Grantor"), pursuant to this Declaration of Covenant for Inspection and Maintenance of Stormwater Facilities and BMPs (the "Declaration of Covenant") for the benefit of the City of Tukwila, a Washington municipal corporation (the "Grantee"), does hereby grant, covenant and agree that it shall observe, consent to, and abide by the conditions and obligations set forth and described in the following Paragraphs 1 through 10 hereof with regard to the Property, and does hereby grant to the Grantee an easement with respect to the Property as described in Paragraphs 2 and 3 hereof. 1. The Grantor or their successors in interest and assigns (collectively, the "Owner") shall, at their own expense, operate, maintain, and keep in good repair, the Property's stormwater facilities and follow hest management practices ("BMPs") identified in the plans and specifications submitted to the City of Tukwila (the "City") under Public Works Permit No. PW19-0047 (the "Permit"), The Pennit was approved by the City on May 24, 2019 and revisions to the Permit were approved by the City on August 8, 2019. The Permit was issued on July 25, 2019. Installation of the stormwater facilities received partial approval inspections by the City in 2019, 2020 and 2021. Collectively, the Permit includes the Stormwater Facility Site Plan (Exhibit B) and the Operations and Maintenance Plan, including the inspection schedule, (Exhibit C) The term "stormwater facilities" includes conveyance pipes, catch basins, manholes, detention vaults, control stnicture/detention flow restrictor and bioretention system (bioscape) by Contech Filterra (engineered stormwater treatment system incorporating certified pretreatment mulch and hioscope plants) designed to manage stormwater on the Property. Instrument Numbcr: 20210709002625 Documcnt:COV Rec: 8177.50 Pagc-3 of 75 Record Date:7/9/2021 5:01 PM King County, WA DocuSign Envelope ID: 778D21E5-150D-4908-8A2D-E30996C937CCE 2, The City shall have the right of ingress and egress over those portions of the Property necessary to perform inspections of the stormwater facilities and BMPs and conduct other activities specified in this Declaration of Covenant and in accordance with City of Tukwila Code ("TMC") 14.30.080. This right of ingress and egress, right to inspect, and right to perform required maintenance or repair shall be as provided for in Paragraph 3 below. 3. If the City determines that maintenance or repair work is required to be done to any of the stormwater facilities or BMPs, the Director of Public Works (the "Director") shall give notice of the specific maintenance and/or repair work required pursuant to TMC 14.30.080. The Director shall also set a reasonable time in which such work is to be completed by the Owner. If the above required maintenance or repair is not completed within the time set by the Director, the City may perform the required maintenance or repair, and is hereby granted access to the Property for such purposes. Written notice will be sent to the Owner stating the City's intention to perform such work. This work will not commence until at least seven (7) days after such notice is mailed. If, within the sole discretion of the Director, there exists an imminent or present danger, the seven (7) day notice period will be waived and maintenance and/or repair work will begin immediately. 4. If at any time the City reasonably determines that a stormwater facility or BMP on the Property presents an imminent hazard, as identified by TMC 14.30.080 and herein incorporated by reference, the Director or equivalent municipal successor's official may take measures specified therein. 5. The Owner shall assume all responsibility for the cost of any rnaintenance or repair work completed by the City as described in Paragraph 3 or any measures taken by the City to address imminent hazards as described in Paragraph 4. Such responsibility shall include reimbursement to the City within thirty (30) days of the receipt of the invoice for any such work performed. Overdue payments will require payment of interest at the current legal rate as liquidated damages. 6. The Owner is hereby required to obtain a Type C Public Works permit from the City priorto filling, piping, cutting, or removing vegetation (except in routine landscape maintenance such as replacement of plants and pretreatment mulch) in open vegetated stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performing any alterations or modifications to the stormwater facilities and BMPs referenced Instrument Numbcr: 20210709002625 Documcnt:COV Rcc: 8177.50 Pagc-4 of 75 Record Date:7/9/2021 5:01 PM King County, WA DocuSign Envelope ID: 778D21 E5-150D-49D8-8A2D-B0996C937CCE in this Declaration of Covenant. Prior to the final approval and issuance of the new pen -nit, a new Declaration of Covenant with updated exhibits reflecting the changes to the stormwater facilities shall be recorded at the Owner's sole cost, and a copy of the new recorded Declaration of Covenant provided to the City. 7. Any notice or consent required to be given or otherwise provided for by the provisions of this Declaration of Covenant shall be effective upon personal delivery, or three (3) days after mailing by Certified. With regard to the matters addressed herein, this Declaration of Covenant constitutes the entire agreement between the parties, and supersedes all prior discussions, negotiations, and all agreements whatsoever whether oral or written. This Covenant shall he governed by the laws of the State of Washington. Any suit to enforce or relating to this Covenant shall only be filed in King County Superior Court, King County, Washington, and the Parties consent to the jurisdiction thereof. In the event of any legal action by either Party relating to this Covenant, the Parties shall pay their own costs or fees. 9. This Declaration of Covenant is intended to protect the value and desirability of the real property described in Exhibit "A", promote the efficient and effective management of surface water drainage on the property, and shall inure to the benefit of all the citizens of the City. References herein to the TMC shall include subsequent amendments to such statutes and all successor statutes. 10. This Declaration of Covenant shall run with the land and be binding upon the Grantor, and the Grantor's successors in interest, and assigns. 11. This project employs a variety of stormwater infrastructure that requires regular inspection and maintenance. These features include catch basins, conveyance pipes and ditches, and a Contech Filterra -facility. King County Metro Transit Department shall be the responsible party and a copy of the maintenance manual shall be retained by the appropriate department onsite or within reasonable access to the site. A log of maintenance activity shall be kept and be available for inspection. Quarterly inspections should take place in January, May, August, and November. The best time for an annual inspection is in the late summer, preferably in August to coincide with the 3quarterly inspection. Items marked "After Major Storm Event" should use 1 -inch of precipitation in a 24-hour time window as a guideline. 1.2 SITE DESCRIPTION This project will expand the capacity of the existing King County Metro Transit Department South Base by constructing an interim base on the parcel directly south of the existing transit base. Under developed conditions this property wit feature two new buildings: an operations building in the northeastern corner of the property and a vehicle maintenance building in the southeast corner. The majority of the remaining site area will be paved to allow for bus coach parking, circulation, and maintenance. As a result, much of the stormwater infrastructure requiring maintenance will be located below grade. The site has two Threshold Discharge Areas (TDAs), each of which corresponds to a separate stormwater discharge location. The area of the site draining to the eastern discharge point is known as TDA 1, while the area draining to the west is known as TDA 2. These areas are delineated in Appendix G1 — Project Maps. In the proposed condition, TDA 1 will provide water quality treatment and oil control. Both water quality treatment and oil control will be provided using Contech Filterra facilities. TDA 2 will provide detention using modular chamber technology. As is the case in TDA 1, TDA 2 wit also provide water quality treatment and oil control via Contech Filterra facilities.
