The temporary construction easement shall commence on
the date of this instrument and will terminate on the date the
58t Ave. South improvements have been accepted by the City

and upon the foliowing described real estate:
Lot /-f-/ Block Hillman's Seattle Garden Tracts, according
to the plat thereof recorded in Vol. 11 of Plats, Page 24, Records
of King County, Washington
During the period of this ea- 1 the City shall have the
right of ingress and egress to and from Lho Above described property
for the f-orcgoi:ng purposes.

for and in consideration of One Dollar($1.00) and the obligation of
the City of Tukwila to readjust and /or replace in kind the existing
driveway, walkway, stairway, rockery and retaining wall,
and other valuable considerations in hand paid, the receipt of which
is hereby acknowledged, do hereby grant an easement to the CITY OF
TUKWILA, a municipal corpor of the State of Washington, to con
struct and maintain upon the above describ(:d property; cut slopes
and fill slopes of i_ L 2feet horizontally for each foot of elevation
of cut or fill. Such easement is for the purpose of providing and
maintaining lateral support for 58th Avc�. South when improved to
the f_u.11 width of the right of way in contormity the existing
cr_nter line grades, and there is reserved to the Grantor (s)
heirs and assigns, the right to rcmovc said slopes at any ti I'Ic upon
providing and maintaining other adequate lateral support.
THIS AGREEMENT s hall constitute a covenant running with
the land.
