HomeMy WebLinkAbout1970 - Easement - Fouty Edith Amelia Hermina - 66643754 w VOL 390 PACE 089 E A S E M E N T TIIIS AGREEMENT made this Z;G day of 19 -7D by and between the CITY OF TUKWILA, a municipal corporation of King County, N Washington hereinafter termed "Grantee" and `D and his wife, hereinafter termed 'Grantor WITNESSETII: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right of -way or easement for utilities with the necessary appurtenances through, over and across the following described property situated in King County, jashington, more particularly described as follows: This Utility Easement is through Lot 32, Block 17 of Hillman's Seattle Garden Tracts as recorded in Volume 11 of Plats, Page 24, Records of King County, Washington. -This easement consists of a 5 foot permanent strip described as the Easterly 5 feet of said Lot 32. TOGETHER WITH a 15 foot temporary construction easement des crived as the Easterly 15 feet of said Lot 32. VOL 390 PAGE 589 Said heretofore mentioned Grantee shall have the right, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, repairing, altering or reconstructing utilities or making any connections therewith, without incurring any legal obligation or liability therefor, provided that such construct- ing, repairing, altering or reconstructing of such utilities shall be accomplished in such a manner that the fences, lawn shrubbery, drives and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said ease- ment; so long as said use does not interfere with the installation and maintenance of the utilities and so long as no buildings or structures are erected on said easement.
