HomeMy WebLinkAbout1970 - Easement - Pargas of Seattle - 6634219von 321 Pact 160 AG34219 E A S E M E N T THIS AGREEMENT made this 4th day of March 19 70 by and between the F CITY OF TUKWILA, a municipal corporation of King County, 0 N Washington hereinafter termed "Grantee" and D Parqas of Seattle, Inc. and his wife, hereinafter termed "Grantor WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right of -way or easement for utilities with the necessary appurtenances through, over and across the following described property situated in King County, Washington, more particularly described as follows: This Utility Easement is through Tax Lot 12 in Sections 10 and 15, Township 23 North, Range 4 East W.M. Said Tax Lot is described as: Beginning at a point on the Northeasterly Margin of the Seattle City Light Right -of -Way North 22'20'-26 West from the quarter corner between Sections 14 15 a distance of 1'722.57 feet; thence North 48 44"West along said Northeasterly margin 1570.27 feet to the True Point of Beginning; thence continuing along said margin 200.00 feet; thence North 28-05 42"East 159.11 feet; thence South 81 14 "East 284.22 feet; thence South 41'- 40� -16 West 310.54' to the True Point of Beginning. This easement consists of that portion of a 10 foot perm- anent strip lying within the above desc. prop. the Centerline of which is described as follows: Beginning at a monument on the Centerline of the Seattle City Light Right -of -Way which bears North '77'54-57 East 420.35' from the quarter corner common to Sections 10 and 15 -23 -4; thence South 4e- 14'44'East along said Centerline 416.74'; thence North 41 -45' 16 "Last 50.00. feet to the Northeasterly margin of said Right -of -Way and the True Point of Beginning; thence South 41 -45 16 "West 60.00 feet; thence North 48 -14 -44 West 150.00 feet; thence North 41 °45'16 East 60.00 feet to the Northeasterly margin of said Right -of -Way; thence North ;sue, N Cr9 �D w7 von 321 PACE 161 P age 2 W. 14'°44' r West 138.16 feet; thence North 54. 25' -24' "West 441.24 feet to the terminus of this easement Centerline; thence South 12 2 -16L51 West 2.32 feet; thence South 48tl4�-44 "East 308.67 feet to the Point of Beginning. TOGETHER WITH that portion of a 30 foot temporary con- struction easement lying within the above desc. property, the. Centerline of which is the same as that described above. Extending or shortening the exterior margins of the easements to terminate at the property lines. Said temporary construction easement shall remain in force during construction and until such time as the utilities and appurtenances have been accepted for maintenance and oper- ation by the City of Tukwila. Easement No. 10 -3 -17 von 321 PACE 162 0'_ That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that suck constructing, repairing, altering, or reconstructing of said sewer main shall be accomplished in such a manner that the private improvements existing in this right -of -way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before D the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the sewer main and so long as no permanent buildings or structures are erected on said easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto. U BY BY ATTEST: i..
