HomeMy WebLinkAbout1970 - Easement - Lutes Burton / Lutes Viola - 66342146634214.. a von 3 Pact x.40 E A S E M E N T THIS AGREEMENT made this Iff 7e day of 19 7 4 0 by and between the CITY OF T a municipal corporation of King County, Washington hereinafter termed "Grantee" and N and IKT his wife, hereinafter termed Grantor WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right of -way or easement for utilities with the necessary appurtenances .through, over and across the following described property situated in King County, Washington, more particularly described as follows: This Utility Easement is through Lot 10, Block 8 of Hillman's Seattle Garden Tracts as recorded in Volume 11 of Plats, Page 24, Records of King County, Washington: This easement consists of a 40 foot permanent strip des- cribed as'the southeasterly 40 feet of said Lot 10. Lutes Easement No. 14 -5 -17 VOL 3?1.FACE i4f Said heretofore mentioned Grantee shall have the right, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, repairing, altering or reconstructing utilities or making any connections therewith, without incurring any legal obligation or liability therefor, provided that such construct- ing, repairing, altering or reconstructing of such utilities shall be accomplished in such a manner that the fences, lawn shrubbery, `T drives and walkways and land contours existing in the right -of -way N shall not be disturbed or destroyed, or in the event that they are' M disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said ease- ment, so long as said use does not interfere with the installation and maintenance of the utilities and so long as no buildings or structures are erected on said easement.
