HomeMy WebLinkAbout1970 - Easement - Schankel Leon / Schankel Shirley - 6634216i VOL 321 PAC 151 E A S E M E N T f THIS AGREEMENT made this 14L day of by and between the 0 CITY OF TUKWI A; a municipal corporation of King County, Washington hereinafter termed "Grantee" and 69._Flf� INZI M and his wife, hereinaft termed "Grantor WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right of -way or easement for utilities with the necessary appurtenances through, over and across the following described property situated in King County, Washington,.more particularly described_ as follows: This Utility Easement is through Lot 7, Block 2 of Stella A. Tyler's First Addition to Sterling as recorded in Volume 15 of Plats, Page 8, Records of King County, Washington. This easement consists of a 5 foot permanent strip des- cribed as the Easterly 5 feet-of said Lot 7. TOGETHER WITH a 15 foot temporary construction easement described as the Easterly 15 feet of said Lot 7. Said temporary construction easement shall remain in force during construction and until such as the utilities and appurtenances have been accepted for maintenance and operation by the City of Tukwila. Schankel Easement No. 23 -3 -17 Shirley Schankel y, ,�VOI' 321 PAGE Said heretofore mentioned Grantee shall have the right, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, repairing, altering or reconstructing utilities or making any connections therewith, without incurring any legal obligation or liability therefor, provided that such construct- ing, repairing, altering or reconstructing of such utilities shall be accomplished in such a manner that the fences, lawn shrubbery, drives and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed, or in the event that they are.' qq:T disturbed or destroyed, they will be replaced in as good a condition CY) as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said ease- ment, so long as said use does not interfere with the installation and maintenance of the utilities and so long as no buildings or structures are erected on said easement.
