T HIS 'AGREEMENT made this

CITY OF TUKWIL, a municipal corporation of King County,
Washington hereinafter termed "Grantee "and
SAMIM AMISH COMMERCIAL COMPANY INCORPORATED
That the said Grantor for valuable consideration does
by these presents grant unto the .Grantee a perpetual right
of -way or easement for utilities with the necessary appurtenances
through, over and across the following described property
situated in King County, Washington, mdre °particularly described
as follo;;s.-
That portion of the Southwest 1/4 of the Southeast 1 /4 of
Section 26 and the Northwest 1/4 of,.-the Northeast 1/4 of Section
35 Township 23 North, Range 4, East W.M. lying westerly of
the East 30.00 feet and Easterly of a line described as follows:
Commencing at the Southeast corner of the Southwest 1/4 of
the Southeast 1/4 of said Section 26. Thence north O1 °47'29"
East 140.76 feet along the East line of said Southwest 1/4;
thence North 87 °55'02" West 38.00 feet to the point of beginning.
Thence South 1 °47'29" West, parallel to the East line of said
Southw 1 /4 t the S th l i n e of said Section 7, 6; thence
South 1 °51'39" West parallel to the East line of said Northwest 1/4,
1182.47 feet; thence South 9 °04'00" West to the Northerly margin
of South 180th Street and the terminus of said line description.
TOGETHER WITH a temporary construction easement described as
a strip of land 20 feet in width the Easterly margin of which is
the same as the above described line description:

Said temporary construction easement shall remain in force
during construction and until such time as the sewers and appurt-
enances have been accepted for maintenance and operation by
the City of Tukwila.

Said heretofore mentioned Grantee shall have the right, without
prior institution of any suit or proceeding at law, at such times as
may be necessary to enter upon said above described property for the
purpose of constructing, repairing, altering or reconstructing sani-
tary sewers or making any connections therewith, without incurring
any legal obligation or liability therefor, provided that such con-
structing, repairing, altering or reconstructing of such sanitary
sewers shall be accomplished in such a manner that the docks, bulk-
heads fences, lawn, shrubbery, drives and walkways and land contours
existing in the right -of --way shah not be disturbed or destroyed,or
in the event that they are disturbed or destroyed, they will be replac-
ed in as good a condition as they were immediately before the property
was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the installa-
tion and maintenance of the sewer main and so long as no buildings
or structures are erected on said easement.
This easement shall be a covenant running with the land and shall
be binding on the successors, heirs and assigns of both parties hereto.
