HomeMy WebLinkAbout1974 - Easement - Connecticut General Life Insurance Company / Southcenter Shopping Center Corporation - 7407120474EASEMENT THIS AGREEMENT made this 2nd day of February 19 72 by and between the CITY OF TUKWILA, a municipal corporation of King County, Washington hereinafter termed "Grantee" and CONNECTICUT GENERAL T IFE INSURANCE COMPANY, a Connecticut corporation, as fee owner, end SOTTTHCENTER SHOPPING CENTER CORPORATTON a Washington corporation, as lessee collectively hereinafter termed 'Grantor CD WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right -of -way or easement for utilities with the necessary appurtenances through, over and across the following described property situated in King County, Washington, more particularly described as follows: This utility Easement is through Tax Lot 4 in Sec. 26, Twp 23 N, R 4 E, W.M. Said Tax Lot is described as follows: The NW 1/4 of the NE 1/4 of Sec. 26, Twp 23 N, R 4 E, W.M. LESS roads. This permanent easement consists of a portion of said Tax Lot 4 described as follows: Beginning at the intersection of centerlines of Andover Park West and Strander Blvd., thence N 01 E along the centerline of said Andover Park West 220.50 ft.; thence N 88 W along a line which is parallel with the centerline of said Strander Blvd. 45,00 ft. to the True Point of Beginning. Thence continuing N 88'15'33" W 35.00 ft.; thence S 01'05'06" W 35.00 ft.; thence S 88 E 35.00 ft.; thence N 01 E 35.00 ft. to the True Point of Beginning. TOGETHER WITH a temporary construction easement described as follows: Beginning at the True Point of Beginning described above; thence N 01'05'06" E 17.00 ft.; thence N 88.15'33" W 55.00 ft.; thence S 01.05'06" W 150.00 ft.; thence S 88.15'33" E 55.00 ft.; thence N 01 °05'06" E 133.00 ft. to the True Point of Beginning. Said temporary construction easement shall remain in force during con- struction and until such time as the sewers and appurtenances have been accepted for maintenance and operation by City of Tukwila, but in no case shall this temporary construction easement extend beyond April 1, 1972. Easement No. 26-35-52 R -1 That said Grantee shall have the right.withou`t prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering or reconstructing said Utilities, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that -such constructing, repairing, altering, ,or reconstructing of said utilities shall he accomplished in such a manner that the private improvements existing- in this right-of-way shall not be disturbed or destroyed, or in the event they arm disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the utilities and so long as no permanent buildings h or structures are erected on said easement. c This easement shall be a'covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
