SMITH his wife, hereinafter termed "Grantor WITNESSETH: E A S E M E N T UQ3 v That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right -of -,,ray or easement for water mains with the necessary appurtenances through, over, and across the following described property situated in King County, Washington, more particularly described as follows: Tract 36, Brookvale Garden Tracts, as recorded in Volume 10 of Plats, Page 47, Records of King County, Washington, and the unplatted strip ad- jacent on the East, EXCEPT that portion thereof in Primary State Highway No. 1. This easement is that portion of the above described tract included within the limits of a strip of land 10 feet in width, with 5 feet on each side of the following described center line: Beginning at the North- west corner of said Tract 36; thence South along the West line thereof a distance of 20.00 feet to the True Point of Beginning of this description; thence South 14°11'04" East a distance of 99.85 feet; thence South 73 °09' 45" East 205.91 feet; thence South 27 °35'14" East 90.80 feet; thence South 12 °54'10" East 20 ft., more or less, to the Northeasterly margin of Pri- mary State Highway No. 1 and the terminal point of this description. The side lines of this easement are to be extended or shortened to terminate at property lines. TOGETHER WITH a temporary construction easement, 30 feet in width, the center line of which is the same as that described above. The side lines of this easement are to be extended or shortened to terminate at pro- perty lines. This temporary construction easement shall remain in force during construction and until such time that the water lines and appurtenances have been accepted by the CITY OF TUKWILA. 5083 592 Said heretofore mentioned Grantee shall have the right, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, repairing, altering or reconstructing water mains or making any connections therewith, without incurring any legal obligation or lia- bility therefor, provided that such constructing, repairing, altering or reconstructing of such water mains shall be accomplished in such a manner that the fences, lawn, shrubbery, drives and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easemen so long as said use does not interfere with the installation and mainten- ance of the water main and so long as no buildings or structures are erected on said easement, /This easement shall be a covenant running with the land and shall be binding on the Gantor!,s successors, heirs and assigns. t G STATE OF WASHINGTON SS COUNTY OF KING I, the undersigned, a notary public in and for the State of Washington, hereby certify that on this 30th day of April 196 8 personally appeared before me Graydon Smites and Marlys ids Smitn to me known to be the individ- uals described in and who executed the foregoing instrument, and acknow- ledged that they signed and sealed the same as their free and voluntary act and deed for the uses and purposes therein mentioned. t Notary Public in and for/the of Washington, residing at Tukwila
