E A S E M E N T THIS AGREEMENT made this 5 th day of April 'v 5083 607 1 1968, by and between the CITY OF TUKWILA, a municipal corporation Q5 of King County, Washington, hereinafter termed "Grantee" and Stanley N. Kasperson, Trustee hereinafter termed "Grantor WITNESSETH: That the said Grantor for valuable consideration does by these presents grant dnto the Grantee a perpetual right -of -way or easement for utility mains and lines with the necessary appur- tenances through, over, and across the following described proper- ty situated in King County, Washington, more particularly described as follows: A fifteen foot wide strip of land described as the Wes- terly 15 feet of the Easterly 21 feet, as measured at right angles to South Center Parkway, of the following described tract. Beginning at the NE corner of the East 1/2 of the NW 1/4 of the NE 1/4 of the NW 1/4 of Section 35, Township 23 North, Range r 4 East, W.M., thence Westerly along the North line 329.61 feet, more or less, to the NW corner thereof, thence South along the West line 262.02 feet, thence Northeasterly 562.33 feet to the Westerly margin of South Center Parkway (57th Avenue S.), thence Northwesterly along said margin 194.88 feet to the North line of Section 35, thence West along said North line 183.68 feet to the point of O beginning. OD to enter upon said property for the purpose of constructing, repairing, altering or re- T14 constructing utility lines or mains or making any connections therewith, without incurring any legal obligation or liability there- fore, provided that such constructing, re- pairing, altering or reconstructing of such utility lines or ;rains shall be accomplished in such a manner that the fences, lawn, shrubbery, drives and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the in- stallation and maintenance of the utility lines or mains and so long as no buildings or structures are erected on said easement.
