FORSYTH -OD termed "Grantor ry WITNESSETH: consideration does That the said Grantor for valuable by these presents grant Canto the Grantee a perpetual right -of -way or easement for utility mains and lines with the necessary appur- tenances through, over, and across the following described proper- ty situated in King County, Washington, more particularly described as follows: A fifteen foot wide strip of land described as the Westerly 15 feet of the Easterly 21 feet, as measured at right angles to South Center Parkway, of the following described tract. That portion of the South 1/2 of the SE 1/4 of the SW 1/4 of Section 26, Township 23 North, Range 4 East, W.M. Beginning at the intersection of the Westerly margin of South Center Parkway (57th Avenue South) with the South line of said Section 26; thence Northwesterly along said margin 42.99 feet; thence Westerly with the South line of said Section 26 a distance of 300 feet; thence Northwesterly parallel with said margin a distance of 225 feet; thence Westerly parallel with said South line 480 feet to the West line of said subdivision; thence Southerly along said r West line 260 feet to the SW corner of said subdivision; thence JD Easterly along the South line of said Section 26 to the point of beginning. vviL uti -Lxty ur ma1115 or maKing any connections therewith, without incurring any legal obligation or liability there- fore, provided that such constructing, re- pairing, altering or reconstructing of such utility lines or mains shall be accomplished in such a manner that the fences, lawn, shrubbery, drives and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the in- stallation and maintenance of the utility lines or mains and so long as no buildings or structures are erected on said easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs and assigns of both parties hereto. 612 STATE OF WASHINGTON )ss.
