HomeMy WebLinkAbout1966 - Easement - Puget Western - 6020018E A S E M E N T THIS AGREEMENT made this 13th day of April, 1966, by and between PUGET WESTERN, INC„ hereinafter called "Grantor and the CITY OF TUK ILA, a municipality of King County, State of Wash- ington, hereinafter called "Grantee," WITNESSETH o That said Grantor, for valuable consideration, does by these presents grant, bargain, sell, convey, and confirm unto the said Grantee, a right- of-way or easement for a storm sewer outfall with necessary appurtenances over, through, across and upon the follow- ing described property, situated in King County, Washington, par- ticularly described as follows: That portion of Government Lot 4 in Section 25, Township 23 Nnreh, Range 4 East W lying Easterly of County Road and Northerly of a line 333 feet North of and parallel with the East and West centerline of said Section 25, Township 23 North, Range 4 East W.M. This utility easement consists of a 15 foot permanent easement described as the North 15 feet of the above described property. TOGETHER WITH a 30 foot temporary construction easement de- scribed as the North 30 feet of the above described property. This 30 foot temporary easement to be used only during con struction of a storm sewer outfall on adjacent property, said temporary easement to cease and determine upon acceptance of the storm sewer outfall for maintenance and operation by the Grantee. The said Grantee shall have the right without prior institution of any suit or proceeding at law, at such times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering or reconstructing said storm sewer outfall, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such constructing, repairing, alter- ing or reconstructing of said storm sewer outfall shall be accomplish- ed in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement so long as said use does not interfere with the installation and maintenance of the storm sewer outfall and so long as no permanent buildings or structures are erected on said easement This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
