tween PUGET WESTERN, INC., a Washington corporation, hereinafter
called "Grantor and CITY OF TUKWILA, a municipal corporation,
hereinafter called "Grantee
WITNESSETH:
That in consideration of One Dollar ($1.00) and other
valuable considerations, receipt of which is hereby acknowledged,
Grantor hereby grants and conveys to Grantee, its successors and
assigns, an easement for an underground water and sanitary and
storm sewer facility right -of -way, together with the right to
construct, reconstruct, operate, inspect, maintain or remove the
same, and other necessary or convenient facilities and equipment
on said right -of -way over, under, upon and across the following
described property located in King County, State of Washington:
The South 10 feet of the North 20 feet of Section
26, Township 23 North, Range 4 East, W.M. lying
within Tract 3, Plat of Andover Industrial Park
No. 2, recorded in Volume 71 of Plats, Pages 68
and 69, records of King County, Washington; Less
the west 27 feet thereof.

Grantee shall have the right to remove any trees, or parts of trees
or other vegetation or natural obstructions within said 10 foot
parcel and may level, grade and re -grade said 10 foot parcel as
may appear to Grantee to be necessary for the construction, opera-
tion and maintenance of its said underground water and sanitary/
storm sewer facilities.
Grantor for himself, his heirs, executors, administrators,
successors and assigns covenants that no structure will be erected
or permitted within said 10 foot parcel, or permitted to otherwise
encroach thereupon, so as to in any way interfere with or endanger Ei
the unrestricted exercise of the rights and privileges herein
granted, that no digging, tunnelling or other form of construction
activity will be done or permitted within said 10 foot parcel which
will in any manner disturb the compaction or unearth any portion u
of the lines or equipment thereon, or in any other way remove,
threaten or otherwise endanger the lateral support in and to said
10 foot parcel or the facilities located therein, and no blasting
or the discharge of any explosives will be permitted within fifteen
(15) feet of the center line of said parcel.
All piping and related facilities laid under this grant
shall be buried to such depth as not to interfere with the ordinary
landscaping of said land, provided, however, that no trees, shrubs,
or bushes shall be planted upon such parcel without first having
obtained the written approval therefor from Grantee.
Grantee shall, at all times, have the right of free ingress

signed, personally appeared ROBERT C. WING and RICHARD E. WILLIAMS,
to me known to be the President and Assistant Secretary, respectively,
of PUGET WESTERN, INC, the corporation that executed the foregoing
instrument, and acknowledged the said instrument to be the free and
voluntary act and deed of said corporation, for the uses and purposes
therein mentioned, and on oath stated that they were authorized to
execute the said instrument and that the seal affixed is the corporate
seal of said corporation.
