HomeMy WebLinkAboutOrd 0244 - Foster Golf Course AnnexationORDINANCE NO. 244 section 1 amended by 252 AN ORDINANCE OF THE TOWN OF TUKWILA ANNEXING PROPERTY TO THE TOWN OF TUKWILA UNDER THE PROVISIONS OF CHAPTER 128 OF THE SESSION LAWS OF THE STATE OF WASHINGTON FOR 1945 WHEREAS, under the provisions of Chapter 128 of the Session Laws of the State of Washington for 1945 a petition in writing asking for the annexation of certain property contiguous to the town limits of the Town of Tukwila hereinafter more particularly described has been filed with the Town Council, signed by the owners of not less than 75% in value, according to the assessed valuation for general taxation, of the property for which annexation is petitioned, which petition sets forth a legal description of the property and was accompanied by plat or drawing outlining the boundaries of the property sought to be annexed, and WHEREAS, the Town council has heretofore fixed September 10, 1957, at the hour of 8:00 p.m., in the Council Chambers in the Town Hall, Tukwila, Washington, as the time and place for public hearing upon such petition, and a copy of said notice was published in the Renton News Record, a legal newspaper of general circulation in the Town of Tukwila, and was posted in three Public places within the territory proposed for annexation, which notices specified the time and place of such hearing and invited interested persons to appear and voice approval or disapproval of the annexation, and WHEREAS, at the time and place set for said hearing, certain protests being made, the Town Council, by motion continued the hearing to Monday September 16, 1957, at 8:00 o.m. and at said meeting the council approved the petition for annexation after excluding a portion thereof andset midnight, September 30, 1957 as the effective date of the annexation Now, therefore, BE IT ORDAINED by the Town Council of Tukwila, as follows: SECTION I: That pursuant the provisions of Chapter 128 of the Session Laws of the State of Washington for 1945 the following described property contiguous to the town limits of THE CITY OF TUKWILA TO-WIT A portion of Sections 24, 23, 14 and 15, Twp. 23 No., R. 4 E.W.M. described as follows: Beginning at a point in the NW- of Section 24, Twp. 23 N., R. 4 E. W. M. approxi- mately 1900 feet south and 850 feet east of the northwest corner of said 24 at the intersection of south- westerly Right of Way line of Northern Pacific Railway and the thread of the stream of Green River also known as Duwamish River being a point in the easterly boundary of present City Limit of Tukwila and running thence northwest- erly along the southwesterly Right of Way line of the North- ern Pa3i.fic Railway through Sections 24, 23 and the East half of Section 14, Twp. 23 N R. 4 E.W.M. to the north and south center line of said Section 14; thence southerly along said center line 100 feet more or less to the thread of the stream of the Duwamish River, following thence northerly down stream along said thread of stream of the Duwamb h River through the West half Sec. 14 and C. D.'I wis Donation Claim No. 37 to a point which bears N. 40 °36' E from a point on the northeasterly Right of Way line of Puget Sound Electric Railway now City of Seattle Transmission Line) which point is 564.29 feet measured along said Right of Way Line N. 49 24' W from the northwesterly margin of a 16 -foot private road (48th Ave. So.) running thence S. 40 °36' W 1270 feet more or less along the northwesterly line of Tax Lot 8 to said point on the northeasterly margin of City of Seattle Trans- mission Line, thence continuing S 40 °36' W across said Trans- mission Line 100 feet to a point in the northeasterly Right of Way Line of Secondary State Road No. 5M in the NE- of Section 15, Twp. 23 N., R. 4 E.W.N. running thence south- easterly in NE4 of Section 15 and the NW4 of Section 14 along said northeasterly Right of Way line 2600 feet more or less to a point which bears N. 74 E of the northeasterly corner of the J. A. Radford Property Tax Lot _No. 2 in the SW of Sec 14 Township 23 N. Range 4 L.W.M) thence S 74 °27' 30" W 67.81 feet more or less to the northeasterly corner of said Z. A. Radford property, said northeasterly corner being located on the southwesterly right of way line of said state road No. 5M, continuing thence S 74 27'30" W along the northwesterly boundary of said J. A. Radford property 177 feet more or less to the northwesterly corner of said J. A. Radford property said corner also being the northeasterly corner of th Carl Brewer property (Tax lot ho. 90) continuing thence S. 7 27'30" W. along the northwesterly boundary of said Carl Brewer property 125 feet more or less to the northeasterly corner of said Carl Brewer property, said northeasterly corner being on the northeasterly right of way line of 56th Avenue South at a point which bears S. 46 04' E 33.84 feet from the intersection of said northeasterly right of way line of 56th Avenue South with the northwesterly right of way line of S. 137th St. continuing thence S. 74 27'30" W 34.82 feet more Foster Donation Claim No. 38 and the present northerly Limit of Tukwila; running thence easterly along said Limit line of Tukwila being So. 139th St. 2150 feet more or less to the center line or thread of the stream of Duwamish River; thence southerly upstream along the thread of the stream of the Duwamish River being present Limit of Tukwila 7300 feet more or less to thepoint of beginning. Shall be and the same hereby is annexed to the Town of Tukwila. SECTION II: The said annexation shall be effective on and after Midnight September 30, 1957 and from and after said date said property shall be subject to all the laws and ordinances of the Town of Tukwila then and thereafter enforced. SECTIGN III: This ordinance shall be in full force and effect five days from and after its passage approval and legal publication as provided by law.
