PERMIT CONDITIONS: 1: ***BUILDING PERMIT CONDITIONS*** 2: Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in accordance with the approved construction documents shall be resubmitted for approval. 3: All permits, inspection record card and approved construction documents shall be kept at the site of work and shall be open to inspection by the Building Inspector until final inspection approval is granted. 4: Insulating materials, where exposed as installed in buildings of any type of construction, shall have a flame spread index of not more than 25 and a smoke development index of not more than 450. Where facings are installed in concealed spaces in buildings of Type III, IV, or V construction, the flame spread and smoke - developed limitations do not apply to facings, that are installed behind and in substantial contact with the unexposed surface of the ceiling, wall or floor finish. 5: Subgrade preparation including drainage, excavation, compaction, and fill requirements shall conform strictly with the recommendations given in the soils report. Special inspection is required. 6: All construction shall be done in conformance with the Washington State Building Code and the Washington State Energy Code. 7: Notify the City of Tukwila Building Division prior to placing any concrete. This procedure is in addition to any requirements for special inspection. 8: All wood to remain in placed concrete shall be treated wood. 9: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building inspector. C 10: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the Building Official from requiring the correction of errors in the construction documents and other data. 12: New and existing buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall be a minimum of 4 inches (102mm) high with a minimum stroke width of 0.5 inch (12.7mm). (IFC 505.1) 13: Adequate ground ladder access to rescue windows shall be provided. We discussed the "substandard lot" located at tax parcel 0179001101, a 3000 square foot lot in Allentown. To summarize, the property owner purchased the subject lot in 2015 and desires to complete an addition that was previously started in 2004 but never received a final inspection. At the time, Code Enforcement made a notation about the structure (a garage converted to a SFR) not having permits for the conversion, but no further enforcement action was taken. You asked whether TMC 18.70.030 applies to this situation, specifically because the lot had previously been owned by the same owner as the neighboring lot prior to the adoption of the substandard lot provisions in the code but was sold in 2007. TMC 18.70.030 regulates development of substandard lots --lots which do not meet the minimum lot width or basic development in the zone in which the lot is located. This section outlines the circumstances under which a substandard lot "may be developed." "Develop" is not defined in the section. Minimum lot size in this zone is 6500 square feet. The subject lot does not meet the basic development standards of the zone because it is only 3000 square feet. However, this lot is already improved with a structure: a garage which was converted into a single-family residence at some point prior to annexation. The structure is noted in KC Assessor's records as being a SF unit. It is my opinion that TMC 18.70.030 applies to vacant lots being develop or lots which are being redeveloped, but not to lots which already have a structure on the property and where the owner is merely seeking to remodel or make other improvements to an already existing structure. To interpret TMC 18.70.030 to apply to any and all development would mean a property owner could never make any improvements which require City approval if there is already a structure on the property. This could eventually result in houses becoming dilapidated, which is not likely the intent of the Council when adopting this section. Further, the lot is not being "developed" per se, but rather is already developed. Because TMC 18.70.030 does not apply, we must next look to the nonconforming structure provisions found in TMC 18.70.050. Here, the total lot area size is what makes this structure nonconforming. As long as the.addition meets all other applicable development standards, completing the addition would not increase the degree of nonconformity and should be allowed. Of course, the structure must still be a "legal" nonconforming structure. As mentioned above, there are no permit records for the conversion. The property owner, however, provided the City with KC documents dating back to the 1950s stating that the structure had been converted to a SF unit. If the City required all property owners to provide permit records for their homes, it's likely that many lawfully constructed homes would not be able to provide such evidence as County record keeping was notoriously sloppy. Further, if the lack of permit history was an issue, it should have been addressed in 2004.
