AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING A NEW ZONING CODE AND SHORELINE REGU- LATIONS, AMENDING ORDINANCE NO. 898 AND REPEALING ORDINANCE NOS. 251, 1109 AND 1186. WaREAS, through the statutory provisions of Chapter 35A.63 of the Revised Code of Washington, the City of Tukwila is authorized to adopt and effectuate zoning regulations and standards for the use of land and buildings located within its corporate limits, and WHEREAS, a zoning code for the City of Tukwila was first adopted in 1957 and has been amended from time to time, and WHEREAS, there have been substantial changes in land use practices, physical development and community values in the City of Tukwila since 1957, and WHEREAS, during the last five years, it has become apparent to the City's elected officials, employees and members of the Planning Commission and Board of Adjustment that a comprehensive review of these land use regulations for the City of Tukwila was required, and WHEREAS, the City's Shoreline Master Program requires regular review and updating of its regulatory provisions, and WHEREAS, since April, 1978, a series of public meetings and public hearings were conducted by the Planning Commission which resulted in a proposed new zoning code and shoreline regulations for the City of Tukwila, and WHEREAS, following the preparation of a proposed zoning code by the Planning Commission, the City Council of the City of Tukwila has conducted a number of public meetings and public hearings for purposes of creating and adopting a new zoning code and shoreline regulations, and WHEREAS, pursuant to the State of Washington Environmental Policy Act, as amended, the State of Washington Shorelines Management Act of 1971, as amended, and other applicable federal and state regu- lations, a thorough review has been made of the environmental impact of the new zoning code and shoreline regulations, and WHEREAS, a final Environmental Impact Statement has been prepared and reviewed by the City Council of the City of Tukwila, together with various other federal and state regulatory requirements, and WHEREAS, based on the recommendation of the Planning Commission of the City of Tukwila, independent consultants, city staff, public com- ments, and other information and data provided during the course of prep- aration and review of the new zoning code, the City Council of the City of Tukwila has determined that it is in the best interests of the public health, safety, morals, general welfare of citizens property owners in the .City of Tukwila, Washington, that a new zoning code shoreline regulations be adopted. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: 1. There shall be a n ew zoning code and shoreline regulations as set forth as Exhibit A *to this Ordinance. 2. The provisions of Ordinance No. 898 (Shoreline Master Plan) are hereby amended as follows: Chapter 6 and 7 of said ordinance relating to shoreline use provisions and variance procedures are hereby repealed in favor of the shoreline regulations contained in Chapter 18.44 of Exhibit A, provided, however, that such regulations shall remain in full force and effect until such time as the pro- visions of Chapter 18.44 are approved by order of the state. 3. Ordinance Nos. 251 (as amended), 1109 and 1186 are hereby repealed. 4. The provisons of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, sub- division, section, or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance or the validity of its ap- plication to other persons or circumstances. 5. This ordinance shall take effect and be in force beginning at 12:01 a.m., April 1, 1982. PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a regular meeting thereof this day of 7,4(41 1982. By letter dated March 17, 1982, Mayor Todd Vetoed this Ordinance.
