PURPOSE: Tho purpose of this ordinanco is to provide minimum standards, provfone, and requiremonts for safe installation of gas pipes and as appliances on consumers' property, and to regulate the sale, maintenance, and alteration of such appliances. SECTION 2. SCOPE: All gas appliances or gas pipes hereafter sold, instal- led, maintained or altorod within the corporate limits of the toms shall conform to the requirements of this ordinance. SECTION 3. DfFINITIO:IS: The following dofinitiona aro providod for the sole purpose of propor intorprotation and administration of this ordi- nance. (1) Certificate of Approval shall moan a document iasuod and attached to the material., pf 1ng, or appliance inspected, complatoly filled out, to- dothor with data, address of the premises or consumer, and aignod by the Inspector. (2) Consunor nhail mean an porson, parsons, customer, firm, association, municipal corporation and/or corporation that usoa gas, including resi- dontial, cocaorcial, and industrial users. (3) Gas shall mean natural, artificial and /or mixed gas. '>4) Gan Aeoliance shall moan any appliance or device used for burning gas. (5) Oas Company shall moan any porson, first, or corporation holding a franchise or permit to distribute gas iithin the corporate limits of tho torn. (6) Goo Copany •Service •Line shall mean the gas piping leading from the gas main to the proporty lino,gr to the point of delivery. (7) Gas-Fitter shall moan one mho doss any gas fitting work, installs, or remodels any piping or appliance vhich would be subject to nuporvision and inspoction under tho provioiona of this ordinanco. (3) Ins octor shall moan the arlmtnistrative authority so doaignatod by this ordnance or his duly authorized roprosentative. (9) Pornon shall mean any porson, firm association or corporation. (10) Point of Deliver' shall mean the junction of the utility's meter sul thrtho consumors' piping. (1 Promieon aball moan the property, including structures, of the consumor. (12) Usodjaa applianco shall moan a gas appliance ubich has been previously sold, installed, and used. (13) Vent shall mean a pipe, flue, or chimney designed and /or installed to carry the products of combustion from an appliance to the outside atmosphere. SECTION 4. GAS FITTERS LICE: Sn RL UI !.,D: No person shall install, extend or alter any gas appliance or piping pertaining to, or in connection with, gas services on a consumer's premises within the corporate limits of the Town unless such person presents satisfactory evidence of a valid Gas Fitters License issued by the State df Washington, or a County, City or Town of said State of Washington; provided that nothing herein shall pro- hibit any person from personally installing gas pipes, gas appliances, or making alterations on gas pipes and gas appliances or from doing any other work permitted by this ordinance on his own premises under the following terms and conditions: (1) He shall secure a permit, (2) Personally do the work in the manner required by this ordinance, subject to the inspection and approval of the Inspector. Provided, however, that a person who is not a licensed Gas Fitter may obtain a permit or permits for only one residence which he occupies, each year. Provided, further, that qualified employers of the Gas Company may engage in the work and activities mentioned in this section without having a Gas hitter's License. SECTION 5. ENFORCEMENT AND ENTRY FOR INSPECTION: The inspector is hereby authorized and directed to cause inspections to be made of all consumer gas Installations within the Town and to enforce all provisions of this ordi- nance; upon presentation of proper credentials, the Inspector may enter any consumer's building or premises at any reasonable time for the purpose of making inspection or preventing violations of this ordinance. SECTION C. PERMITS FOR WORK ON CONSUMER'S PROPERTY: No person shall install extend or alter any gas piping or gas appliance pertaining to, or in con- nection with, a gas system on a consumer's premises without first applying for a permit in the form prescribed by and from the Inspector to do such work•Provided. however, that no permit is required for servicing gas appli- ances. Such perm shall state the kind of work to be done thereunder, and it shall be unlawful for any person to do or perform any work other than that designated in such permit. Such a permit shall also state the location by street and number of the consumer's premises amixzkzi} where such work is td one and shall be valid only for the location so stated. A separate permit shall be issued for each consumer's premises and shall terminate ninety days after issuance unless extended by the Inspector for good and sufficient cause. Persons failing to obtain permits within 43 hours of the start of work shall be subject to the penalties of Section 20 Of this ordinance.. SECTION 7. RECORDS: The Inspector shall keep a Record of all gas install- ations inspected. He shall also keep a record pf permits issued under this ordinance. SECTION S. METER LOCATION2: A meter location shall be provided by the consumer for the building or premises to be served, and the location shall be such that the meter connections are easily accessible in order that the meter may be read or changed. No gas meter shall be hereafter installed under a stoop, stairway, show window or porch or in an unventilated or confined space, and shall be a safe distance fro a furnace, boiler or other heating appliance. No meter shall be placed in any location where it will be inaccessible or exposed to injury, such as driveways, or where it will be subjected to excessive corrosion. SECTION 9. PIPING INBPECTION: (1) Inspector to be Notified for Inspection. then any work done under a permit issued by the Inspector is completed and ready for in- spection, the person to whom the permit has been issued shall, within twenty -four hours after completion of said work, notify the Inspector that the same has been completed and is ready for inspection anu the Inspector shall cause said work to be inspected within a reasonable time thereafter. The Gas Company shall not cause gast enter the consumer's gas appliance through the meter without the Inspector's sig.ature of Approval being evident on the permit. (2) Test and Piping Inspection. Test and piping inspection shall be made by the Inspector after all piping; authorized by the permit has been txxxsidxskstiputtickta installed and before any portions thereof which are to be concealed by plastering or otherwise, have been so concealed, and before any fixtures or gas appliances have been attached thereto. This inspection shall include a pressure test at which time the piping shall stand an air pressure equal to not less than the pressure of a column of mercury six(6) inches in height, and the piping shall hold this air pressure for a period of at least teh(1O) minutes without any perceptible drop in pressure. A U -Guage type mercury column shall be used for the test. (3) Tools, Apparatus and Labor for Test. All tools, apparatus, lsbor and assistance necessary for the test shall be firnished by the permittee. SECTION 10. CERTIFICATE OF APPROVAL: The Inspector shall issue a Certificate of Approval at the completion of the work for which a specific permit has been issued if, after inspection, it is found that such work has complied with the provisions of this ordinance and all other requireaent s of law or ordiaance applicable hereto, SECTION 11. DEFECTIVE ORK OR .T I ,L;1:: If the inspection shall show that defective materials gave Peen used or defective workmanship has been per formed in the installation, alteration or extension of any gas pipe, fixture or appliance in or on any consumer's premises, such defective materials or work shall be replaced by the permit holder within three days and the inspection repeated. SECTION 12. DANGEROUS OR DEiECTIVE PIPING OR APPLIANCE, OIBCC �I i CTIG- OF BY IN SPECToR (1) The inspector may cause to be disconnected any gas piping, fixture or appliance which has been con_ ±ected before a certificate of approval has been issued, or which, upon inspection, shall be found de- fective or in such condition as to endanger life or property. In all cases in which such a disconnection is .:jade, a notice shall be affixed thereto and shall state that the same has been disconnected by the In- spector, together with the reasons therefor, aria it shall be unlawful for any person to remove said notice or to reconnect said gas piping, fixture or appliance until authorized by the Inspector to do so. (2) The Inspector shall have the cauty, responsibility and right to access to inspect all gas appliances in public builuinLs, cor :iercial buildings, and industrial plants in connection with the enforcement of fire regulations. SECTION 13. DISCONTINUANC:. OR REFUSAL O ,!;E VICE. (1) The gas company may discontinue or refuse to supply Las for any gas iiping, fixture or gas appliance which it may find to be defective or leaking, or in such condition as to endanger life or property: Provided, however, that the gas company shall immediately give written notice of discontinuance or refusal of service to the inspector and the Occupant of the consumer's building or premises where such gas supply discontinued or refused, The Inspector shall i mmediately make an in- vestigation of the conditions reported by the gas company and it ehall be unlawful for any person to reconnect any gas piping, fixture or appliance until authorized by the Inspector. (21 In all cases in which the supplying of gas has been discontinued for safety reasons, the supplying of gas shall not be resumed until author- ized by the Inspector. Provided, however, that if the gas has been turned off by a Gas Fitter or an employee of the Gas (.om. .any while doing work on the premises, such Gas Litter or employee is entitled to turn on tae gas main when he has finished the work, without authorization from the Inspector. SECTION 14. Requirements of hew or Used GAS APPLI CES Er: s) ACOLa RIES (1) All gas appliances and accessories installed for domestic or commercial use shall comply with, and be of a design and construction of applicable American Standard Approval, Listing and Installation require- ments for gas appliances and accessories covering safe operation, sub- stantial and durable c,nstrietion, acceptable performance and installation of the American Gas Association, Inc., and adopted by the American stand ards Association, Inc., and as hereafter aamended: Provided, however,that industrial and other specialized appliances ants equipment not included in the above requirements of the American Gas Association, inc., and adopted by the American Standards Association, Ina., may be sold on approval of the Inspector. Each appliance approved by the American Gas Association, Inc. shall be so marked or labelled with a distinctive trade mark or name as a means of identification and shall bear information showing the rated heat input in BTU per hour. Each new gas appliance approved by the American Gas Association, Inc., shall be considered as approved appliance and shall also be marked and labelled. All new hot water heaters and heating appli- ances shall also be equipped with an American Gas A sociation approved complete shut -off type automatic pilot, (2) All used gas appliances hereafter sold or offered for sale or installed shall be approved by the inspector for Safety, and shall be identified accordingly; used gas apolian.ces shall be connected to as outlets for use at the time of inspection, in the event the apuliance has been used with Butane, Propane, or other liquefied petroleum Lases, it shall be subject to approval by the Inspector as having been properly converted for use with natural gas or any admixture thereof. SECTION 15. CONVERSION FROM NON- GAS FTJL L TO ,;TUR L GAS: Furnaces, boilers or other types of heating equipment designed to burn gzatxlaLet$txxx k fuel other than gas shall not be converted to burn Las until such equipment has been approved for conversion by the Inspector. All heating appliances which are converted to gas shall be vacuum cleaned anc_ brushed down. SECTION 16. PROPER INSTALLATI6N: Every gas appliance hereafter installed shall be installed in accordance with the requirements of gas piping and gas appliances in buildings set forth in the ;BF J o.54, standards of the National Board of Fire Underwriters for the Installation of Gas Piping. and Gas Appliances in Build.inu,dated September, 1954. SECTION 17. UNLAWFUL RESTORATI(Z OF G S A O BY-P SaI G GE i ET. It shall be unlawful ror any person to restore the flow of ;as through pipes which have been shut off either by the Gas 'ompany or the Inspector, or to cause gas supplied by the Gas Gornpany to byppass the meter by which the amount of gas is measured. SECTION I.S. ADOPTION BY REIN RENC The following, and as the sale also may be amended hereafter, are hereby adopted by reference and shall be observed/ American Standard Requirements for installation of DomesetIeaasue Conversion burners V421.3 American Standard Requirements for installation of Gas Uonversion burners in Domestic Ranges 621.3: NBFLT No .54 Standards of the i ational toard of Fire Under? ri :er s for the Installation of Gas Piping and Appliances in buildings SECTION 19, CONFLICTING PROVISIONS :In the event any of the provisions of this ordinance conflict with any other provisions of this ordinance, with any other ordinances of this Town, or with the standards embodied in state and Federal laws and rules and regulations, the provisions containing the highest standards shall be observed. SECTION 20. PENALTIES: Any person that shall fail to comply with, or violate, any of the provisions of this ordinance shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined in an amount not exceeding $300.00 or by imprisonment in the town jail not exceeding 90 days or by both such jine and imprisonment. SECTION 21. CONFLICT: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 22. VALIDITY: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 23. TITLE OD ORDINANCE: This ordinance shall be known as the "Gas Ordinance of Tukwila" and may be cited as such. SECTION 24. EFFECTIVE DATE: This ordinance shall be in full force and effect five(5) days from, and after its passage, approval and legal publication as provided by law. It shall be unlawful to sell or install any gas appliance not conforming to the regulations and requirements of Section 13 after the expiration of a ninety(90) day period from the date of passage of this ordinance.
