AN ORDINANCE RELATING TO SIDEWALK CONSTRUCTION AND AMENDING ORDINANCE NOS. 1158 and 1217 The CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON does ordain as follows: 1. Section 1 of Ordinance No. 1158 passed in May, 1980 and amended by Ordinance No. 1217, passed in June, 1981, is hereby amended to read as follows: "Whenever a building permit application is made for the construction of new multi residential, commercial or industrial structures within the City, the person, partnership, or corporation seeking such permit shall submit a sidewalk construction plan for approval by the Directors of the Departments of Public Works and Planning. The sidewalk construction plan shall include all plans and specifications necessary for the construction of sidewalks adjacent to all edges of the property adjoining any street or public right -of -way. A building permit shall not be issued until after a sidewalk construction plan is approved by the Director of the Department of Planning with the consent of the Director of the Department of Public Works. "No final certificate of occupancy shall be issued for the subject project until the sidewalks have been constructed in accordance with the approved plan or the applicant has made 6°t-469 eteF alternate arrangements with the Director of the ni_ n__.n� nq Department of Public Works, which have been approved by the Director of the Planning Department. "Building permit applications for construction of improvements on property zoned for single- family residential use shall be excluded from this requirement except when such sidewalk is built as a part of an overall development, plat or subdivision." 2. Section 4 of Ordinance No. 1158, passed in May, 1980, and amended by Ordinance No. 1217, passed in June, 1981, is hereby amended to read as follows: "A delay, waiver or exception to the requirements of this Chapter may be granted by the City ORDINANCE Page 1 5669A /LEH Council upon request by the applicant. Said request may be granted if the City Council determines that such construction is not feasible because of: unique topographical considerations, conditions, or existing City Public Works development plans; or would such construction would render a hardship on the applicant. In the event any person desires to file such a request for delay, waiver or exception, such request must be considered by the City Council at least thirty (30) days before the requested building permit is issued as follows: "As a condition for granting a delay, waiver or exception to the requirements of this chapter set forth above, the City Council may require the applicant to make an agreement which would provide that such sidewalk improvements would be constructed at the applicant's sole expense or to provide for the construction of said sidewalk improvements by means of participating in a future local improvement district, or districts, whichever should occur sooner." "In the event a building permit is sought for a development adjoining any street or other public right -of -way which does not have an established finished grade with associated storm drain and utility systems, including establishment of the width of said street or right -of -way, the Director of Public Works is authorized to enter into an agreement with said permit applicant to provide for the construction of said sidewalk improvements by means of a proposed participating in a future local improvement district, or districts, er developer's agreement. or to make an agreement which would provide that such sidewalk improvements would be constructed at the applicant's sole expense_" PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON at a regular meeting thereof this go day of 1981.
