DECLARATION OF COVENANT FOR INSPECTION AND
MAINTENANCE OF STORMWATER FACILITIES AND BMPS
1. Partes
1.1 This Covenant for Inspection and Maintenance of Stormwater Facilities and Best
Management Practices ("Covenant") is made by and between Bellwether Tukwila LLLP as Grantor, and the
City of Tukwila, a Washington Municipal Corporation, as Grantee. Grantor and Grantee (also denoted as
City herein) are each a Party and collectively the Parties to this Agreement.
2. Recitals
2.1 Grantor applied to City for issuance of a Stormwater Vault on December 23rd, 2019, Building
Permit on March 9th, 2020, and Construction Stormwater General Permit on November 18th, 2020.
2.2 Pursuant to TMC 14.30.060, application for and issuance of such permit requires the property
owner to enter into this Covenant.
2.3 The subject of the Covenant is the real property located in King County, Washington, bearing
King County Tax Parcel No. 004300-0108 and legally described in the attached Exhibit A incorporated herein
("Property").
2.4 The City approved the applications which consist of the following documents, attached and
incorporated herein:
2.4.1 City issued Permit No(s). D19-0317; D19-0318, WAR308708 Exhibit B.
2.4.2 Stormwater Facility/BMP Site Plan, Exhibit C.
2.4.3 Operations & Maintenance Plan including schedule, Exhibit D.
3. Terms of Agreement
NOW THEREFORE, in consideration of the foregoing recitals and other good and valuable
consideration including approval and issuance of City of Tukwila Permit D19-0317, December 23rd, 2019;
D19-0318, March 9th, 2020; WAR308708, November 18th, 2020; the sufficiency and receipt of which are
acknowledged, Grantor hereby irrevocably covenants as follows:
3.1
Covenant .
The foregoing Recitals and references to documents are incorporated as material terms of this
3.2 The Grantor(s) for itself and its successors in interest having any ownership interest in the
Property (collectively Owners) shall at their sole cost and expense retain, uphold, operate, maintain, and repair
the stormwater facilities and best management practices as defined on Exhibit C ("BMPs") located on the
Property pursuant to the schedule within the Operations & Maintenance Plan.
3.3 The obligations required under Section 3.2 above shall be taken consistent the following:
3.3.1 The City shall have the right of ingress and egress over those portions of the Property
necessary to perform inspections of the stormwater facilities and BMPs and conduct other activities specified
in this Declaration of Covenant and in accordance with Tukwila Municipal Code ("TMC") 14.30.80. This

right of ingress and egress, right to inspect, and right to perform required maintenance or repair shall be as
provided for in subsection 3.3.2 below.
3.3.2 If the City determines that maintenance or repair work is required to be done to any
of the stormwater facilities or BMPs, the Director of Public Works or designee (the "Director") shall give
notice of the specific maintenance and/or repair work required pursuant to TMC 14.30.080. The Director shall
also set a reasonable time in which such work is to be completed by the Owner. If the above required
maintenance or repair is not completed within the time set by the Director, the City may perform the required
maintenance or repair, and is hereby granted access to the Property for such purposes. Written notice will be
mailed to the Owner stating the City's intention to perform such work. This work will not commence until at
least seven (7) days after such notice is mailed. If, within the sole discretion of the Director, there exists an
imminent or present danger, the seven (7) day notice period will be waived and maintenance and/or repair
work will begin immediately.
3.4 If at any time the City reasonably determines that a stormwater facility or BMP on the
Property presents an imminent hazard, as identified by TMC 14.30.080 and herein incorporated by reference,
the Director or equivalent municipal successor's official may take measures specified therein.
3.5 The Owner shall assume all responsibility for the cost of any maintenance or repair work
completed by the City as described in Covenant. Such responsibility shall include reimbursement to the City
within thirty (30) days of the receipt of the invoice for any such work performed. Overdue payments will
require payment of interest at the current legal rate as liquidated damages. All such costs and expense shall
constitute a lien against the Property.
3.6 The Owners shall obtain a Type C Public Works permit from the City prior to filling, piping,
cutting, or removing vegetation (except in routine landscape maintenance such as replacement of plants and
pretreatment mulch) in open vegetated stormwater facilities (such as swales, channels, ditches, ponds, etc.),
or performing any alterations or modifications to the stormwater facilities and BMPs referenced in this
Covenant. Prior to the final approval and issuance of the new permit, a new Covenant with updated exhibits
reflecting the changes to the stormwater facilities shall be recorded at the Owner's sole cost, and a copy of the
new recorded Declaration of Covenant provided to the City.
3.7 Any notice or consent required to be given or otherwise provided for by the provisions of this
Declaration of Covenant shall be effective upon personal delivery, or three (3) days after mailing by Certified
Mail, return receipt requested, to the address listed below for that party:

3.8 With regard to the matters addressed herein, this Covenant constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements whatsoever whether
oral or written. This Covenant shall be governed by the laws of the State of Washington. Any suit to enforce
or relating to this Covenant shall only be filed in King County Superior Court, King County, Washington, and
the Parties consent to the jurisdiction thereof. In the event of any legal action by either Party relating to this
Covenant, the Parties shall pay their own costs or fees.
3.9 This Covenant is intended to protect the value and desirability of the real property described
in Exhibit A, promote the efficient and effective management of stormi,vater drainage, and shall inure to thc
benefit of all the citizens of the City and its municipal successors and assigns. References herein to the TMC
shall include subsequent amendments to such statutes and all successor statutes.
3.10 This Covenant shall run with the land and shall be binding upon the Owners as defined in
Section 3.2 above.
3.11 This Covenant may be amended or terminated only with the advance express written consent
of the City as determined pursuant to its discretion.

This permit shall become null and void if the work 5 not commenced within 180 days for the date of issuance, or if
the work is suspended or abandoned for a period of 180 days from the last inspection.

2: Work shall be installed in accordance with the approved construction documents, and any changes made
during construction that are not in accordance with the approved construction documents shali be
resubrnitted for approval.
3: All permits, inspection record card and approved construction documents shall be kept at the site of work
and shall be open to inspection by the Building Inspector until final inspection approval is granted.
4: The special inspections and verifications for concrete construction shall be as required by IBC Chapter 17,
Table 1705.3.
5: The special inspections for steel elements of buildings and structures shall be required. All welding shall be
done by a Washington Association of Buikiing Offlcial Certified welder.
6: The special inspection of bolts to be installed in concrete prior to and during placement of concrete.
7: When special inspection is required, either the owner or the registered design professional in responsible
charge, shall employ a special inspection agency and notify the Buliding Official of the appointment prior to
the first buliding inspection. The special inspector shall furnish inspection reports to the Building Official in
atimely manner.
8: A final report documenting required special inspections and correction of any discrepancies noted in the
inspections shall be submitted to the Buliding Officlal. The final inspection report shall be prepared by the
approved special inspection agency and shall be submitted to the Building Official prior to and as a
condition of final inspection approval.

vertical rise of 10 feet or more and will be unworked for greater than 12 hours. During this time period,
cover or mulch other disturbed areas, if they will be unworked more than 2 days. Covered material must
be stockpiled on site at the beginning of this period. Inspect and maintain this stabilization weekly and
immediately before, during and following storms.
115: From May 1 through September 30, inspect and maintain temporary erosion prevention and sediment at
least monthly. All disturbed areas of the site shall be permanently stabilized prior to final construction
approval.
116: The property owner is responsible for the maintenance of its storm drainage system and, for this purpose,
shall have a maintenance plan in place and the responsibility for maintenance assigned prior to Public
Works final.
117: Any Public Storm Manhole(s) shall be installed per City of Tukwila Standard Detail no. DS -09; including (all
in color) letters, seal, and City logo.
118: A water quality device is required for the storm drain system in the parking lot unless proof of existing
water quality device is submitted.

easement documentation prior to the Final Inspection.
125: A copy of the recorded easement document for ingress/egress and utilities shall be submitted to the Public
Works Inspector prior to the Final Inspection.
126: Geotechnical Engineer/Soils Engineer shall provide certification of trench backfill to the Public Works
Inspector. Trench backfill shall be per 2012 WSDOT Standard Specifications for Road, Bridge, and Municipal
Construction. (No native backfill unless approved by the City Engineer.)
127: Refer to WAR308708 for DOE Construction Stormwater General Permitfor the Confluence Apartments.
128: Maintain emergency, pedestrian, and vehicular access to buildings, trails and transit at all times.
129: Coordinate any relocation of power poles and installation of new street lights with Power Provider (Puget
Sound Energy - PSE). PSE has a Franchise Agreement with the City.
130: New public sidewalk within shall be wide and have expansion joints at 12' o.c. with
score joints at the midpoints (between the expansion joints). Coordinate with the Public Works Inspector
and the Planning Division. (Per C.O.T. standard detail RS -11.)
131: (1) Sidewalk Easement (2) Conveyance of Public Improvements and (3) Material List shall be signed by the
Owner/Applicant as part of the Turnover process; all prior to Public Works final. As part of the turnover,
Owner shall provide As-Builts & an ACAD CD. Owner shall also provide a two (2) year maintenance bond in
the amount of 10% x cost of work within the Public right-of-way.
132: Owner/Applicant shall contact the local postmaster regarding location of mailbox(es) installation. Location
of mailbox(es) installation shall be coordinate with Public works.
133: Prior to Public Works Final, provide storm drainage as -built plan, storm drainage maintenance plan and

148: Truss shop drawings shall be provided with the shipment of trusses delivered to the Job site. Truss shop
drawings shall bear the seal and signature of a Washington State Professional Engineer. Shop drawings
shall be maintained on the site and available to the building inspector for inspection purposes.
149: Insulating materials, where exposed as installed in buildings of any type of construction, shall have a flame
spread index of not more than 25 and a smoke development index of not more than 450. Where facings
are installed in concealed spaces in buildings of Type III, IV, or V construction, the flame spread and smoke -
developed limitations do not apply to facings, that are installed behind and in substantial contact with the
unexposed surface of the ceiling, wall or floor finish.
150: Subgrade preparation including drainage, excavation, compaction, and fill requirements shall conform
strictly with the recommendations given in the soils report. Special inspection is required.
151: All construction shall be done in conformance with the Washington State Building Code and the
Washington State Energy Code.
152: Structural Observations in accordance with I.B.C. Section 1709 is required. At the conclusion of the work
included in the permit, the structural observer shall submit to the Building Official a written statement that
the site visits have been made and identify any reported deficiencies which, to the best of the structural
observer's knowledge, have not been resolved.
153: Notify the City of Tukwila Building Division prior to placing any concrete. This procedure is in addition to
any requirements for special inspection.
154: Special inspection for sprayed fire-resistant materials applied to structural elements and decks is required.
Special inspections shall be based on the fire -resistance design as designated in the approved construction
documents.
155: All wood to remain in placed concrete shall be treated wood.
156: Masonry construction shall be special inspected.
157: All rack storage requires a separate permit issued through the City of Tukwila Permit Center. Rack storage
over 8 -feet in height shall be anchored or braced to prevent overturning or displacement during seismic
events. The design and calculations for the anchorage or bracing shall be prepared by a registered
professional engineer licensed in the State of Washington. Periodic special inspection is required during
anchorage of storage racks 8 feet or greater in height.
158: There shall be no occupancy of a building until final inspection has been completed and approved by
Tukwila building inspector. No exception.
159: A Certificate of Occupancy shall be issued for this building upon final inspection approval by Tukwila
building inspector.
160: All construction noise to be in compliance with Chapter 8.22 of the City of Tukwila Municipal Code. A copy
can be obtained at City Hall in the office of the City Clerk.
161: Every occupied space other than enclosed parking garages and buildings used for repair of automobiles
shall be ventilated in accordance with the applicable provisions of the International Mechanical Code.
162: Water heaters shall be anchored or strapped to resist horizontal displacement due to earthquake motion.
Strapping shall be at points within the upper one-third and lower one-third of the water heater's vertical

State and local regulations require all stormwater management systems to be inspected on a regular basis and
maintained as necessary to ensure performance and protect downstream receiving waters. Without maintenance,
excessive poflutant buildup can limit system performance by reducing the operating capacity of the system and
increasing the potential for scounng of poltutants during periods of high flow.

The BioPod~8iofilter System (BioPod) is a stormwater biofiltration treatment system used to remove pollutants

inlet rack to minimize scour. The biofiltration chamber is filled with horizontal layers of aggregate (which may or
may not include an underdrain), bioftration media and mulch, Stormwater passes vertically down through the
mulch and biofiltration media for treatment. The mulch provides pretreatment by retaining most of the solids or
sediment. The biofiltration media provides further treatment by retaining finer sediment and dissolved pollutants.
The aggregate allows the media bed to drain evenly for discharge through an underdrain pipe or by infiltration.
Configuration
The BioPod system can be configured with either an internal or external bypass. The internal bypass allows both
water quality and bypass flows to enter the treatment vault, The water quality flows are directed to the biofiltration
chamber while the excess flows are diverted over the bypass weir without entering the biofiltration chamber. Both
the treatment and bypass flows are combined in the outlet area prior to discharge from the structure. BioPod
units without an internal bypass are designed such that only treatment flows enter the treatment structure. When
the system has exceeded its treatment capacity, ponding will force bypass flows to continue down the gutter to
the nearest standard catch basin or other external bypass structure.
The BioPod system can be configured as a tree box filter with tree and grated inlet, as a planter box filter with
shrubs, grasses and an open top, or as an underground filter with access risers, doors and a subsurface inlet
pipe. The optional internal bypass may be incorporated with any of these configurations. In addition, an open
bottom configuration may be used to promote infiltration and groundwater recharge. The configuration and size
of the Biopod system is designed to meet the requirements of a specific project.
Inspection & Maintenance Overview
State and local regulations require all stormwater management systems to be inspected on a regular basis and
maintained as necessary to ensure performance and protect downstream receiving waters. Without maintenance,
excessive pollutant buildup can limit system performance by reducing the operating capacity of the system and
increasing the potential for scouring of pollutants during periods of high flow.
Some configurations of the BioPod may require periodic irrigation to establish and maintain vegetation. Vegetation
will typically become established about two years after planting. Irrigation requirements are ultimately dependent
on climate, rainfall and the type of vegetation selected.

Maintenance
Frequency
Periodic inspection is essential for consistent system performance and is easily completed. Inspection is
typically conducted a minimum of twice per year, but since poltutant transport arid deposition varies from site to
site, a site-specific maintenance frequency should be established during the first two or three years of operation.
Inspection Equipment

Inspection Procedures
BioPod inspections are visual and are conducted without entering the unit. To complete an inspection, safety
measures including traffic control should be deployed before the access covers or tree grates are removed. Once
the covers have been removed, the following items should be checked and recorded (see form provided on page 6)
to determine whether maintenance is required:
' If the BioPod unit is equipped with an internal bypass, inspect the contoured inlet rack and outlet chamber
and note whether there are any broken or missing parts. In the unlikely event that internal parts are broken
or missing, contact Oldcastle Stormwater at (800) 579-8819 to determine appropriate corrective action.
^ Note whether the curb inlet, inlet pipe, or — if the unit is equipped with an internal bypass — the inlet rack is
blocked or obstructed,
• If the unit is equipped with an internal bypassobserve, quantify and record the accumulation oftrash
and debris \nthe inlet rack. The nignifioonceofaccumulated trash and debris ioomatter ufjudgment.
Often, much of the trash and debris may be removed manually at the time of inspection if a separate
maintenance visit is not yet warranted.
• If it has not rained within the past 24 hours, note whether standing water is observed in the biofiltration
chamber.
• Finally, observe, quantify and record presence of invasive vegetation and the amount of trash and debris
and sediment load in the biofiltration chamber. Erosion of the mulch and biofiltration media bed should
also be recorded. Sediment load may be rated light, medium or heavy depending on the conditions.
Loading characteristics may be determined as foliows:
o Light sediment load — sediment is difficult to distinguish among the mulch fibers at the top of the
mulch layer; the mulch appears almost new.
o Medium sediment load — sediment accumulation is apparent and may be concentrated in some areas;
probing the mulch layer reveals lighter sediment loads under the top 1" of mulch.
o Heavy sediment load — sediment is readily apparent across the entire top of the mulch Iayer; individual
mulch fibers are difficult to distinguish; probing the mulch layer reveals heavy sediment load under the
top l^ofmulch.

Maintenance should be scheduled if any of the following conditions are identified during inspection:
• The concrete structure is damaged or the tree grate or access cover is damaged or missing.
• The curb inlet or inlet rack is obstructed.
• Standing water is observed in the biofiltration chamber more than 24 hours after a rainfall event (use
discretion if the BioPod is located downstream of a storage system that attenuates flow).
• Trash and debris in the inlet rack cannot be easily removed at the time of inspection.
• Trash and debris, invasive vegetation or sediment load in the biofiltration chamber is heavy or excessive
erosion has occurred.
Maintenance Equipment

Maintenance Procedures
Maintenance should be conducted during dry weather when no flows are entering the system, All maintenance
may be conducted without entering the BioPod structure. Once safety measures such as traffic control are
deployed, the access covers may be removed and the following activities may be conducted to complete
maintenance:
~ Remove all trash and debris from the curb inlet and inlet rack manually or by using a vacuum truck as
required.
- Remove all trash and debris and invasive vegetation from the biofiltration chamber manually or by using a
vacuum truck as required,
• If the sediment load is medium or light but erosion of the biofiltration media bed is evident, redistribute
the mulch with a rake or replace missing mulch as appropriate. If erosion persists, rocks may be placed in
the eroded area to heldissipate energy and prevent recurring erosion.
If the sediment load is heavy, remove the mulch layer using a hoe, rake, shovel and bucket, or by using a
vacuum truck as required. If the sediment load is particularly heavy, inspect the surface of the biofiltration
media once the mulch has been removed. If the media appears clogged with sediment, remove and
replace one or two inches of biofiltration media prior to replacing the mulch layer.
• Prune vegetation as appropriate and replace damaged or dead plants as required.
~ Replace the tree grate and/or access covers and sweep the area around the BioPod to leave the site clean.

Natural, shredded hardwood mulch should be used in the BioPod. Timely replacement of the mulch layer
according to the maintenance indicators described above should protect the biofiltration media below the
mulch layer from clogging due to sediment accumulation. However, whenever the mulch is replaced, the
BioPod should be visited 24 hours after the next major storm event to ensure that there is no standing water
in the biofiltration chamber. Standing water indicates that the biofiltration media below the mulch layer is
