BARTELL DRUGS 14227 TUKWILA INTL BLVD PL14-0006 L14-0013 SIGN CODE VARIANCE City of Tukwila Jim Haggerton, Mayor Department of Community Development Jack Pace, Director December 2, 2014 NOTICE OF DECISION TO: Bartell Drugs, Applicant SEG 56th LLC, Owner/Applicant King County Assessor, Accounting Division This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170 on the following project and permit approval. I. PROJECT INFORMATION Project File Number: L14-0013 Applicant: Bartell Drugs and SEG 56th LLC Type of Permit Applied for: Sign Permit Variance Project Description: Variance request to exceed the maximum height and area permitted for a freestanding sign, and to reduce the required setback. Location: 14227 Tukwila International Blvd Associated Files: None Comprehensive Plan Designation/Zoning District: Neighborhood Commercial Center (NCC) II. DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Hearing Examiner has determined that the application to exceed the maximum height and reduce the minimum setback does comply with applicable City and state code requirements and has approved the application, subject to the following conditions: 1. Prior to issuance of a sign permit, the applicant shall remove the existing freestanding sign on the subject property. The applicant shall obtain a separate sign permit for the sign's installation. As part of the sign permit application, the applicant shall provide scaled plans that show the proposed location of the freestanding sign and the location of utilities within ten feet of the sign's location. 3. As part of the sign permit application, the sign shall have a sign and message area that meets the standards of TMC Title 19. 4. Prior to installation of the sign, the applicant or contractor shall call 811 a minimum of 48 hours in advance for utility locates. 5. Due to the presence of the above ground utility vault the applicant shall obtain permission from Seattle City Light for the placement of the sign. This variance application by the City of Tukwila offers no assurances or guarantees that Seattle City Light will approve the sign placement. 6. If the sign needs to be relocated in order to accommodate utilities in the area, the Director of Community Development or designee shall have the authority to approve the relocation that is within ten feet of the location approved with this variance application. A variance greater than ten feet will require review by the Hearing Examiner. 7. If the applicant intends on closing the adjacent sidewalk and/or working in the right of way, a separate public works permit from the City shall be required. 8. This variance shall be valid until September 1, 2024. Until September 1, 2024, the sign may have refaces and copy changes, provided permits are issued by the City as required by TMC 19.12.020. At no time shall the sign be relocated, re -erected, enlarged, or structurally altered in any way, without first obtaining a new variance. In no way is the City obligated to issue a variance in the future. After September 1, 2024, the sign is permitted to remain AS -IS indefinitely. However, relocation, re -erection, alteration, replacement or change in any way to the sign, including the structure or sign panel/face/copy, will require the sign to be brought into full compliance with the City's sign code. In no way does this condition preclude the property owner from requesting a new variance after September 1, 2024. 9. As specified by TMC 19.36.040 (C)(2), the freestanding sign shall be removed in the event of any activity that occurs on the site which triggers design review. In no way does this condition preclude the property owner from requesting a new variance as part of a redevelopment application. 10. The City shall record the Notice of Decision with the King County Records Office. The applicant shall reimburse the City for all incurred recording fees assessed by King County. Reimbursement of the recording fees shall be provided to the City prior to issuance of the required sign permit. 11. If the freestanding sign approved by this application is not installed within one year of issuance of the City's Notice of Decision the variance application shall expire. 12. At no time shall trees or vegetation, either on public right of way or private property, be removed or pruned to accommodate the proposed freestanding sign. 13. The Hearing Examiner has denied the applicants' request to exceed the maximum sign area permitted by TMC 19.20.040 Table 1. III. YOUR APPEAL RIGHTS The Decision on this Application is a Type 3 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of the Decision is permitted. A party who is not satisfied with the Hearing Examiner's decision may file an appeal in King County Superior Court. IV. PROCEDURES AND TIME FOR APPEALING Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Brandon Miles, who may be contacted at 206-431-3684 for further information. The Department has reviewed the application and recommends approval of a variance from the height limit and setback requirements, but not from the maximum permitted message area (which would be 50 square feet per side based on the street frontage length). 10. The sixth criterion is whether the variance would be inconsistent with other adopted City plans or policies. The City's Comprehensive Plan and the 2010 amendments to the Sign Code call for transitioning the zone and area to a more pedestrian -oriented environment, and for removal of auto -oriented signage, such as the proposed freestanding sign. However, the existing environment at this location is in transition, and the variance as conditioned would allow for a reasonable transition period consistent with City plans and policies for phasing out tall signs in the NCC zone. 8. The last criterion is whether the variance would result in greater convenience to the public in identifying the business location for which the variance is sought. The variance from height, setback and sign message area would all assist the public in identifying the business location. 9. As conditioned, the proposed variance from height and setback requirement would meet all of the variance criteria, and should be granted. The request for a variance from the message area would not meet all of the criteria, and is denied. Decision The requested variance for height and setback standards is hereby granted with the following conditions: 1. Prior to issuance of a sign permit, the applicant shall remove the existing freestanding sign on the subject property. 2. The applicant shall obtain a separate sign permit for the sign's installation. As part of the sign permit application, the applicant shall provide scaled plans that show the proposed location of the freestanding sign and the location of utilities within ten feet of the sign's location. 3. As part of the sign permit application, the sign shall have a sign and message area that meets the standards of TMC Title 19. 4. The freestanding sign is approximately 30 feet tall and has an area of 151,428 square feet. The sign was installed prior to the site's annexation by the City. 3. In December of 2012, the sign was damaged by an automobile. The City, the property owner, and the applicant, Bartell Drug, entered into a Voluntary Correction Agreement (VCA) concerning the sign. Granting of the variance shall result in greater convenience to the public in identifying the business location for which a Sign Code variance is sought. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 19.28.010. All of the criteria set forth in TMC 19.28.030 must be met in order to grant a variance. 2. The first criterion is that the variance as approved will not constitute a grant of special privilege inconsistent with the intent of the Sign Code. The proposed sign height would allow the sign to be viewed above the right-of-way landscaping, consistent with the privilege enjoyed by other properties. The requested variance from the five-foot minimum setback is also justified because reasonable placement of the sign is limited by the presence of existing landscaping and the utility cabinet. A message area of 70 square feet was not shown to be justified by the facts. 3. The second criterion is whether, because of special circumstances related to certain property characteristics or its surroundings, a variance is necessary in order to provide the property with the same rights and privileges permitted to other properties in the zone and vicinity. The existing landscaping and utility box, and the angle of TIB, are special circumstances affecting the location of the sign and its visibility so as to justify the variances from height and setback requirements, although the requested sign message area of 70 square feet is not justified by the special circumstances in this case. 4. The next consideration is whether granting the variance would be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and the zone. The variances as to height, setback and message area would not be materially detrimental to public welfare or injurious to property or improvements in the area or vicinity. 5. The fourth criterion is whether the special conditions and circumstances prompting the variance request were the result of the applicant's actions. The landscaping and the utility cabinet are special conditions which were not the result of the applicant's actions. 6. The next consideration is whether the requested variance would represent the least amount of deviation from the Code that is needed to accomplish the purpose for which the variance is sought. The requested variance for height and setbacks were shown to be the least amount of deviation from the Code necessary, but the requested 70 square feet of message area has not been shown to represent the least amount of deviation necessary. Hearing Examiner Decision L14-0013 SEG 56`h LLC Sign Variance Page 5 of 7 7. The sixth criterion is whether the variance would be inconsistent with other adopted City plans or policies. The City's Comprehensive Plan and the 2010 amendments to the Sign Code call for transitioning the zone and area to a more pedestrian -oriented environment, and for removal of auto -oriented signage, such as the proposed freestanding sign. However, the existing environment at this location is in transition, and the variance as conditioned would allow for a reasonable transition period consistent with City plans and policies for phasing out tall signs in the NCC zone. 8. The last criterion is whether the variance would result in greater convenience to the public in identifying the business location for which the variance is sought. The variance from height, setback and sign message area would all assist the public in identifying the business location. 9. As conditioned, the proposed variance from height and setback requirement would meet all of the variance criteria, and should be granted. The request for a variance from the message area would not meet all of the criteria, and is denied. Decision The requested variance for height and setback standards is hereby granted with the following conditions: 1. Prior to issuance of a sign permit, the applicant shall remove the existing freestanding sign on the subject property. 2. The applicant shall obtain a separate sign permit for the sign's installation. As part of the sign permit application, the applicant shall provide scaled plans that show the proposed location of the freestanding sign and the location of utilities within ten feet of the sign's location. 3. As part of the sign permit application, the sign shall have a sign and message area that meets the standards of TMC Title 19. 4. Prior to installation of the sign, the applicant or contractor shall call 811 a minimum of 48 hours in advance for utility locates. 5. Due to presence of the above ground utility vault the applicant shall obtain permission from Seattle City Light for the placement of sign. This variance application by the City of Tukwila offers no assurances or guarantees that Seattle City Light will approve the sign placement. 6. If the sign needs to be relocated in order to accommodate utilities in the area, the Director of Community Development or designee shall have the authority to approve a relocation that is within ten feet of the location Hearing Examiner Decision L14-0013 SEG 566 LLC Sign Variance Page 6 of 7 approved with this variance application. A variance greater than ten feet will require review by the Hearing Examiner. 7. If the applicant intends on closing the adjacent sidewalk and/or working in the right of way, a separate public works permit from the City shall be required. 8. This variance shall be valid until September 1, 2022. Until September 1, 2022, the sign may have refaces and copy changes, provided permits are issued by the City as required by TMC 19.12.020. At no time shall the sign be relocated, re -erected, enlarged, or structurally altered in any way, without first obtaining a new variance. In no way is the City obligated to issue a variance in the future. After September 1, 2022, the sign is permitted to remain AS -IS indefinitely. However, relocation, re -erection, alteration, replacement or change in any way to the sign, including the structure or sign panel/face/copy, will require the sign to be brought into full compliance with the City's sign code. In no way does this condition preclude the property owner from requesting a new variance after September 1, 2022. 9. As specified by TMC 19.36.040 (C)(2), the freestanding sign shall be removed in the event of any activity that occurs on the site which triggers design review. In no way does this condition preclude the property owner from requesting a new variance as part of a redevelopment application. 10. The City shall record the Notice of Decision with the King County Records Office. The applicant shall reimburse the City for all incurred recording fees assessed by King County. Reimbursement of the recording fees shall be provided to the City prior to issuance of the required sign permit. 11. If the freestanding sign approved by this application is not installed within one year- of issuance of the City's Notice of Decision the variance application shall expire. 12. At no time shall trees or vegetation, either on public right of way or private property, be removed or pruned to accommodate the proposed freestanding sign. 13. In no way does this variance application grant permission for any portion of the sign, including its underground foundation, to extend into the City's right of way. The Building Division of the Department of Community Development may require structural review for the proposed sign. 2. The applicant is requesting a variance from the City's prescriptive sign requirements due to site constraints, the presence of a high voltage utility cabinet and street trees. Figure 1: Aerial Photo of Subject Property The property is located on the NW corner of the busy intersection of South 144`h Street and Tukwila International Blvd (TIB) and is zoned Neighborhood Commercial Center (NCC) (See Figure 1). The property is a commercial complex that includes a Bartell Drugs and smaller retailers. The property is part of an auto oriented strip retail development pattern that includes a fast food restaurant (Jack in the Box) and standalone drug store (Walgreens). According to King County records, the building where Bartell Drugs is located was constructed in 1978, long before the City annexed the area in the early 1990s. Following annexation, the City embarked on a mission to transform the area from an auto -oriented urban environment to one that is more pedestrian friendly; hence, the NCC zone. The City's Comprehensive Plan, states the following about the NCC zone: "Generally focused around key intersections in transportation corridors (they) can help provide the sense of a "people place" that the neighborhoods bordering the corridors need. A Neighborhood Commercial Center not only helps mitigate the corridors' transportation impacts on residential H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 2 areas, it can also provide a commercial focus for the businesses bordering the corridor'". The City's Comprehensive Plan also states that development in the NCC zones is to be compact and pedestrian friendly2. The City, through a mix of public and private investment, is currently working to make the vision outlined in the Comprehensive Plan a reality. The City constructed road improvements which added sidewalks and other pedestrian amenities; and, is currently working to complete the Tukwila Village project which will include a library, senior housing, non -senior housing, and small commercial shops. The Tukwila Village project is a private -public partnership which will create the first mixed use development along TIB. Figure 2, Google Image of Property from Tukwila International Blvd, existing freestanding sign is shown in the background. Existing signage on the property includes one non -conforming freestanding sign and various wall signs. TMC 19.20.040 specifies the allowable freestanding signs for premises3 within the City. Using King County Parcel Viewer 2.0 it was estimated that the premise has 559 feet of linear frontage on three public streets (Tukwila International Blvd, S. 144th Street and 37`h Ave S). Based on this frontage length the property is permitted to have one freestanding sign that meets the following standards: • Only one freestanding sign; • 50 square feet of message area per side/100 square feet for all sides; • 70 square feet of sign area per side/140 square feet for all sides; • Maximum height seven feet; and • Setback at least five feet from all property lines. The applicant has requested a sign that is 15 feet tall; has a total message area of approximately 70 square feet per side; and would have no setback from Tukwila International Blvd (See attachment C ). The freestanding sign will have four message areas, one area would state `Bartell Drugs", a small manual changeable reader board, and there will be two small tenant panels. 1p. 100 21d. 3 Premises means one or more contagious lots of record not separated by right of way and owned or managed by the same individual or entity (TMC 19.08.220). H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 3 The existing freestanding sign on the property, which was installed prior to annexation by the City, is approximately 30 feet tall, with an approximate area of 151.428 square feet; and a minimum setback from adjacent property lines. The existing freestanding sign on the property at one time was legally non -conforming. Around December of 2012 the freestanding sign was damaged by an automobile. The construction necessary to fix the existing sign is not permitted under the City's non -conforming regulations. In March of 2014 the City, Bartell Drug and the property owner entered into a Voluntary Correction Agreement (VCA) regarding the status of the existing sign on the property (See Attachment D). Under the VCA the existing freestanding sign must be removed once the variance process is concluded. The VCA does not provide any assurance or guarantees to Bartell or the property owner regarding the outcome of the variance application. The questions before the Hearing Examiner: Should the freestanding sign be permitted to exceed the maximum height standard; be permitted to encroach into the required setback; and have a larger area than what is specified by TMC Title 19? FINDINGS Staff's evaluation of the proposed project against the Variance criteria detailed in TMC 19.28.030, (1-7) is listed below. The applicant's response to the variance criteria is attached to this staff report as Attachment A. 1. The variance as approved shall not constitute a grant of special privilege which is inconsistent with the intent of this sign code. TMC 19.04.020 states the intent of Title 19 "Sign and Visual Communication Code": The purpose of this code is to enhance the City's aesthetic character; to protect the public health, safety and welfare; and to increase the effectiveness of visual communication in the City by providing opportunities for Tukwila businesses, residents and property owners to display signage. The regulations for signs have the following specific objectives: 1. To have signs that attract and invite rather than demand the public's attention along the City's streetscapes. 2. To have streets that appear orderly and safe, because clutter is minimized. 3. To have signs that enhance the visual environment of the City, because they are in harmony with building architecture and landscape design. 4. To allow business identification that is not unduly hindered by regulatory standards. 5. To ensure typical communication and civic discussion is fostered in the City's residential neighborhoods. 6. To allow signs that utilize high quality construction materials, fine architectural detailing, harmonious proportionality, and that serve a multi -modal environment. Under Title 19 of the TMC, the applicant's site qualifies for freestanding signage based on the total H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 4 amount of linear frontage along private and public streets. In this case, the subject property is permitted to have one freestanding sign, with a maximum message area of 50 square feet per face and maximum height of seven feet (TMC 19.20.040). The applicant desires to install this sign along Tukwila International Blvd, the busiest and most visible of the three streets that the property faces. All other property owners with frontage along Tukwila International Blvd have oriented their signs to that street. Placement of a freestanding sign along Tukwila International Blvd is limited because of the presence of right of way landscaping and a six foot tall utility cabinet (See Figures below). Figure 3, Existing Sign with utility vault and street trees in front. In the applicant's response to the variance criteria (Attachment A) reference is made to other variance applications that were approved in the area. First, the applicant incorrectly states that a variance was issued to the Walgreen's located adjacent to applicant's property. The Walgreen's did not obtain a variance. The freestanding sign was installed under the City's old sign code that permitted taller signs. The sign is currently non -conforming and is subject to the City's ten year grace period (SN11-084). The Chevron at the southwest corner of S. 144th Street and Tukwila International Blvd was granted a variance because a small retaining wall located along the street edge would block the view of a lower sign. While there are similarities between the applicant's request and the approved Chevron variance application, issuance of a variance does not set precedence for approval of other variance requests. As shown in Figure 4, Tukwila International Boulevard is not perpendicular to S. 144th Street, but instead angles towards the northeast. This issue, along with the applicant's landscaping and City street trees, hinders visibility of signage for southbound drivers on Tukwila International Boulevard. In most circumstances a property, such as the applicant's, could install a conforming monument sign on the property to provide visibility. However, the combination of the utility cabinet, private landscaping, and street angle argue for the need for flexibility from the City's prescriptive standards. H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 6 Figure 5: Proposed Location for new Freestanding Sign With regards to height, the variance would allow the applicant to raise the message portion of a sign above the right of way landscaping and six foot utility cabinet. The sign will be tall enough to accommodate future growth of the trees. On sign setback, the variance would assists in addressing the issue of the roads design and landscaping that hinders visibility of southbound drivers along Tukwila International Boulevard. In staff's opinion, the applicant has not fully addressed the need to increase the allowable sign message area. In the applicant's response to the variance criteria the applicant points out that the City approved a variance for the Chevron Gas Station located adjacent to the property. As part of the Chevron variance request the applicant had requested a sign that would also exceed the maximum sign area. Again, while previously approved variance applications are not precedent setting, in the Chevron variance application the Hearing Examiner approved the applicant's height request, but conditioned that the freestanding sign could not exceed the maximum sign area permitted by the City's sign code. Staff does have some concerns that in the long term, if approved, the applicant's variance request would be providing a granting of a special privileged not enjoyed by other property owners in the area. TMC 19.36 provides very strict limitations on completing certain work to nonconforming signs. As was noted, the existing freestanding sign was nonconforming. The sign was in fact nonconforming under the City's old sign code, which was superseded by the current sign code in August of 2010. Many of the signs in the area of the applicant's property are also nonconforming and will need to be removed. The applicant's proposed sign is not pedestrian friendly. The NCC zone strives to be a pedestrian friendly area; however, the area is still auto dominated and is currently in transition. The applicant's variance would allow a sign to remain that does not meet the overall intent of the sign code or the vision of the area. Staff has provided a recommended condition that would eventually require that the proposed sign be removed. H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 7 Furthermore, redevelopment of the site could also provide options to provide signage that meets code. Under TMC 19.36.040 (C)(2) if a project trigger design review, all nonconforming signs on the premise must be brought into conformance. Staff recommends that a condition be added to address this situation. 2. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. The landscaping in the City's right of way and the utility cabinet were installed as part of the City's Tukwila International Blvd construction project in 2003/04. Prior to the City's project occurring, the area did not have sidewalks or landscaping. At the time the project did not impact signage on the subject property because the sign code permitted freestanding signs to be 35 feet, provided the sign was no taller than any of the buildings on site. In August of 2010 the City adopted a new sign code. While the City's sign code is generous with signage, the City did move to a monument only requirement for all freestanding signs. Additionally, under the new sign code, the City created grace periods for legally constructed signs that were made non- conforming with the sign code changes. A sign that is covered under a grace period is permitted to have refaces and copy changes until a specific date. After that specific date the sign must be brought into compliance when there is a reface, copy change or alteration. The existing freestanding sign on the subject property was non -conforming to the previous sign code and therefore does not qualify to be considered under a grace period and cannot be repaired, refaced or have a copy change. Locations for placement of a sign along Tukwila International Blvd are limited. There are only two landscaped islands along this street. The larger landscaped island to the north contains shrubs and mature trees and the sidewalk in front contains street trees. Placing a sign at this location would have limited visibility and removing any of these trees is not permitted under the landscaping regulations. Figure 6: North landscaped island on property. The other landscaping island (see Figure 6)—where the applicant is proposing to install the proposed freestanding sign—also has landscaping, but there is a gap next to the utility box. In most cases it would logical to place a monument sign at this location, but the utility cabinet makes it difficult to view the sign. To overcome this issue, the applicant is proposing to install a sign that exceeds the maximum height of H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC R seven feet and encroaches into the required setback (minimum five feet). Other portions of the property that front along Tukwila International Blvd are access drives and thus not suitable areas for the placement of a freestanding sign. The utility cabinet, street trees, and design of the road provide justification for approving the variances regarding height and setback; however, there appears be no need to permit a larger sign area. Figure 7: Landscaped area where sign is proposed to be located. In the applicant's response to the variance criteria (Attachment A) references that the building mounted sign for Bartell Drugs is blocked by the Jack in the Box located at the street corner. This is not the only reason why the sign is not visible. The building itself is located a considerable distance from both S. 144th Street and Tukwila International Blvd. If the building was located closer to the streets the building mounted signs would have better visibility. For example, the Walgreens was constructed near S. 144th Street and has excellent visibility. Figure 8: Walgreens with good visibility. 3. Granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is located. The applicant is proposing to replace an existing sign with a new, shorter freestanding sign. The new freestanding sign is proposed near the location of the existing freestanding sign. As was discussed above, in 2003/04 the City completed infrastructure improvements along Tukwila International Blvd. Part of H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 9 those improvements involved undergrounding existing overhead utilities. There appears to be an underground utility vault located near the freestanding sign. This variance application cannot grant modifications to safety setbacks from utilities. The variance application is only regarding height standards, setback standards, and area requirements found in Title 19 of the TMC. In order to ensure that there are no impacts to underground utilities the applicant will need to coordinate with the City's Public Works Department, Seattle City Light and other utilities at the time of construction. Conditions are proposed by staff to address this situation. The placement of the sign will not hinder visibility for automobiles leaving the commercial center. An access drive to the commercial center is located north of the proposed location for the sign. This access point provides right in/right out access only, left turns are not permitted. The sign's location to the south will not hinder drivers who need to look north to exit from the center. 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. The applicant is proposing to install a freestanding sign along Tukwila International Blvd that will exceed the height, setback and area requirements of the City's Sign Code (Title 19). This is being proposed because of the presence of landscaping in the City's right of way and the placement of a utility cabinet within a landscaped island on the property. This sign would serve as the only freestanding sign on the premise and the existing sign would be removed. Areas to place a freestanding sign on the property appear to be limited. There are no landscaping islands along S. 144`h Street and there are only two islands along Tukwila International Blvd. The north landscaping island along Tukwila International Blvd has mature landscaping and a sign at this location would likely require removal of some trees which other parts of the Zoning Code do not allow. Installing landscaping islands on the property in order to place a freestanding sign would likely impact automobile movement on the site. 5. The variance as granted represents the least amount of deviation from prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. There are several factors to consider when reviewing this variance criterion: Sign Design The applicant is proposing a monument style sign (See Attachment B). As shown, the sign will be 15 feet tall and have a total sign area of approximately 70 square feet. The maximum permitted message area for a property of this size is only 50 square feet per side of a freestanding sign. The sign will not meet setbacks (See Attachment C). The applicant has claimed that need for the variance is due to the placement of utility vaults and landscaping within the City's right of way (See Attachment A). The design of the property itself also hinders signage. For example, the building has been placed a significant distance from the adjacent streets. This makes it difficult to view building mounted signs. This issue could be resolved as part of a future redevelopment of the property. The traffic flow on the property also limits placement of a H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 10 c o freestanding sign. Again, this could be addressed as part of a future redevelopment of the property. As discussed earlier in this staff report, there appears to be justification to granting the variances for height and setback; however, staff does not see a justification for approving the variance request for area. A variance must be the minimal necessary to overcome a hardship. Granting a variance for area does not seem necessary to overcome a hardship. Total Number of Allowed Freestanding Signs TMC 19.20.040 only permits the subject property to have one freestanding sign. The site currently only has one freestanding sign and the applicant is proposing to replace the sign. If the variance is approved, and if the sign is approved, no additional freestanding signs would be permitted on the property. Removal of Non -Conforming Signs TMC 19.36.020 establishes a ten year grace period for freestanding signs that complied with the City's previous sign code, but were made non -conforming with the adoption of the new code. The ten year grace period expires in August of 2020. If the variance request is granted, as proposed, it would allow the applicant to maintain a taller sign than what is permitted for other properties along TIB well past August of 2020. This would allow the property owner to have a special privilege denied to other property owners who are required to remove non -conforming signs. 5. The variance request is not inconsistent with any other adopted City plans or policies, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. As stated, the City's Comprehensive Plan envisions that the NCC will transition into a pedestrian friendly environment. This goal is reflected throughout the City's planning documents including the City's sign code. In 1998, the City enacted a revitalization plan for TIB. As part of this revitalization plan, the City set a goal to remove non -conforming signs throughout the Boulevard. The applicant's proposed sign is not necessarily consistent with the City's long term efforts to revitalize TIB. Additionally, the City's non -conforming regulations make it very clear that the City desires to phase out tall signs within the City's commercial districts. 7. Granting of the variance shall result in greater convenience to the public in identifying the business location for which the Sign Code variance is sought. Placing the freestanding sign along a busy street, such as Tukwila International Boulevard, provide greater convenience to the public in identifying the subject property. The sign would be visible along both directions of the street. CONCLUSIONS 1. The applicant operates a business at the corner of S. 144th Street and Tukwila International Blvd, which is zoned NCC. Several years ago, as part of the Tukwila International Boulevard Improvements, a utility cabinet and landscaping trees were installed. The applicant has claimed that this cabinet and trees hinders the placement of a freestanding sign on the subject property. In response, the applicant has requested a variance to construct a sign that at 15 feet tall that is well H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 11 above the maximum height permitted for freestanding signs on the property. Additionally, the sign will not meet setbacks and will have a message area of about 70 square feet, a larger message area than provided by the code. 2. Pursuant to TMC 19.36.030, the existing freestanding sign shown in Figure 3 is not eligible to have a reface or copy change. 3. The proposed sign will be placed in an area near the location of various underground utilities. The applicant has not fully addressed how this placement will occur and what, if any, impacts could occur to the utilities located in the area. This variance application cannot grant permission to locate a sign in an easement area of the City or utility provider. 4. Placement of a freestanding sign on the property is restricted by limited location of landscaping islands along the perimeter of the property. 5. The City is striving to transform the NCC zone into a pedestrian oriented environment. A tall sign, such as what is proposed by the applicant, would not assist the City in achieving this goal. However, the transition effort does take time and this area of the City is still auto dominated. 6. In staff's opinion, granting of this variance to install a new freestanding sign, that does not meet height or setbacks, does not constitute a granting of special privilege in the short term. Staff does believe that the granting of the variance for height and setbacks would constitute a special privilege in the long run due to the fact that the property would not have to comply with the ten year grace period outlined in TMC 19.36.020 (C). If approved as presented, the applicant would be able to use the sign indefinitely. Additionally, as outlined in conclusion #5, the City is striving to transform the NCC zone into a pedestrian friendly environment and thus granting this variance would allow a tall sign to remain in a pedestrian friendly environment indefinitely. Staff has proposed a condition to address this concern. 7. In staff's opinion granting a variance to allow a sign that is larger in area than what is permitted by TMC Title 19 would constitute a granting of special privilege. When the Hearing Examiner approved the Variance for the Chevron station a condition was placed that the sign could not exceed the maximum sign area permitted by code. Staff believes that such a condition warranted with the request by Bartell Drugs. 8. The proposed sign will actually increase convenience to the public in identifying the business location. Placing the sign at the corner of the intersection will allow motorists to quickly identify the property and make decisions about where to turn. RECOMMENDATIONS Staff recommends approval of the variance for height and setback standards, with the following conditions: 1. Prior to issuance of a sign permit, the applicant shall remove the existing freestanding sign on the subject property. H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 12 2. The applicant shall obtain a separate sign permit for the sign's installation. As part of the sign permit application, the applicant shall provide scaled plans that show the proposed location of the freestanding sign and the location of utilities within ten feet of the sign's location. 3. As part of the sign permit application, the sign shall have a sign and message area that meets the standards of TMC Title 19. 4. Prior to installation of the sign, the applicant or contractor shall call 811 a minimum of 48 hours in advance for utility locates. 5. Due to presence of the above ground utility vault the applicant shall obtain permission from Seattle City Light for the placement of sign. This variance application by the City of Tukwila offers no assurances or guarantees that Seattle City Light will approve the sign placement. 6. If the sign needs to be relocated in order to accommodate utilities in the area, the Director of Community Development or designee shall have the authority to approve a relocation that is within ten feet of the location approved with this variance application. A variance greater than ten feet will require review by the Hearing Examiner. 7. If the applicant intends on closing the adjacent sidewalk and/or working in the right of way, a separate public works permit from the City shall be required. 8. This variance shall be valid until September 1, 2022. Until September 1, 2022, the sign may have refaces and copy changes, provided permits are issued by the City as required by TMC 19.12.020. At no time shall the sign be relocated, re -erected, enlarged, or structurally altered in any way, without first obtaining a new variance. In no way is the City obligated to issue a variance in the future. After September 1, 2022, the sign is permitted to remain AS -IS indefinitely. However, relocation, re -erection, alteration, replacement or change in any way to the sign, including the structure or sign panel/face/copy, will require the sign to be brought into full compliance with the City's sign code. In no way does this condition preclude the property owner from requesting a new variance after September 1, 2022. 9. As specified by TMC 19.36.040 (C)(2), the freestanding sign shall be removed in the event of any activity that occurs on the site which triggers design review. In no way does this condition preclude the property owner from requesting a new variance as part of a redevelopment application. 10. The City shall record the Notice of Decision with the King County Records Office. The applicant shall reimburse the City for all incurred recording fees assessed by King County. Reimbursement of the recording fees shall be provided to the City prior to issuance of the required sign permit. 11. If the freestanding sign approved by this application is not installed within one year of H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.DOC 13 issuance of the City's Notice of Decision the variance application shall expire. 12. At no time shall trees or vegetation, either on public right of way or private property, be removed or pruned to accommodate the proposed freestanding sign. 13. In no way does this variance application grant permission for any portion of the sign, including its underground foundation, to extend into the City's right of way. Notes 1. Sign and electrical permits are still required for the installation of the sign. The Building Division of the Department of Community Development may require structural review for the proposed sign. 2. If the variance is approved, in no way does it limit the City's Police Powers in enforcement the City's sign regulations for any signs that have been installed on the property without a valid permit. H:\PLANNING\BARTELL\VARIANCE APPLICATION\FINAL STAFF REPORT.I)OC 14 BART°ELL Washington's Own Drugstores* BEFORE THE HEARING OFFICER OF THE CITY OF TUKWILA Sign Code variance request under TMC 19.28.030 of Bartell Drugs (tenant) and SEG 56th LLC (property owner) regarding a proposed freestanding sign at 14277 Tukwila International Blvd. The proposed sign is to replace an existing freestanding sign that was legally non -conforming but was hit by a motorist and not allowed to be repaired under current TMC19.36.030. This sheet is to accompany page 5 "Review Criteria" of the sign variance application package of the City of Tukwila, and addresses seven criteria. 1. The variance does not constitute a grant of special privilege, and is consistent with the intent of the sign code. Similar variances have previously been issued by the City of Tukwila for the gas station's freestanding sign near the intersection directly across the street. Our reason for seeking a variance is very similar to that (Chevron's) situation. We also believe a variance was granted to the Walgreen's monument sign on the same block, so there is precedence for issuing variances to two adjacent businesses. This-- hardship his'hardship request involves height, size, and setback,- which we believe were accommodated between those neighboring variances. 2. This variance will provide comparable use rights and privileges that the City of Tukwila previously granted in the sign variance mentioned above for the Chevron signage on the south side of the common intersection. Our variance application is necessary due to the location, shape, and size of the adjacent electrical vault, which is 6' in height. Any conforming sign w/o a height variance (presumably 7' high), would have visibility restricted to a degree that would render it ineffective behind a 6' tall obstruction, and result in no benefit to the public, especially approached from the intersection to the South. Additionally, the city owned and maintained trees placed in the sidewalk to the North and South also severely restrict visibility of any conforming height sign from both directions. There is really only one logical spot to place the sign, to the south of the existing sign, closer to the vault and the intersection. Many limitations impact potential spots, such as location of underground utilities, the presence of the Jack in the Box building, drive-thru, and sign; and the placement of landscaping and city sidewalk trees near the current sign location. Also, the angle of the property line as it follows Tukwila International Blvd. in combination with the Jack in the Box elements mentioned eliminate the possibility of placing a non -variance height sign even closer to the intersection. A photograph from 2001 shows that virtually none of these obstructing elements were in place before the city introduced them in conjunction with Tukwila International Boulevard improvements. Allowing the height variance would also enable inclusion of two small tenant panels, with their visibility also benefitting the public. This height variance would allow each panel to barely clear the vault obstruction by a minimal amount. The overall sign panel square footage proposed is drastically reduced from the existing freestanding sign, and asks for a minimal variance to accomplish the correct proportion of the Bartell Drugs corporate logo. Therefore, a setback variance is also sought. This would allow the sign to physically fit between the property line and the edge of the planting strip, as the planting strip narrows in this area to a degree that impedes anything less. An additional hardship is that visibility of the Bartell Drugs storefront sign is obstructed to TIB traffic at the intersection of TIB and S144th and along TIB due to the Jack -In -the -Box building, the elements listed previously, and the fact that the building is set back quite a distance from both TIB and S144th. The structure of the sign has been designed to provide aesthetic benefit and aligns with the Bartell Drugs storefront design for a uniform appearance. 3. Granting of the variance will not be detrimental to the public welfare and safety. The structure of the signage will be professionally manufactured and installed by a well- respected commercial sign company that is licensed to do business in the City of Tukwila, as allowed by the City of Tukwila. It will be placed in the planting strip, surrounded by landscaping, away from pedestrian traffic. It would not interfere with vehicle sightlines or traffic safety. 4. The conditions and circumstances that prompt this variance request are beyond the control of the applicant and are not a result of actions of the applicant. The obstructing electrical vault and trees are not within our control. We refer again to the fact that these obstructions were placed long after the current sign was already in place. 5. The variance request is for height, size, and setback, while attempting to stay within code parameters in all other respects, and is intended to be otherwise within the intent of the code. Accompanying artwork shows the dramatic reduction in size from the current sign. 6. The variance request is not intended nor known to be inconsistent with any other adopted City plan or policy. 7. Granting the variance will enable both pedestrians and vehicular traffic to identify the business location. The Bartell Drugs store is greatly set back in the retail building, and would suffer greatly if effective freestanding signage were not available to passersby. Two reasons that this is especially important for Bartell Drugs is that it has a direct competitor basically within the same parking lot, and also due to the nature of the transient community with a steady influx of newcomers. PREAMBLE THIS AGREEMENT is made and entered into this 7 day of / --_ , 2014, by the City of Tukwila, a Washington municipal corporation (the "City" or "Tukwila"), SEG 56th Limited Liability Corporation, organized under the laws of the State of Washington (the "Property Owner"), and The Bartell Drug Company, organized under the laws of the State of Washington ("Bartell"). II. RECITALS WHEREAS, the Property Owner owns a commercial property ("the Property) near the intersection of S. 144th Street and Tukwila International Boulevard (King County Parcel #152304-9182); and WHEREAS, Bartell operates a retail store on the Property; and WHEREAS, located on the Property, fronting Tukwila International Boulevard, is a large freestanding sign, upon which is a sign face for Bartell and a small reader board ("the Sign"). A photo of the Sign is provided as Exhibit "A" to this agreement; and WHEREAS, the Sign was installed prior to the City of Tukwila annexation of Tukwila International Boulevard into the City; and WHEREAS, the City of Tukwila regulates the placement, installation, and display of signage in the City through Tukwila Municipal Code ("TMC") Title 19; and WHEREAS, the Sign was considered legally non -conforming, subject to the strict restrictions and limitations found in TMC Title 19; and WHEREAS, the Sign was damaged in December of 2012; WHEREAS, the Sign cannot be repaired in a manner that is permitted under Title 19; and WHEREAS, on February 25, 2013, the City issued a Notice and Order to the Property Owner and Bartell requiring that the Sign be removed; and WHEREAS, on March 13, 2013 an appeal of the Notice of Order was submitted to the City; and WHEREAS, the Hearing Examiner, on motion by the City, dismissed the appeal because it was not timely filed; and • WHEREAS, the Hearing Examiner's dismal was not appealed to a court of competent jurisdiction by either the Property Owner or Bartell; and WHEREAS, the City has the authority to issue citations to both the Property Owner and Bartell until the sign is removed. Furthermore, the City can also choose to obtain an order from a court of competent jurisdiction allowing the City to enter the property and remove the sign; and WHEREAS, Bartell has indicated that it wishes to pursue a variance application to install a freestanding sign on the subject property; and WHEREAS, the parties wish to resolve this matter in a manner that minimizes costs and impacts to the businesses and the taxpayers. NOW THEREFORE, in consideration of the mutual promises set forth herein, the Parties hereto agree as follows: Exhibit(s): A. Photo of Freestanding III. AGREEMENT Section 1. Description of the Property. The Property is King County Parcel #152304-9182, located along Tukwila International Boulevard, in the City of Tukwila, Washington. Section 2. Violation Acknowledgment by the Property Owner and Bartell. The Property Owner and Bartell both acknowledge that the Sign is in violation of TMC Title 19 and must be removed. Section 3. Variance Application Bartell shall submit a complete variance application no later than February 21, 2014. Failure to submit the variance application shall be considered "conclusion of the variance process" as outlined in Section 4 of the agreement. In the event that Bartell does not submit a variance application by February 21, 2014 the sign shall be removed no later than April 15, 2014. Section 4. Fines Bartell and the Property Owner agree that fines of $100 a day are accumulating for each day that the sign remains after August 1, 2013. The Sign must be removed within sixty (60) days after conclusion of the variance process. Conclusion of the variance process includes a final decision by the hearing examiner or cancellation of the application due to inactivity as prescribed in TMC 18.104. Fines shall increase following the sixty (60) day grace period to $500 per day until the • sign is removed. The City shall forgive all fines, associated with the Sign if the Sign is removed within 60 days after conclusion of the variance process or if the sign is removed by Apriri,'2014 Section 5. City Right of Access h P e ) 1 1 51 If the Sign is not removed pursuant to the timeframes outlined in section 4 of this agreement the City shall have the right to access the property and remove the sign. The property owner, through this agreement, expressly grants the City access to the property for the purposes of removing the Sign. Section 6. No Assurances on Variance Application Bartell and the Property Owner acknowledge that this agreement in no way provides any guarantees or assurances that the sign variance application will be approved by the City's Hearing Examiner, which operates as an independent hearing officer for the City. Furthermore, this agreement does not obligate or bind City staff to support the variance application. The variance application will be processed by the City in good faith, in the same manner as other applications. Section 7. Joint Responsibility Bartell and the property owner agree that the each party is solely and jointly responsible for compliance with this agreement. The City may choose, at its sole and absolute discretion, to seek enforcement of this agreement by one or both parties. Section 8. Indemnification Bartell and the Property Owner agree to defend and hold the City, its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, caused by or related to the Sign, except for injuries and damages caused by the sole negligence of the City. Section 9. Assignment of Interests, Rights, and Obligations. This Agreement shall be binding and inure to the benefit of the Parties. No Party may assign its rights under this Agreement without the written consent of the other Party, which consent shall not unreasonably be withheld. This Agreement shall be binding upon and shall inure to the benefit of the heirs, successors, and assigns of Bartell, the Property Owner and the City. Section 10. Incorporation of Recitals. The Preamble and Recitals contained in this Agreement are hereby incorporated into this Agreement as if fully set forth herein. Section 11. Specific Performance. The Parties specifically agree that damages are not an adequate remedy for breach of this Agreement, and that the parties are entitled to compel specific performance of all material terms of this Agreement by any party in default hereof. Section 12. Governing Law and Venue. This Agreement shall be construed and enforced in accordance with the laws of the State of Washington. Venue for any action shall lie in King County Superior Court or the United States District Court for Western Washington. Section 13. Attorney's Fees. In the event of any litigation or dispute resolution process between the Parties regarding an alleged breach of this Agreement, the prevailing party shall be entitled to any award of attorney's fees and costs, including those attributed to any appeals. Section 14. Entire Agreement and Amendments. This Agreement represents the entire agreement between the Parties with respect to the subject matter herein. This Agreement supersedes all other written and/or oral agreements between the Parties relating to the Sign or the Property. Any Party may request changes in the Agreement. Proposed changes which are mutually agreed upon shall be incorporated by written amendments to this Agreement. Section 15. Severability and Survival. The provisions of this Agreement are separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of this Agreement, or the validity of its application to other persons or circumstances. The provisions of this Agreement, which by their sense and context are reasonably intended to survive the completion, expiration or cancellation of this Agreement, shall survive termination of this Agreement. Section 16. No Third -Party Beneficiaries. This Agreement is for the benefit of the Parties hereto only and is not intended to benefit any other person or entity, and no person or entity not a signatory to this Agreement shall have any third -party beneficiary or other rights whatsoever under this Agreement. No other person or entity not a party to this Agreement may enforce the terms and provisions of this Agreement. } Section 17. Authority. The Parties each represent and warrant that they have full power and actual authority to enter into this Agreement and to carry out all actions required of them by this Agreement. All persons are executing this Agreement in their representative capacities and represent and warrant that they have full power and authority to bind their respective organizations. Section 18. Notices. Notices, demands, or correspondence to the City, Property Owner and Bartell shall be provided by pre -paid first-class mail to the addresses provided by the executing Parties below. Notice to the City shall be to the attention of both the Director of Community Development and the City Attorney. The )arties hereto, and any subsequent property owners or Bartell tenants, shall advise the other of new addresses for such notices, demands or correspondence. Notices from the City to subsequent property owners or any subsequent tenant of the Bartell store shall be given by the City only if the subsequent property owner or Bartell tenant have given the City written notice of their address for such notice. Section 19. Police Power. Nothing in this Agreement shall be construed to diminish, restrict or limit the police powers of the City granted by the Washington State Constitution or by general law. Section 20. No Presumption Against Drafter. This Agreement has been reviewed and revised by legal counsel for both Parties and no presumption or rule that ambiguity shall be construed against the party drafting the document shall apply to the interpretation or enforcement of this Agreement. Section 21. Headings. The headings in this Agreement are inserted for reference only and shall not be construed to expand, limit or otherwise modify the terms and conditions of this Agreement. Section 22. Legal Representation. CRITERIA FOR SIGN CODE VARIANCE (TMC 19.28.030) 1. The variance as approved shall not constitute a grant of special privilege, which is inconsistent with the intent of this Sign Code. 2.
