YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type II decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision, that is by July 11, 2014. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $541 plus retainer. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. MB Page 2 of 3 06/26/2014 Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. The project includes: • Installation of the following: o Wireless outdoor equipment mounted on steel platform within lease area/screen wall o 30 KW generator on concrete pad located on grade within fence enclosure o On rooftop of building: • (12) panel antennas • (12) RRH • (3) surge protectors • (1) GPS antenna o 200A electrical service and fiber service Existing Development The existing building is located within a commercial/industrial park. The building is located along the Green River Trail to the south of the Duwamish River. Surrounding Land Uses Adjacent to the parcel to the southeast are buildings zoned C/LI. To the southwest is Interurban Ave. and across this road lie parcels zoned RCM. To the northwest of the site are casinos zoned C/LI. Directly north of the building is the Duwamish Waterway with properties zoned LDR across the river. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. There was a conditional use permit approved for a wireless facility at this location in 2003 (L03-027) Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. As demonstrated in Tables 1 and 2, the project meets all applicable development standards for a Type 2 WCF. 2. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 3. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type II Wireless Telecommunication Facility permit as applied for by Cascadia PM for Verizon Wireless without conditions. INFORMATIONAL ITEMS The installation of a generator will require permits from the fire and building departments for above ground fuel tank installation and foundation permit. A City of Tukwila electrical permit is required for service alteration. Please note that the installation of an emergency power disconnect switch is required for fire department use. This noise study extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient sound levels of the site were measured on March 26, 2014 with a Larson - Davis 820 spectrum analyzer sound level meter. Measurements were conducted as close to the proposed location as possible. The average ambient noise level was 62 dBA primarily due to local traffic noise. The weather during the measurements was cloudy and the roads were damp. Code Requirements The site is located within the City of Tukwila Zoning jurisdiction on property designated with a CLI (Commercial/Light Industrial) zoning. All of the receiving properties are also zoned CLI. The proposed new equipment consists of equipment support cabinets and an emergency generator. The equipment support cabinets are expected to run 24 hours a day. The generator will run once a week during daytime hours for maintenance and testing purposes only. Under Tukwila Municipal Code 8.22.040 noise from equipment on a within a commercial district is limited as follows: Class B EDNA Receiver: Noise is limited to 60 dBA 24 hours a day.
