The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: (1) Preliminary Approval; (2) Final Approval; and (3) Recording. A description of each step in the short plat approval process is included below. 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. PRELIMINARY APPROVAL CONDITIONS 1. Add short plat file number L14-0028 to all sheets of the short plat survey. Verify legal descriptions and wording. See red -lined portion of sheet 1 of 2 for corrections — enclosed. 2. The Pedestrian Walkway Easement and Maintenance agreement (Recording #20140221000022) must be amended or replaced to include the new Lot 2 of short plat L14- 0028. Please consult with your attorney to develop the appropriate language/approach to accomplish this condition. 3. The Private Ingress/Egress and Utilities Easement and Maintenance Agreement (Recording #20140221000021) must be amended or replaced to include the new Lot 2 of short plat L14- 0028. This includes revising the note found on page 2 of short plat L12-034; revising the stand alone recorded easement; and, adding a note about the easement and agreement to L14- 002 Please consult with your attorney to develop the appropriate language/approach to accomplish this condition. 4. Include the subdivision notes found on sheet 2 of short plat L12-034 on this short plat. 5. Owner/Applicant to complete a Traffic Concurrency Certificate Application and pay a Transportation Concurrency Test Fee in the amount $300 as part of this Short Plat — L14-0028. (See enclosed.) 6. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: a. A survey map as described in the application checklist that is consistent with all of the conditions of approval. The surveyor's original signature must be on the face of the plat. b. Existing and proposed legal descriptions for the new lot. c. Separate easement document with legal descriptions for any common access/utility infrastructure. d. Redlined changes as indicated on Sheets 1, 2, and 3 of the short plat survey. APPEALS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS may raise such issues as part of the appeal. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (11/02/2012). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. 2. Final Approval The next step is to comply with the conditions of approval and submit the necessary short plat documents (survey, legal descriptions, and other required paper work). All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, you will be asked to obtain the signature of the owner, and land surveyor on the face of a clean copy of the Short Plat. The Chair of the Short Subdivision Committee will then sign your short plat which constitutes a grant of final approval. Expiration The final approved short plat must be filed with the King County Department of Records by June 3, 2015, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. Do not fold the short plat, but rather roll up the document to take to the Recorder' s office. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and a copy of the recorded documents is provided to the Department of Community Development. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. Please note for future reference : 1. The entire project site drains to this basin. The general topography of the site slopes from southeast to northwest. The KCRTS equivalent soils group, as defined in Table 3.2.2.6 of the 2009 King County Surface Water Manual (KCSWM), is Outwash. A particle size distribution soils analysis was performed by A.A.R., Testing Laboratory Inc. on Sept 24, 2012. The analysis confirms that the soils at the site are composed of 26% fine sand and 72% medium sand or larger; the Unified Soil Classification System (USCS) classification of the soils is SP, clean sands with less than 5% fines. The project adds more than 2,000 SF, but Tess than 5,000 SF of new impervious surface, therefore is subject to a small project drainage review based on the thresholds outlined in the 2009 KCSWM Section 1.1.2.1. The project is subject to Small Drainage Review because the project is a single family residential project that results in >_ 2,000 SF of new impervious surface... AND meets the following criteria... The project will result in no more than 10,000 square feet13 of total impervious surface added on or after January 8, 2001 and its new pervious surface area will be no more than 35,000 square feet minus 3.25 times the area of new impervious surface being proposed by the project (for sites larger than 22,000 square feet, a factor of 2.25 may be used instead of 3.25, and for sites zoned as RA, F, or A, the allowable amount of new pervious surface calculated herein may be increased by 50% or may be the remaining portion of site if 65% or more of the site is preserved in native vegetation by clearing limit, covenant, easement, or tract), OR Table 1 outlines how the project will result in no more than 10,000 SF of total impervious surface added on or after January 8, 2001. Orcas Homes -Technical Information Report April 2014 Core Requirements Core Requirement #1: Discharge at the Natural Location Stormwater runoff from the project presently infiltrates to native soils, with overflow conditions sheet flowing in a northerly direction towards South 160th Street. In the developed condition, stormwater will continue to infiltrate to native soils and discharge at its natural location. Core Requirement #2: Offsite Analysis Stormwater runoff from the entire project currently infiltrates to native soil, with overflow conditions sheet flowing in a in a northerly direction towards South 160th Street. Offsite analysis is not required for full infiltration sites. Core Requirement #3: Flow Control The property is located within the Level 2 Flow Control area per the King County stormwater map. However, soils are conducive to full infiltration; therefore, stormwater will be infiltrated. This project is exempt from flow control requirements per the Small Project threshold outline in section 1.1.2.1 of the KCSWM as discussed in the Design Requirement section of this report. Core Requirement #4: Conveyance System There is no conveyance system proposed for this project. Core Requirement #5: Erosion and Sediment Control The project will provide erosion and sediment controls (ESC) to prevent, to the maximum extent practicable, the transport of sediment from the project site. Refer to Section 8 of this report for a discussion of the ESC measures proposed. Core Requirement #6: Maintenance and Operations Maintenance and operations of all drainage facilities is the responsibility of the property owner. Maintenance and operation guidelines are provided in Section 10 of this report. Core Requirement #7: Financial Guarantees and Liability This project is exempt from this core requirement because the stormwater facilities are privately owned and maintained. Core Requirement #8: Water Quality This project is exempt from Water Quality requirements as defined by Core Requirement #8 based on the surface area exemption. Although the project will create 2,400 square feet of new impervious surface, only 400 square feet is pollution - generating impervious surface (PGIS). Special Requirement #1: Other Adopted Area -Specific Requirement Based on pre -application meeting notes, no other area -specific requirements are imposed on this property. The weather was overcast with temperatures in the mid 50's degrees Fahrenheit. The property is currently developed with one (1) single-family residence. The project proposes short plat the property into two (2) total parcels to construct one (1) additional single family structure along with an associated driveway and utilities. The property is accessed from South 160th Street. Stormwater runoff from the entire project currently infiltrates to native soil, with overflow conditions sheet flowing in a northerly direction towards South 160th Street. Overflow stormwater discharges to the drainage system located on South 160th Street, travels west along South 160th Street and then discharges into the drainage system along South 42nd Avenue, continuing along 42nd Avenue beyond a IA mile downstream. Task 4: Drainage System Description and Problem Descriptions Based on this field inspection and review of past drainage complaint records, there appears to be no significant erosion or capacity problems within a Ya mile downstream of the property. Task 5: Mitigation of Existing or Potential Problems Flows from the development will be mitigated with a full infiltration trench within the subject property. Stormwater overflow conditions will continue to sheet flow in a northerly direction towards South 160th Street. SECTION 4: FLOW CONTROL /WATER QUALITY ANALYSIS AND DESIGN Existing Hydrology The project site is 18,060 square feet. Surface area calculations for existing onsite conditions are based on the topographic survey performed for the project. Table 3 summarizes the existing condition areas. Performance Standards Level 2 Flow Control The City of Tukwila utilizes the 2009 King County Surface Water Manual (KCSWM) for its drainage requirements. However, this project is exempt from flow control requirements per the Small Project threshold outline in section 1.1.2.1 of the KCSWM as discussed in the Section 2 (Design Requirement) of this report. Per the 2009 KCSWM Section C.2.2.3, full infiltration trenches must be at least 30 feet in length per 1,000 square feet of new impervious roof surface based on a 2 feet wide bottom. An overflow outlet is proposed to sheet flow storm water during heavy rainfall events. Refer to the Table 5 below and attached infiltration trench details. PGIS is defined as "an impervious surface considered to be a significant source of pollutants in surface and storm water rune Such surfaces include those subject to vehicular use or storage of erodible or leachable materials, wastes, or chemicals, and which receive direct rainfall or the run-on or blow-in of rainfall." Non-metal rooftops are not considered PGIS; therefore, are not included in the PGIS area calculations. SECTION 5: CONVEYANCE SYSTEM There is no conveyance system proposed for this project. SECTION 7: OTHER PERMITS • Building Construction Permit • Short Plat Application SECTION 8: EROSION CONTROL ANALYSIS AND DESIGN All erosion and sediment control measures shall be governed by the requirements of the 2009 KCSWM. An Erosion and Sedimentation Control plan has been prepared to assist the contractor in complying with these requirements and designed to prevent sediment -laden run-off from leaving the site during construction. Refer to Appendix B for Erosion Control plans and details. The erosion potential of the site is influenced by four major factors: soil characteristics, vegetative cover, topography, and climate. Erosion/ sedimentation control is achieved by a combination of structural measures, cover measures, and construction practices that are tailored to fit the specific site. Construction Sequence and Procedure Prior to the start of any grading activity upon the site, all erosion control measures, including installation of a stabilized construction entrance, shall be installed in accordance with the construction documents. The best construction practice will be employed to properly clear and grade the site and to schedule construction activities. The planned construction sequence for the construction of the site is as follows: 1. Pre -construction meeting. 2. Post sign with name and phone number of ESC supervisor (may be consolidated with the required notice of construction sign). 3. Flag or fence clearing limits. 4. Install catch basin protection if required. 5. Grade and install construction entrance(s). 6. Install perimeter protection (silt fence, brush barrier, etc.). 7. Grade and stabilize construction roads. 8. Construct surface water controls (interceptor dikes, pipe slope drains, etc.) simultaneously with clearing and grading for project development. 9. Maintain erosion control measures in accordance with King County standards and manufacturer's recommendations. 10. Relocate erosion control measures or install new measures so that as site conditions change the erosion and sediment control is always in accordance with the King County Erosion and Sediment Control Standards. Cover all areas that will be unworked for more than seven days during the dry season or two days during the wet season with straw, wood fiber mulch, compost, plastic sheeting or equivalent. 12. Upon completion of the project, all disturbed areas must be stabilized and BMPs removed upon approval from City of Tukwila. Trapping Sediment Structural control measures will be used to reduce erosion and retain sediment on the construction site. The control measures will be selected to fit specific site and seasonal conditions. The following structural items will be used to control erosion and sedimentation processes: • Temporary gravel construction entrance • Filter fabric fences (Silt fences) • Ground cover measures such as straw cover and/or hydroseeding • Inlet protection Vehicle tracking of mud off-site shall be avoided. Installation of a gravel construction entrance will be installed at a location to enter the site. The entrances are a minimum requirement and may be supplemented if tracking of mud onto public streets becomes excessive. SECTION 10: OPERATIONS AND MAINTENANCE The owner or operator of the project shall be responsible for maintaining the stormwater facilities in accordance with the requirements as attached in Appendix C. Proper maintenance is important for adequate functioning of the stormwater facilities. If it is unclear whether a problem exists, contact a Professional Engineer. Dispersion trenches must be maintained as follows: • Trenches must be inspected annually and after major storm events to identify and repair any physical defects. Maintenance and operation of the system should focus on ensuring the system's viability by preventing sediment -laden flows from entering the device. Excessive sedimentation will result in a plugged or non-functioning facility. • If the dispersion trench has a catch basin, sediment accumulation must be removed on a yearly basis or more frequently if necessary. Prolonged ponding around or atop a device may indicate a plugged facility. • If the device becomes plugged, it must be replaced. • Keeping the areas that drain to the dispersion trenches well swept and clean will enhance the longevity of these devices. • For roofs, frequent cleaning of gutters will reduce sediment loads to these devices. Conditions of Use 1. Plastic covering may be used on disturbed areas that require cover measures for less than 30 days. 2. Plastic is particularly useful for protecting cut and fill slopes and stockpiles. Note: The relatively rapid breakdown of most polyethylene sheeting makes it unsuitable for long-term applications. 3. Clear plastic sheeting may be used over newly -seeded areas to create a greenhouse effect and encourage grass growth. Clear plastic should not be used for this purpose during the summer months because the resulting high temperatures can kill the grass. 4. Due to rapid runoff caused by plastic sheeting. this method shall not be used upslope of areas that might be adversely impacted by concentrated nrnoff. Such areas include steep and/or unstable slopes. Note: There have been many problems with plastic, usually attributable to poor installation and maintenance. However, the material itself can cause problems, even when correctly installed and maintained, because it generates high -velocity runoff and breaks down quickly dire to ultraviolet radiation. In addition, if the plastic is not completely removed, it can clog drainage system inlets and outlets. During the wet season. 50 linear feet of silt fence (and the necessary stakes) per acre of disturbed area must be stockpiled on site. Purpose: The purpose of perimeter protection is to reduce the amount of sediment transported beyond the disturbed areas of the construction site. Perimeter protection is primarily a backup means of sediment control. Most, if not all, sediment -laden water is to be treated in a sediment trap or pond. When to Install: Perimeter protection is to be installed prior to any upslope clearing and grading. Measures to Use: The above measures may be used interchangeably and are not the only perimeter protection measures available. If surface water is collected by an interceptor dike or swale and routed to a sediment pond or trap, there may be no need for the perimeter protection measures specified in this section. Criteria for Use as Primark' Treatment: At the boundary of a site. perimeter protection may be used as the sole form of treatment when the flowpath meets the criteria listed below. If these criteria are not met, perimeter protection shall only be used as a backup to a sediment trap or pond. The effectiveness of hog fuel is highly variable, but it has been used successfully on many sites. It generally requires more maintenance than quarry spalls. Hog fuel is not recommended for entrance stabilization in urban areas. The inspector may at any time require the use of quarry spalls if the hog fuel is not preventing sediment from being tracked onto pavement or if the hog fiiel is being carried onto pavement. Hog fuel is prohibited in permanent roadbeds because organics in the subgrade soils cause difficulties with compaction. 4. Fencing (see Section D.3.1) shall be installed as necessary to restrict traffic to the construction entrance. 5. Whenever possible, the entrance shall be constructed on a firm, compacted subgrade. This can substantially increase the effectiveness of the pad and reduce the need for maintenance. Maintenance Standards 1. Quarry spalls (or hog fiiel) shall be added if the pad is no longer in accordance with the specifications. 2. If the entrance is not preventing sediment from being tracked onto pavement, then alternative measures to keep the streets free of sediment shall be used. This may include street sweeping, an increase in the dimensions of the entrance, or the installation of a wheel wash. This will provide the City with an option so that a future sidewalk along this roadway can have the least impact on the neighbors to the west Under a typical development scenario, we understand that this project would be required to install Improvements along its street frontage (about 154' along 33r1 Avenue S. and about 127' along 34th Place 5.) which would include pavement widening, curb and gutter, catch basins, stormwater pipes, a sidewalk, street trees, street lights (where needed) and undergrounding of the existing power poles. Instead of constructing these very short sections of improvements In areas where there is little, to no possibility of additional development installing similar improvements, we would rather pay the City a fee in -lieu of installation to be paid in full prior to the issuance of any building permit This fee will be applied to any future sidewalk project in the area that would be more beneficial to the community. We understand that this approach is allowed under the Section 4.0.4(C.)(1) of the City's Infrastructure Design and Construction Standards. Our intent here is to provide a financial contribution to a much larger sidewalk installation project in the immediate area, which was annexed to the City in 1990.
