I. PROJECT INFORMATION Project File Number: L14-0036, Special Permission from the Director Applicant: Brian Deller Type of Permit Applied for: Parking Determination from the Director. Project Description: Virtual Sports is proposing to locate a laser tag facility at 17600 West Valley Highway in a multi -tenant building. Virtual Sports is requesting a parking determination from the Director to determine the minimum number of parking spaces required for the proposed use on the site. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 -days of the issuance of this Decision, that is by August 1, 2014. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Minnie Dhaliwal, who may be contacted at 206-431-3685 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. Virtual Sports is requesting a parking determination from the Director to determine the minimum number of parking spaces required for the proposed use on the site. EXISTING DEVELOPMENT The subject property is located on the east side of West Valley Highway. The subject site is 6.38 acres and the building is 110,049 square feet. The building was built in 1986 as a warehouse type of a building. There are 126 existing parking stalls and with the restriping plan there will be a total of 140 parking stalls. The proposal is to use 27,000 square feet of the existing building space for Virtual Sports, a laser tag facility. The playfields occupy roughly 14,000 sq. ft. with the rest dedicated to the lobby area, few arcade games, offices and kitchen/bar area. SURROUNDING LAND USES Zoning in the vicinity of the subject site is Commercial/Light Industrial, which allows a mix of commercial and light manufacturing type of uses. The property immediately to the north has a warehouse type of building that was built in 1978 and is 56,650 sq. feet on a 3.69 acre site. It is currently occupied by Tuff Sheds and has many sheds in the parking area. The property immediately to the south was also built in1978 and is 35,140 square feet building on an 8.69 acre site. It is currently occupied by an equipment rental type of a business. There is a public trail and railroad tracks immediately to the east of the property. West Valley Highway lies to the west and Green River lies beyond the Highway. A small portion of the subject site lies within 200 feet of the River. DECISION CRITERIA — PARKING DETERMINATION Off -Street Parking and Loading Regulations are found in Chapter 18.56 of the Tukwila Municipal Code (TMC). The chapter includes a table that lists the required number of parking spaces for automobiles and bicycles (Table 18-7). With the restriping proposal there are a total of 140 parking spaces available for all tenants at the subject site. There is no on -street parking allowed along West Valley Highway. Tukwila Off -Street Parking Requirements Based on the number of required parking spaces listed in Table 18-7: 1) One parking space is required per 1000 sq. ft. of manufacturing type of use. 2) One parking space is required per 2000 sq. ft. of warehouse type of use. The required number of parking stalls for a laser tag facility is not specified under the City's parking regulations. Under TMC 18.56.100 "Uses Not Specified" the Director shall determine the required number of parking stalls for uses not specified in the City's parking regulations. The Director's determination shall be based upon the requirements for the most comparable uses specified in the Off - Street Parking Chapter (TMC 18.56). Comparable Uses There are no comparable uses to a laser tag facility that are listed in table 18-7 of TMC 18.56. If the code required parking for the existing tenants is 58 that leaves 82 for the laser tag facility. Current use of parking spaces on the subject site Based on the parking counts taken by the applicant the parking utilization on the subject site ranged from 5 to 45 cars. The peak times were mid-day around 2 pm with the lowest counts during the evenings and weekends. Additionally, the peak operating hours for the laser tag facility do not coincide with the peak hours of other tenants. The peak hours for the laser tag facility are after 5 pm and weekends, while the peak hours of other tenants are traditional Monday through Friday business hours. Applicant has provided parking utilization data for a laser tag facility in Tacoma, which is a 14,000 sq. ft. facility with a 7,200 sq. ft. play field and has equipment for 30 individuals to play at one time. Based on the utilization data for this facility the peak hours were on weekends with a maximum number of 35 vehicles observed on a Saturday afternoon. The proposal is to use 27,000 square feet of the existing building space for Virtual Sports, a laser tag facility. The playfields occupy roughly 14,000 sq. ft. with the rest dedicated to the lobby area, few arcade games, offices and kitchen/bar area. Applicant has stated that they will operate with the maximum capacity of 60 players per hour based on available equipment. This capacity is roughly double the capacity of the laser tag facility in Tacoma. Potential Impacts Since there is no on -street parking in the vicinity of the subject site, there are no potential impacts anticipated on the city streets if the applicant provides 80 parking spaces for the proposed use. CONCLUSION There are a total of 140 parking stalls on the subject site. A total of 58 spaces are required by code for the existing tenants in the building. A total of 82 spaces are available for Virtual Sports. The applicant has determined that they will require roughly 30-50 parking spots during peak hours on weekdays and roughly 70-80 parking spots during peak hours on weekends. Based on the code required parking for the existing tenants; utilization of the existing parking lot; and comparison with a similar laser tag facility it is determined that Virtual Sports shall provide 80 parking spaces for the proposed use. RECOMMENDATIONS Virtual Sports shall provide 80 parking spaces for the proposed use. The building is 110,049sf, of which we occupy roughly 27,000sf, and is 100% leased. The other uses in the building currently include a mix of light manufacturing, warehousing, and services with little to no retail component and traditional, Monday through Friday business hours. A list of the names of the other tenants and their uses is attached. We are a laser tag facility and our estimated hours of operation are: Mon -Thur: 3pm-10pm (peak 5pm-8pm) Fri: 3pm-11pm (peak 5pm-10pm) Sat: 11am-11pm (peak 11am-11pm) Sun: 11am-8pm (peak 11am-4pm) We will operate two play fields that can be combined into one playfield. The gaming portion of our fields consumes roughly 14,000sf of our space with the rest being dedicated to the lobby area, a small amount of arcade games, offices, and a kitchen/bar area. We will operate with themaximum capacity of 60 players per hour based on available equipment. Players will arrive about 10 minutes before their required game time to get checked in and ready for play. Once the previous game has completed the equipment will be transferred from the players in the previous game and given to the waiting players for their time slot. The set of players leaving the field are expected to depart the facility 10-15 minutes upon completion of their timeslot. The two fields will be on staggered times to ensure there are not conflicts in operations. There are no improvements being made during our construction process to adjust the square footage of the building in any way. Due to the group activity nature of the attraction we are providing, the majority of our visitors ride together in groups, both small and large. Because our business attracts a large amount of younger participants, many of them will be getting dropped off. Monday, May 26, 4 During weekdays we will run our operation with a minimum staff of roughly six people. During peak operations on weekends we will have roughly 15 employees on staff. There are currently over 126 parking stalls on site. This number is not taking into consideration the 28 dock high loading doors that span the width of the building on the front side and the 20 grade level doors on the backside. Many of the other tenants currently in the park have no need for all of their loading doors and currently have their employees park in front of the dock loading doors on a daily basis as they are close to the front doors of their spaces. We will have no need for all but one loading door, which will allow us to stripe over 20 additional spaces for the business park. All of the parking stalls in the business park are shared amongst all tenants and are on a first come, first serve, non reserved basis. Parking counts were taken at 17600 W Valley Hwy over the course of three days, May 29th- May 315t . The parking count ranged from 5-45 cars. The peak times were mid day around 2pm with the lowest counts coming in during the evenings and weekends. Thursday, May 29th — 11am — 44 cars, 2pm — 45 cars, 3:30pm — 35 cars Friday, May 30th — 2pm — 42 cars, 7:30pm — 6 cars Saturday, May 31st - 11am — 7 cars, 3pm — 5 cars We are aware that the special permissions packet requested a comparison of three like facilities for the review of the special permissions director. Unfortunately, there are very few facilities that can be directly compared to a laser tag facility due to the unique nature of having a field that only allows a set number of participants in a Targe portion of the facility. There is one other laser tag facility in the Puget Sound region, Laser Quest. Below is our evaluation of the Laser Quest facility in Tacoma. Laser Quest is located at 2210 S. 320th St, Unit A-4, Federal Way, WA 98003 is an approximately 14,000 square foot facility with a 7,200 square foot play field. The facility features enough equipment for 30 individuals to play at one time. The data was collected on Thursday May 22 and Saturday May 24th. During weekday parking counts, demand on the facility was minimal. The peak hours of operation were observed to be late morning to early afternoon. The maximum number of vehicles was 35 vehicles and was observed on Saturday at 1:OOPM. The peak hours of operation were from 12:OOPM to 9:OOPM on Saturday. The data sheets are attached. Our group has a background in other recreation entertainment facilities (five trampoline parks), which helped give us a better understanding of the parking requirements this facility would create. Our projections based on our field capacities were confirmed after evaluating Laser Quests parking flow. It is our determination that Virtual Sports will require roughly 30-50 parking spots during peak hours on weekdays and roughly 70-80 parking spots during peak hours on weekends. The proposed location has over 126 existing parking spots which will be increased to over 140 after the restriping of the parking lots.
