The Examiner viewed the site on January 6, 2015. The following exhibits were entered into the record: 1. A public hearing was held on the application on January 6, 2015 at the Department of Community Development, 6300 Southcenter Boulevard, Tukwila, WA. Represented at the hearing were: the Department, by Rebecca Fox, Senior Planner, and Nora Gierloff, Senior Planner; and the applicant, Miracle Temple Church, by Dale Curtis, Artlessa Wilborn, and Pastor Henry Jenkins. No one from the general public testified at the hearing. After due consideration of the evidence presented at the public hearing, the following shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on this application. Findings of Fact 1. The subject site is addressed as 14925 Interurban Avenue S. Tukwila, WA. The project location is within an existing building that is located on three lots. The structure is 4,392 square feet, and formerly housed a nightclub/tavern. Approximately 730 square feet of the building is occupied by a restaurant use operated by the applicant, Miracle Temple Church. 2. The site takes access from Interurban Avenue South. Surrounding land uses include a convenience store/gas station to the immediate north, and other office, industrial and commercial service uses to the north, south, and east along Interurban Avenue South. 3. The site is zoned Regional Commercial Mixed (RCM) and the zoning in the immediate vicinity is RCM. A High Density Residential (HDR) zone is located further northwest of the site. 4. The western unpaved portion of the property is steeply sloped. The developed portion of the property is flat, and is developed with the existing building and landscaping, surface parking, and trash and loading areas. The site has approximately 62 parking spaces. 5. The proposal is to operate a religious facility within the existing building, with a total of 1,488 square feet of sanctuary space. The applicant indicates that the church will operate with religious services on Thursday and Friday between 7 and 8:30 p.m., and on Sunday between 9 a.m. and 1 p.m. The Southern Grill cafe in the same building operates from 10:30 a.m. to 4 p.m., Monday through Friday. The applicant represents that the church services will occur only when the cafe is closed. F Hearing Examiner Decision L-14-0051 Miracle Temple Church CUP Page 3 of 5 6. Under the Code, complementary parking may be provided between the church and cafe uses, with up to 10 percent of the usable floor area of the building occupied by the complementary cafe use without providing additional parking. The Department calculates that up to eight church spaces could be used by the cafe. 7. The Department has reviewed the proposal and recommends approval with conditions, which are described in the staff report. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.104.010.3, which provides that a decision on a conditional use permit application is a quasi-judicial decision by the Hearing Examiner. 2. The proposed religious facility's assembly areas would exceed 750 square feet, so conditional use approval is required under TMC 18.26.020. 3. The criteria for granting of a conditional use permit are set forth in TMC 18.64.050: (1) the proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity; (2) the proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy; (3) the proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; (4) the proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan; and (5) all measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. 4. The proposed use would not be materially detrimental to public welfare or injurious to the property or improvements in vicinity. The proposal is for a church use to occur within the building, during non -peak traffic hours, i.e., Thursday and Friday evenings between 7 and 8:30 p.m. and on Sunday between 9 a.m. and 1 p.m., so traffic impacts are not an issues, and no other negative effects on public welfare or other properties in the vicinity would occur on account of the proposed church use which will take place within the existing structure. 5. The Code requires one parking stall for every four fixed seats; the 212 -person maximum occupancy for the church will therefore be required to provide 53 parking stalls for church use. Because the cafe is will be closed when the church is operating, the Code allows complementary parking; eight church parking stalls could be shared with the cafe. The proposed use will meet the parking standards. The project as conditioned will also meet other applicable development regulations. The proposed church use would be compatible with the surrounding land uses, which include commercial offices, retail, warehousing and other uses permitted in the RCM zone. The traffic generated by the proposed use would be during off-peak hours, and the traffic and the use would be compatible with surrounding land uses. 7. The proposed religious facility would be consistent with the Comprehensive Plan, e.g., Goal 1.1., which provides for a community of inviting neighborhoods and vibrant business districts. 8. As conditioned, the proposal will incorporate all appropriate measures to minimize possible adverse impacts. Traffic and parking impacts are addressed by the hours of operation for both uses at the site, as well as the provision of adequate off-street parking. Noise, glare or odors are not anticipated to be caused by the proposed use so as to affect other properties or uses in the area. 9. The application would meet all criteria for a conditional use permit and should be approved. Decision The Conditional Use Permit is hereby granted with the following conditions: 1. The church shall operate only during hours of closure for the Southern Grill, or any other future use in the space, unless total number of parking spaces required for both uses can be provided on the site. 2. Church parking spaces shall be required based on occupancy at the rate of a minimum of one vehicle space for every four seats. 3. Complementary vehicle parking may be provided between the church and the sandwich shop with a maximum of 8 spaces serving the cafe use. 4. The applicant shall install no fewer than two bicycle parking spaces per TMC 18.56/Figure 18.7. Building Permit Information Items: a. The applicant shall obtain all required permits before starting any construction work to improve the building for use as a church. b. The applicant shall have all final approvals, final inspections, and a Certificate of Occupancy prior to operating as a church. c. Prior to the building's being used as a church, full fire alarm and fire sprinkler systems shall be installed to meet all current life and safety codes. d. The applicant shall obtain installation permits from the Tukwila Fire Department and a City of Tukwila electrical permit prior to fire alarm and fire sprinkler installation. e. Construction of the church and roof system with building upgrades shall require a licensed engineer for the building's structure with the new engineered truss roof system to meet current codes for seismic and wind loads. A design professional (engineer and/or architect) licensed in the State of Washington shall be required to provide architectural drawings. Drawings shall include all accessible barrier free elements complying with the current building and accessible codes. The Phase II permit shall also be a change of use from a nightclub (A2) to a church (A3). g. Reduced Pressure Principle assembly (RPPA) shall be installed on the existing 1" domestic water service. h. A Detector Double Check Valve Assembly (DDCVA) shall be installed on the fire suppression line. i. All trash enclosures, recycling and storage areas must be screened to a minimum height of 8' and located outside the setback areas. Provide elevations and construction details as part of the building permit application submittal. j. Roof top mechanical units, satellites and similar structures must be properly screened. Provide elevations and construction details shall be submitted as part of the building permit application submittal. k. The principal design professional (that is the professional who is responsible for project coordination) shall be identified on all submittal documents. 1. Complete, accurate and current permit applications shall be submitted for each required permit. m. Plan submittal documents shall be to scale, clearly depict and detail all work (existing and proposed) to be performed by each permit. n. BACKGROUND On August 6, 2014, the City received a Conditional Use Permit application from the Miracle Temple Church to operate a church in an existing building at 14925/14935 Interurban Avenue South in the Regional Commercial Mixed Use Zone (RCM). Tukwila Municipal Code (TMC) 18.26.040.4 allows religious facilities with an assembly area greater than 750 square feet as a conditional use. FINDINGS The applicant has requested a Conditional Use Permit in order to operate a church in a portion of an existing, largely vacant building. The 31,500 square foot subject site, occupies three lots and is developed with an existing building. The 4,392 square foot structure was formerly used as a nightclub/tavern. (Exhibit 1) The applicant, Miracle Temple Church, owns the entire three -lot property. In 2014, the Church remodeled approximately 730 square feet at the north end of the building for use as a restaurant. Approximately 400 square feet is usable cafe space. Restaurants are a permitted use in the RCM zone (TMC 18.26.020.40). The completed restaurant space is occupied by the "Southern Grill" cafe. The Southern Grill is operated by Miracle Temple Church members as a separate, complementary use. The remaining 3,662 square feet of the building will be improved for church use with an approved conditional use permit. A change of use is required to operate a church, shifting from an A2 occupancy for the former nightclub use to an A3 for a place of religious worship. The church would share some parking, and trash areas with the restaurant. There is an access driveway on the site. The existing solid waste dumpster is currently unscreened. Based on staff observation, the site currently contains approximately 62 vehicle parking spaces, with three handicapped accessible stalls. Parking stalls at the rear of the building are delineated faintly. The rear parking area is blocked off and not currently in use. VICINITY/SITE INFORMATION Topography The subject property backs up to the Green Duwamish River Valley wall. The western, unpaved portion of the property has steep slopes. The remaining property is flat and developed with the existing building and required landscaping, parking, trash and loading areas. Surrounding Land Use A High Density Residential (HDR) zone with multifamily uses sits above the site, approximately 150 feet north of the site, 300 feet to the west of the site. A convenience store/gas station is located immediately adjacent to the north. Office, industrial and commercial service uses exist along Interurban Avenue S. to the north, south and east. Access Access to the site is through driveways off Interurban Avenue South. CONDITIONAL USE PERMIT DECISION CRITERIA The proposed project must comply with criteria detailed in the Conditional Use Permit Chapter of the Tukwila Municipal Code (TMC 18.64.050). The applicant's response to the conditional use permit criteria is Attachment 3 to this staff report. Staff makes the following findings using the Code's conditional use permit criteria (TMC 18.64.050) listed in italics: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. Church uses with assembly space under 750 sq. ft. are a permitted use in the RCM zone, while churches with assembly space 750 sq. ft. or over require a conditional use permit. The Southern Grill sandwich shop, owned by the Church, currently operates in a remodeled space in the northern end of the building. The cafe is physically separated from the future church space. The preliminary floor plan shows space for worship, meetings, administrative offices, storage, and restroom facilities. (Exhibit 4) According to plans provided for the Southern Grill permit work, and the applicant's statement for the Conditional Use Permit, services will occur only when the cafe is closed. The sandwich shop's operating hours are 10:30 a.m. to 4 p.m. Monday through Friday. The applicant reports that religious services will be held on Thursday and Friday between 7 and 8:30 p.m., and on Sunday between 9 a.m. and 1 p.m. 2. The proposed use shall meet or exceed the same standards for parking, landscaping yards and other development regulations that are required in the district it will occupy. The following relevant standards exist in this Regional Commercial Mixed Use (RCM) district (TMC 18.26), unless noted: Setbacks: No exterior construction is proposed in the setback area. Landscape: The code requires the following landscaping when adjacent to High Density Residential (HDR): front - 10 feet; side - 5 feet; rear — 10 feet when adjacent to HDR. The existing landscaping does not meet current code requirements. Per TMC 18.70.090 any nonconforming landscaping is only required to be brought into compliance if design review is triggered. Since there is no design review with this conditional use permit and remodel, the deficiencies are not required to be corrected at this time Off-street parking: (TMC 18.56.050) The preliminary site plan provided with the conditional use permit application indicates a total of 57 spaces, including 52 standard parking places, two compact stalls and three handicap stalls with a space for van parking. No bicycle parking is provided. A site visit shows approximately 62 existing spaces i.e. a different total number of existing spaces, in a different parking configuration from what is indicated on the plan. The spaces that are currently onsite include the improvements that were required in mid -2014 for the cafe/sandwich shop. In addition, there are spaces on the west side that have not been restriped and are not currently in use. The preliminary site plan (Exhibit 4) indicates 1,488 sq. ft. of sanctuary use. With seven feet of space per occupant required by the Building Code, the sanctuary's maximum occupancy is 212 people. Per TMC 18.56/Figure 18.7, at least one parking stall is required per four fixed seats, or a minimum of 53 stalls. Parking shall be provided at a rate of one space for every four fixed seats per TMC 18.56/Figure 18.7. Based on the 212 person maximum occupancy shown on the plans, a minimum of 53 stalls shall be provided for church use. Per plans submitted for the Southern Grill, the restaurant will be closed during church hours. The applicant also confirmed this verbally to staff. Under these circumstances, the parking that is required and provided for the sandwich shop may be used during its hours of closure by the church to accommodate its parking needs during services. Tukwila Municipal Code 18.56.070.D allows complementary parking whereby up to 10% of a given building (i.e. the church) may be occupied by a complementary use (i.e. the cafe/sandwich shop) without providing parking spaces in addition to the spaces for the principal church use. In this case, 8 parking stalls (based on 400 square feet of usable cafe space, required at a rate of one space per 50 square feet) may be shared by the cafe. The code requirements could be met with a minimum of eight stalls required for the 400 square foot usable cafe space and a minimum of 53 for the church, given a 212 person maximum church occupancy and 1 parking stall required per four fixed seats. If there are currently 62 legally - sized stalls and drive lanes, parking would be sufficient. Once the building plan is finalized, an accurate site plan with the necessary vehicle stalls and drive lanes with the correct number of properly -dimensioned, required spaces is required for the entire site, including both church and restaurant uses, per Tukwila Municipal Code. If the conditional use permit is approved, then a building permit is required before a certificate of occupancy will be issued for the church use. As part of the building permit review process, the applicant is responsible for meeting all Building and Fire Code requirements including but not limited to: a. The applicant shall obtain all required permits before starting any construction work to improve the building for use as a church. b. The applicant shall have all final approvals, final inspections, and a Certificate of Occupancy prior to operating as a church. c. Work shall reflect compliance with all state and local codes and ordinances. Trash enclosures All trash enclosures, recycling and storage areas must be screened to a minimum height of 8'. It shall be located outside the required setbacks. Sufficient space shall be required for recycling. The dumpster is currently unscreened. Interior parking lot landscaping (TMC 18.52.035) In RCM zones, 10 square feet of landscaping is required per parking stall when those stalls are located behind a building. Landscaped areas shall be placed at the ends of each interior row in the parking area, with no stall more than 10 stalls or 100 feet from a landscape area. For areas adjacent to public streets, a minimum of 15 square feet of landscaping is required for each parking stall. These standards are currently not met. However per TMC 18.70.080 nonconforming parking lots only need to be brought into compliance with the current code if a change of use takes place that requires an increase in the parking area by an increment greater than 100%. All the parking is existing and no expansion of the parking area is proposed. Roof Top Units: Preliminary plans do not indicate the presence of roof top mechanical units or similar structures. All roof top mechanical units, satellite dishes and similar structures shall be properly screened. Design Review Per TMC 18.60, design review is not required for improvements since the building is less than 10,000 square feet. 3. The proposed use shall be compatible generally with the surrounding land uses. The purpose of the Regional Commercial Mixed Use zone (TMC 18.26.010) is to provide for areas characterized by commercial services, offices, lodging, entertainment and retail activities with associated warehousing and accessory light industrial uses along a transportation corridor and intended for high intensity regional uses. Residential uses mixed with certain commercial uses are allowed at second story or above. The zone's standards are intended to promote attractive development; an open and pleasant street appearance; and compatibility with adjacent residential areas. The church will produce traffic during off-peak hours between 7 p.m. and 8:30 p.m. on Thursday and Friday, and from 9 a.m. to 1 p.m. on Sunday. Traffic impact fees will not be required since the trips generated by the church will occur outside peak hours. No outdoor noise is anticipated with the proposed church use. Any noise from the church will likely be masked by the adjacent Interurban Avenue S. traffic and the general ambient noise of the area. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The vision articulated in the Comprehensive Plan calls for a quality opportunities for working, living and community involvement. Goal 1.1 states "A community of inviting neighborhoods and vibrant business districts." 5. All measures shall be taken to minimize the possible adverse impacts which (sic) the proposed use may have on the area in which it is located. The church will operate when the cafe is closed. This schedule will minimize traffic and parking impacts to the site and adjacent area. The preliminary site plan (Exhibit 5) shows 57 parking stalls, including three handicap accessible stalls. The site has an access driveway. The proposed use will not generate noise, glare or odors that may impact adjacent properties. PUBLIC COMMENTS A member of the public raised concerns over the source of the project's financing. In discussions with staff, he determined that the issue was not directly pertinent to the Conditional Use Permit review process, and should not be included in the review. CONCLUSIONS 1. Church -related traffic would be greatest during non -peak hours. Any noise associated with the church will be minor compared to the ambient noise of the site from the vehicular, truck, bus and airplane traffic. The uses surrounding the subject site should tolerate the traffic that will be characteristic of the church use. 3. Bicycle parking is lacking, and shall be provided per the Code. The site is adjacent to the Green River regional trail and the Interurban Trail. Staff and congregants could potentially bike to the site. 4. The dumpster is currently unscreened. It shall be screened per Code. 5. Preliminary roof elevations do not show mechanical equipment. Roof top mechanical units, satellites and similar structures must be properly screened per Code. 6. The proposed use will be compatible with the surrounding residential and commercial land uses. 7. The proposed use will not conflict with the goals and policies of the Comprehensive Plan. A church may create a sense of community among its families, fostering a sense of place and an emotional attachment to the area. 8. On-site parking is likely to be a primary impact of church use. 9. The church use will occur only when the Southern Grill cafe is closed, either in the early evening during the week, or on Sunday mornings. 10. Parking stalls shall be provided per TMC 18.56/Figure 18.7 of church occupancy at the rate of one space per four seats. 11. Complementary parking may be provided per TMC 18.56.070.D between the church and cafe uses, with up to 10% the usable floor area of the building occupied by the complementary (cafe) use without providing additional parking. With 400 square feet of usable cafe space, up to 8 cafe spaces may be used by the cafe. 12. If the conditional use permit is approved then a building permit is required before a certificate of occupancy will be issued for the church use. As part of the building permit review process the applicant is responsible for meeting all Building and Fire Code requirements. Complementary vehicle parking may be provided between the church and the sandwich shop with a maximum of 8 spaces serving the cafe use 4. The applicant shall install no fewer than two bicycle parking spaces per TMC 18.56/Figure 18.7. Building Permit Information Items: a. The applicant shall obtain all required permits before starting any construction work to improve the building for use as a church. b. The applicant shall have all final approvals, final inspections, and a Certificate of Occupancy prior to operating as a church. c. Prior to the building's being used as a church, full fire alarm and fire sprinkler systems shall be installed to meet all current life and safety codes. d. The applicant shall obtain installation permits from the Tukwila Fire Department and a City of Tukwila electrical permit prior to fire alarm and fire sprinkler installation. e. Construction of the church and roof system with building upgrades shall require a licensed engineer for the building's structure with the new engineered truss roof system to meet current codes for seismic and wind loads. f. A design professional (engineer and/or architect) licensed in the State of Washington shall be required to provide architectural drawings. Drawings shall include all accessible barrier free elements complying with the current building and accessible codes. The Phase II permit shall also be a change of use from a nightclub (A2) to a church (A3). g. Reduced Pressure Principle assembly (RPPA) shall be installed on the existing 1" domestic water service. h. A Detector Double Check Valve Assembly (DDCVA) shall be installed on the fire suppression line. i. All trash enclosures, recycling and storage areas must be screened to a minimum height of 8' and located outside the setback areas. Provide elevations and construction details as part of the building permit application submittal. j. Roof top mechanical units, satellites and similar structures must be properly screened. Signs may be reused but they must be clean and show no evidence of former wording. The main body of the text and graphics will be screen printed or painted on the Sign, see Figure 1 for details. The changeable portion of the text (permit action, project name and file number) will be done in vinyl letters or silk screened on the sign. The posts will be 4" x 4" x 96" treated wood posts and the top of the sign will be 7 to 9 feet above grade. Sign will be mounted to the posts with galvanized brackets.
