TYPE OF APPLICATION: Special permission from the Director to locate one cargo container
LOCATION: Vietnamese Martyrs Parish

ZONING: Tukwila Urban Center — Workplace District (TUC — WP)

BACKGROUND
1. On October 29, 2014, the applicant submitted an application for Special Permission from the Director to
temporarily place one cargo container at 6841 South 180th Street, Vietnamese Martyrs Parish.
2. The Vietnamese Martyrs Parish property is zoned Tukwila Urban Center — Workplace District (TUC — WP), with
a Shoreline overlay. Tukwila Municipal Code (TMC) 18.28.030 permits cargo containers as an accessory use in
the TUC — WP zone provided they obtain special permission from the Director and meet the requirements of
TMC 18.50.060. The Shoreline overlay requires a 125' buffer from the Ordinary High Water Mark (OHWM) for
the leveed portions of the Green River.
3. TMC 18.50.060 (C) notes the following requirements in order to place a cargo container in the LDR zone:
A. Only two cargo containers will be allowed per lot, maximum length of 40 feet.
B. The container is located to minimize visual impact to adjacent properties, parks, trails and right-of-way
as determined by the Director.
C. The cargo container is sufficiently screened from adjacent properties, parks, trails and rights-of-way, as
determined by the Director. Screening may be a combination of solid fencing, landscaping, or the
placement of the cargo containers behind, between or within buildings.
D. If located adjacent to a building, the cargo container must be painted to match the building's color.
Vietnamese Martyr Parish
L14-0070
E. Cargo containers may not occupy any required off-street parking spaces.
F. Cargo containers shall meet all setback requirements for the zone.
G. Outdoor cargo containers may not be refrigerated.
H. Outdoor cargo containers may not be stacked.
4. The application materials submitted to the City included a site plan showing the proposed cargo container on
the southern corner of the property. The proposed location meets TUC — WP setback requirements and the
location provides screening from existing landscaping.
DISCUSSION
It is the burden of any individual seeking land use approval to clearly demonstrate that they can meet
application requirements before having the application issued. The applicant has met this burden. The applicant
provided a site plan that clearly demonstrates the proposed cargo container location and how it meets length,
setback, and screening requirements. The applicant has also committed to provide additional screening with the
placement of 5' potted plants (thuja occidentalis) and to paint the cargo container the same color as the
adjacent building. The proposed cargo container will occupy three on-site parking stalls. The property must
provide 238 parking stalls pursuant to TMC 18.28.080 off-street parking standard and currently provides 241
parking stalls. The three occupied stalls will bring the total provided to 238, still meeting the parking
requirement. The placement of the proposed cargo container does not alter the existing shoreline buffer.
Additionally, the applicant intends to place the cargo container temporarily, and will be on-site from
approximately November 2014 to February 2015. The container will not be refrigerated, will not be stacked, and
is not located in an off-street parking space, thus meeting code provisions as outlined in TMC 18.50.060.
The application to locate one 40 foot container is accepted. This container may be placed.
APPEALS
This Notice of Decision may be appealed to the Hearing Examiner. If there are no valid appeals filed within the
time limit the decision of the Department will be final.
In order to appeal the decision, a written notice of appeal must be filed with the Department of Community
Development within fourteen days of the issuance of the Notice of Decision (2013). The requirements for such
appeal are set forth in the Tukwila Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association
or other group, the address and phone number of a contact person authorized to receive notices on the
appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in that decision. The Notice of
Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed; the
harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to
matter or issues raised in the Notice of Appeal.
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's
decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the

RE:
Project #:
Project Name:
Special Permission — Director: Decision Criteria
Church of the Vietnamese Martyrs — Cargo Container
The Vietnamese Martyrs Catholic Parish is applying for permission to temporarily place a cargo container
on the south end of their property. The container will be 40' x 8', and meet all applicable criteria, as
outlined below. The cargo container will occupy (3) existing parking stalls. Currently the Parish has a
parking requirement of 238 stalls, with 241 provided on site. The three stall deficit will bring the total
provided down to 238, which meets the required quantity. The cargo container will only be on site
temporarily. It will be used for a festival from February 4th thru February 19th, then will be removed from the
site. While it is on site, the cargo container will be screened by potted plants (thuja occidentalis — 5'
specimens). The cargo container will also be painted white to match the adjacent building. See attached
site plan for details. Please see our responses to specific review requirements listed below.
Review Criteria:
1. Only two cargo containers will be allowed per lot, maximum length of 40 feet. One 40' container is
proposed.
2. The container is located to minimize the visual impact to adjacent properties, parks, trails and
rights-of-way as determined by the Director. The container is placed near the southwest corner of
the building adjacent to the loading dock area. The container will be painted to match the building
color to help disguise it from the neighboring dike walkway.
3. The cargo container is sufficiently screened from adjacent properties, parks, trails and rights-of-
way, as determined by the Director. Screening may be a combination of solid fencing, landscaping,
or the placement of the cargo containers behind, between or within buildings. The cargo container
will be screened by potted plants to help disguise it. The plants will be located to hide the
container as well as possible, while maintaining access to the (3) doors on the container. The
screening will be 5' tall thuja occidentalis (smargad) plants in Targe containers — placed
approximately 20" on center around the perimeter of the container as shown in the attached site
plan
4. If located adjacent to a building, the cargo container must be painted to match the building's color.
The container will be painted to match the building.
5. Cargo containers may not occu . y any required off-street parking spaces. The container is
temporarily occupying (3) • .arking spaces, but not required parking spaces. The container
has a limited duration on sit-, .nd will be removed after the festival in February 2015.
6. Cargo containers shall meet all setback requirements for the zone. The container meets all
55 S. Atlantic Street • Suite 301 • Seattle, WA 98134 • 206.682.7525 / Fax. 206.682.7529
setback requirements.
7. Outdoor cargo containers may not be refrigerated. The container is not refrigerated.
8. Outdoor cargo containers may not be stacked. The container will not be stacked.
We believe the proposed cargo container location and placement meets all City of Tukwila requirements. If
you have any questions or concerns, please contact us at your convenience.
Sincerely,
9 -
