This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project
and permit approval.

11. BACKGROUND
Sound Transit has applied to remove a Black Cottonwood tree that is next to the light rail guideway on
property located at 15241 515t Avenue South, the location of the Buddhist temple. A second Black
Cottonwood tree that is next to the tree that could damage the guideway is proposed for removal as it is
very close to the tree proposed for removal and hinders access to that tree; in addition it is leaning at a 30
degree angle towards the parking lot of the temple and is a safety issue for the parking lot users. The two
attached photos illustrate the tree and its proximity to the guideway. The trees are located at the top of a
steep slope, just above Southcenter Boulevard.

Staff Report and Notice of Decision
Sound Transit has provided a tree evaluation, prepared by an ISA certified arborist, documenting the
condition of the tree. Black Cottonwoods are brittle, fast growing trees that lose branches with very little
warning and are subject to fast rates of decay. The tree can grow over four feet per year. The subject tree
is 48 -inches in diameter and has been topped in the past on scaffold branches that overhang the Sound
Transit elevated structure. The cuts induced new growth that is now large enough to cause damage upon
failure, heavy enough to fail without warning and poorly attached to what may now be a decayed
supporting branch. A site visit showed that the tree is encased with English ivy. The arborist also
recommends removal of an adjacent Black Cottonwood which is leaning at a 30 degree angle towards the
parking lot of the temple. In a follow up communication, the applicant states that the English ivy will be
removed from around the tree.
A list of suggested replacement trees was submitted with the tree cutting permit — any of the suggested
trees are acceptable in this location. Based on the size of the tree to be removed, eight replacement trees
would be planted.
Due to the close proximity of the tree to the guideway, the system must be shut down to ensure the tree
can be safely removed. The light rail system is scheduled to be closed down on November 15, 2014 to
install system upgrades to prepare for the extension of service to Capitol Hill and the University of
Washington. This closure provides the opportunity to address the removal of the subject trees without
having to shut the system down on a separate occasion with the associated financial costs to the system
from lost revenue as well as the inconvenience to passengers using the system.
III. DECISION
SEPA Determination: The City's SEPA Responsible Official has previously determined that this
application does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Tree
Cutting Permit does comply with applicable City and state code requirements and has approved that
application, subject to any conditions which are set forth in the Decision below:
1. After the removal of the tree and assessment of the slope and available planting area, submit a
planting plan which identifies the location for the eight replacement trees and the type of
replacement trees to be planted.
IV. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code
§ 18.104.010. Other land use applications related to this project may still be pending.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing
Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to
challenge either the conditions which were imposed by the MDNS decision or the failure of the Department
to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing
Examiner.
A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in
King County Superior Court from the Hearing Examiner's decision.

V. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal
must be filed with the Department of Community Development within 14 days of the issuance of this
Decision, that is by 5:00 p.m., Monday, December 1, 2014.
The requirements for such appeals are set forth in Tukwila Municipal Code Chapter 18.116. All appeal
materials shall be submitted to the Department of Community Development. Appeal materials MUST
include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.
VI. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the
Hearing Examiner based on the information presented to the Planning Supervisor, who made the original
decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be
allowed to present oral argument based on the information presented to the Planning Supervisor before
their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW Chapter 36.70C. If no appeal of the
Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on
this permit will be final.
VII. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The

I am attaching the Notice of Decision on the tree removal request for the tree on 51' Ave. South, at the Buddhist
Temple. A hard copy of the permit will go in tomorrow's mail.
I did not put a date in the condition of approval on when a landscaping plan is to be submitted, but would appreciate
hearing back from you on when we can expect to receive the landscaping plan after you have had a chance to assess the
site after the tree is removed.

Hi Carol,
After speaking with the property owner and assessing the possible damage and liability to Southcenter Blvd it is
preferred to remove the tree to the stump. We would then treat the stump with Garton 4 with Triclopyr to stop further
growth of the stump. We plan to remove all of the English Ivy around the tree and stump as it is an invasive.
Once the cottonwood is down we would replant near the stump and to the west to help with slope stability. We spoke
to the property owner today about allowing us access to water and maintain the planting to insure the establish well.
I can provide you a planting plan once we know the type of trees the city is okay with and the number we need to
provide.

A couple questions that you may need to ask of the arborist. The recommended action is to remove the scaffold
branches to create a snag and then chemically treat the snag — there is no mention of the chemical that will be used to
kill the tree. Also, if the tree is going to remain, where will the replacement trees be planted? When we visited the site
today, we noticed there was quite a bit of ivy on the tree — if it is to remain as a snag, we would require that the ivy be
removed. Hopefully that is not an issue for Sound Transit.
Thanks — I'm working on the staff report right now, so if you are able to get answers to my questions that would be
helpful.

This Entry Agreement ("Agreement") is made effective on the date below between the CENTRAL PUGET SOUND
REGIONAL TRANSIT AUTHORITY ("SOUND TRANSIT"), a regional transit authority of the State of
Washington and 5100 SC Blvd. LLC ("Owner").
RECITALS
Owner owns certain real property ("Property") described below. Sound Transit wishes to gain access to the Property for

had some topping cuts conducted on the scaffold branches overhanging the ST elevated structure.

Option 1 - minimum need is to remove the two large branches overhanging the tracks down to the
junction of all 4 large branches. DO NOT TOP THESE BRANCHES AGAIN. Future risk will occur with
this option as the tree continues to grow. Remaining scaffold branches will have a higher probability of
failure due to the loss of canopy and wind exposure. Probability will be greater they will fail to the
private property, though room for error should conclude these branches could fail to the tracks under the
right storm related circumstances.
Option 2 - Recommended Option - Remove all scaffold branches to create a snag at a height just below
the elevated structure. Chemically treat this habitat snag to kill it so regrowth will not create
maintenance needs in the near future. Removal of tree leaning to parking lot recommended for safety of
private parking lot.
Option 3 - If Private landowner chooses, the whole tree could be removed for some extra cost, if the
stump is not chemically treated the tree will begin to grow again and may become a maintenance issue
in the long term (>10 yrs) future.
