I. PROJECT INFORMATION Project File Number: L14-0072 Applicant: Amy Kwan for Kwan Dental Clinic Type of Permit Applied for: Tree Cutting Permit Project Description: Removal and replacement of two landscaping trees Location: 6715 Fort Dent Way Associated Files: None Comprehensive Plan Designation/Zoning District: II. BACKGROUND Regional Commercial/Mixed Use (RCM) The dental clinic is requesting the removal of two Platanus (Sycamore, P. acerifolia, London plane) trees on the southwest and southeast corners of the clinic building. Both trees are approximately 60 feet tall and do not appear to have been maintained since their installation when the clinic was constructed in 1994. The applicant hired a certified arborist Trelstad Tree, to assess the trees. The assessment provided states: "They are in the early stage of maturity and have large, full canopies. Ms. Qwan...has already had problems with the one on the SW area. Invasive roots from other plants and underground utilities have affected the irrigation system. The foundation of the building is very close to the bases of both trees. They have each lost large limbs. These trees do not have enough space to accommodate their potential large growth. In my opinion replacing these 2 trees with trees that are more manageable, i.e. slower growth rate, small maturation rate such as certain evergreens. Mountain Hemlock or hinoki cypress are perfectly acceptable alternatives for this site...." Staff Discussion The two trees are planted fairly close to the building and in the case of the tree on the southeast side of the building, the roots have grown into a utility cabinet and are circling the tree. The landscaping on the site does not appear to have been maintained on a regular basis since its planting in 1994 when the dental clinic building was constructed. Staff, including the Urban Environmentalist, have visited the site to assess the condition of the trees. Staff concurs that the two trees can be removed and replaced with slower growing trees. The applicant's arborist has recommended two trees as substitutes for the Sycamores — the hinoki cypress (Chamaecyapris obtusa) and the mountain hemlock (Tsuga mertensiana). While the Sycamore trees were planted as part of the formal landscaping for the building when it was originally constructed, the site is also located in the shoreline jurisdiction. The City's Shoreline Master Program, revised in 2011, requires that vegetation planted in the shoreline jurisdiction be native species. The mountain hemlock is a native — two other options are Western White Pine (Pinus monticola) or Shore Pine (Pinus contorta). TMC 18.44.B.4also requires replacement of trees removed from the shoreline jurisdiction. Based on the size of the tree being removed, there is a sliding scale of trees required for replacement. The sycamores are 25.7 (southeast tree) and 23.8 (southwest tree) inches in diameter, therefore TMC 18.44.B.4 requires 16 trees to be planted to replace the value provided by the current trees. Two of the replacement trees would be planted in the area where the Sycamore trees are being removed. If the other 14 replacement trees cannot be accommodated on the project site, then there are two options 1) plant the replacement trees in the shoreline at a site approved by the City (with priority placed on planting trees in the Transition Zone); or 2) payment into the City's tree replacement fund. The replacement trees would be mix of deciduous and evergreen and split between 7 at the one gallon size tree and 7 at the larger size (6-8 ft. in height for evergreens, 2 " in caliper for deciduous). Payment into the tree fund would be based on the City's cost estimate of $50 for the one gallon size and $100 for the larger plant material. III. DECISION SEPA Determination: The City's SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Tree Cutting Permit does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision below: CL Page 2 of 4 12/12/2014 9:22 AM H:\\L14-0072 Kwan Dental Clinic Staff Rpt.-NOD.docx December 12, 2014 L14-0072 Kwan Dental Clinic Tree Removal Staff Report and Notice of Decision 1. The tree stumps must be ground out and the soils amended to prepare for planting replacement trees. 2. After the removal of the two trees, provide a tree planting plan, identifying the type of trees to be planted. The site is located in the shoreline jurisdiction and replacement trees must be native species. The hinoki cypress is not a native species therefore either mountain hemlock or other native species such as Western White Pine (Pinus monticola) or Shore Pine (Pinus contorta) are the suggested replacement trees. The applicant may request other appropriate native trees for approval by the City if desired. 3. If irrigation does not exist, provide a temporary irrigation plan to ensure the establishment and survival of the new landscaping to be installed for at least three years. 4. New landscaping to be installed by April 15, 2015. 5. Newly landscaped areas are to be mulched after the installation of the plants. 6. Provide 14 replacement trees, in addition to the two trees planted to replace the Sycamores, to compensate for the removal of the two Sycamore trees in the shoreline jurisdiction. The 14 trees can either: 1) be planted on site; 2) be planted in a shoreline jurisdiction area approved by the City. The second option includes purchase and installation of the trees. A third option is payment may be made into the City's tree replacement fund based on 7 (1) gallon plants at $50 each and 7 larger plants at $100 each. IV. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. V. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision, that is by 5:00 p.m., Friday, December 26, 2014. The requirements for such appeals are set forth in Tukwila Municipal Code Chapter 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. VI. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Chapter 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VII. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Carol Lumb, who may be contacted at 206-431- 3661 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. You will probably have issues with tree health in the future if the trees are not replanted correctly. I will attach a couple of handouts that discuss proper tree planting techniques — one of them has a diagram of the root collar/flare that is helpful in identifying what to look for when planting trees. I also wanted to check with you on the required replacement trees — please confirm that you plan to pay into the tree replacement fund instead of planting trees elsewhere on the site or in another location. Whatever option you choose, I would like to get closure by April 15 (the date when the replacement trees were to be planted) so I can indicate in the file that the conditions of permit approval have been met. I am attaching a copy of the Notice of Decision for your reference — we also didn't see any temporary irrigation on site — can you tell me what method you will be using to ensure that the two new trees survive and thrive. For the two trees to be replaced if the sycamores are removed, those trees would need to be of a similar canopy and the staff report for the tree permit gave several options, one of which was recommended by the arborist you consulted. Columnar trees are not acceptable — the hemlock is probably the most narrow of two choices for the on-site replacement. Here are some suggested native shoreline plants: Western red cedar - Thuja plicata (best in shadier area) Sitka spruce — Picea sitchensis Hemlock — Tsuga heterophylla Hazelnut — Corylus cornuta Vine maple — Acer circinatum Big leaf maple — Acer macrophylllum Oregon ash — Fraxinus latifolia Serviceberry — Amelanchier alnifolia Red -twig dogwood — Cornus sericea Snowberry — Symphoricarpos albus Ninebark — Physocarpus capitatus Nootka rose — Rosa nutkana Indian plum —Oemleria cerasiformis Pacific crabapple — Malus fusca There are other native plants, this is just what our staff environmentalist came up with quickly to give you some guidance. Some plants would need to be planted at lower elevations (once the site is cleared) — we would want to see your plant list to assist in where to plant different species, if you decide to plant the restoration area yourself. Availability of some plants might be spotty on some so you will need to do some research before sending us your intended list. The area is south of the BECU site along the Green River Trail. We have just started to take out blackberries and other invasives, so I don't know when the site might be ready for planting. Work parties will resume in February and continue through to next November/December, 2015, depending on the weather and availability of volunteers. There is public parking on 48th Avenue South, where you could then wheel barrow northbound on the trail to the site. Both of the trees appear to be very healthy, although the tree at the southeast corner does have roots that are circling the base of the tree. My suggestion would be to have the ISA certified arborist do maintenance on the trees - trim branches that may need trimming and any other work that would promote both of the trees' health. It was hard to tell, but it didn't look like there had been any pruning to the trees in the past - trees, as well as the other landscaping need the occasional maintenance by a qualified specialist to help shape them, take out branches that may be compromised etc., just as buildings need the occasional maintenance action. If there is concern about branches breaking off, tree maintenance is the first approach that should be used. The tree on the southwest corner appeared to be very healthy, without circling roots at the base. If you want to pursue removing the two trees, then please complete the attached permit application. You will need to provide a written report from the ISA certified arborist documenting what the issues with the tree are. Just for your information, I will be out of the office from 9/11-9/26. If you decide to submit the shoreline vegetation permit removal permit, then I will review it when I return. We have two large sycamore trees on the south side of our property. When these trees were initially planted in 1994, they were not a problem. Over the past 20 years they have grown to be very large in size. From my understanding, these trees will continue to grow both in height and trunk diameter. Because the trees are so large, their root systems are also large. We are concerned that the roots will eventually damage our building foundation and underground drainage system. Please note that in the past, numerous large branches have fallen off of these trees and landed on our roof, landscape plants and shrubs, and onto the bike/walk trail that is adjacent to the property line. We do not want to wait until our roof gets damaged or worst yet someone who happens to be on the trail gets injured from one of these fallen branches. I had Bruce Trelstad of Trelstad Tree Inc come by on Tuesday, September 9th to look at the trees. He is an ISA certified arborist and has done work for the City of Tukwila. He said that my concerns are valid. He can be reached at 206.935.4116. The trees are on the SW & SE corners of the dental office_ They are approximately 60" tall. They are in the early stage of maturity and have large hull canopies. Ms, Owarr has severalconcerns, She has already had problems with the one on the SW area_ Invasive roots from other plants and underground utilities have affected the irrigation system. The foundation of the building is very close to the bases of both trees. They have each lost large limbs_ They are large now, but pane trees can grow much larger. These trees do not have enough space to acoamrnodate,their potential large growth. In my opinion replacing these 2 trees with trees that are more manageable, i_e. slower growth rate, smaller maturation rate such as certain evergreens.
