W i City of Tukwila Allan Ekberg, Mayor INFORMATIONAL MEMORANDUM TO: Committee Services & Safety Committee FROM: Laurel Humphrey, Legislative Analyst DATE: January 18, 2022 SUBJECT: Community Services & Safety Committee Overview ISSUE Overview of scope and purpose of the Community Services & Safety Committee BACKGROUND Information regarding the City Council's standing committees can be found in a few key locations. Resolution 2040 The titles, scopes, and schedules of the 2022 Standing Committees were adopted on January 3, 2022 by Resolution 2040. Per Resolution 2040, the Community Services and Safety Committee will "provide policy recommendations on legislative matters relating to police, fire, emergency services, municipal court, public safety facilities, animals, community engagement, human services, parks, recreation, youth and senior services, golf course, community center, library, public art, social equity and justice, and other ad hoc matters as assigned." City Council Rules of Procedure Section VI(A) of the City Council Rules of Procedure establishes the basis of standing committees as follows: A. Standing Committees 1. The City Council may choose to implement a framework of standing committees, comprising three Councilmembers each, to aid in the transaction of its business. 2. The standing committee titles, scopes of authority, and schedule will be adopted by resolution in January of each year. 3. The scopes of the standing committees will be balanced in accordance with the City's workload. 4. The Council President shall appoint the chair and membership of each Committee by the second Regular Meeting of each year. 5. The standing committees shall consider and make policy recommendations to the City Council. Committees may at times refer items to the full Council with no recommendation. 6. Each Committee Chair shall report to the Council the findings of the committee. 1 INFORMATIONAL MEMO Page 2 7. Each Committee Chair may review and approve the Committee agenda and will approve Committee minutes before distribution. The Committee Chair can authorize the cancellation of a Committee meeting. 8. In the event a Committee member is unable to attend a meeting, another Councilmember may attend in the absent member's place. If no replacement can be found, the meeting may still take place with two members. Section III(A), City Council Business also references the work of standing committees: III. Legislative Process A. City Council Business 1. Matters to be considered by the Council shall be placed on a standing committee, Committee of the Whole, or Regular Meeting agenda and include items required by law to be presented to Council, items requested by a majority of the Council, staff -initiated items in accordance with the City's strategic priorities and work plan, and items referred from previous meetings. 2. As a general practice, legislative actions to come before the City Council for a decision should appear first before a standing committee, then the Committee of the Whole, then a Regular Meeting. Informational items not requiring a decision may be scheduled with more flexibility as the situation requires. 3. Items may be placed directly on the agenda of a Committee of the Whole or a Regular Meeting when the items are approved by the Council President, and the items are routine or in the event of an emergency. Public Access Committee meetings are open to the public, and agendas are posted online and emailed to subscribers. As of 2021, meeting audio is stored in the city's Digital Records Center and videos are posted the next day to TukTV. There is typically not an opportunity for public comment due to time restrictions and the benefit of the whole Council and City Administration hearing public comment offered at the Committee of the Whole and Regular Meetings. In rare cases, the Chair may make an exception. RECOMMENDATION Discussion only. Residential burglary continued to be low in the fourth quarter, ending the year with an 85% decrease compared to its peak in 2009. Commercial burglary, auto theft, and theft from vehicle, however, all totaled higher in 2021 than many previous years. Wittwer, Fire Chief CC: Allan Ekberg, Mayor, David Cline, City Administrator DATE: 01/16/2022 SUBJECT: Interlocal Agreement (ILA) for Fire Investigation Services CURRENT STATUS Fire Investigation to determine the origin and cause of every fire is mandated by law. Incendiary and suspicious fires are then referred to Law Enforcement for follow up investigations. Fire Investigations in Tukwila is conducted by the Tukwila Fire Marshal's Office (FMO) using the Fire Marshal, or one of the two Deputy Fire Marshals. It is difficult to plan for fire investigation needs as fires are unplanned events. This disrupts the scheduled inspections and meetings that support development/code enforcement. Tukwila has about 75 fire investigations for Origin and Cause each year. The regular caseload for an experienced fire investigator is between 60-70 cases per year. Puget Sound Regional Fire Authority (PSRFA) is restructuring their Fire Investigation team and is open to a joint effort to better address this dynamic need. There is an opportunity to join PSRFA to provide origin and cause investigation services to both PSRFA and the City of Tukwila. A one- year trial period would provide a chance to see if this model is a more sustainable procedure for fire investigation in the City of Tukwila. DISCUSSION An Interlocal Agreement (Collaborative Services Agreement) will be shared with CSS next month. The following has been agreed to between the parties with the following terms: • One-year agreement for 2022, renewable for consecutive years (in the event further consolidation does not occur). • PSRFA provides origin/cause fire investigations to the City of Tukwila, and partners with law enforcement (Tukwila PD, KCSO, ATF) as needed to assist with the investigation of incendiary fires in the city. • Tukwila Fire provides one Full Time Position (FTE) Captain Aaron Johnson to the PSRFA fire investigations unit. Page 1 of 2 13 o Captain Johnson remains an employee of TFD; he will work 4 'tens' out of PSRFA Station 74 under the direction of Fire Investigation Unit supervisor Ken Goll. o Captain Johnson may work out of TFD whenever it suits his needs and the needs of the unit. • All PSRFA investigators, including Captain Johnson, will investigate fires throughout the RFA's service area and in the city of Tukwila. They will share in the associated 'standby' burden. • TFD will continue to provide a vehicle, portable radio, uniforms, etc. • PSRFA will provide a laptop / connectivity and office space at station 74. • The Tukwila FTE assigned will report to the Fire Chief Directly with any City of Tukwila specific issues. • This agreement will benefit both agencies and others that may join in the future, as it will provide for a sustainable model for fire investigation services. • The expectations include 24/7 coverage for fire investigations and that all current reports / processes will continue with this agreement. View ILA document under Services 1.1 through 1.7 that defines services and a 24/7 (standby) coverage. Currently Tukwila Fire Department is not staffed sufficiently to handle the workload of fire investigations. As of this year we have had approximately 80 fire investigations, that have come in groups. All fire investigators in the FMO are working on investigations while trying to balance their other schedule. A dedicated fire investigator will bring a more experienced level of investigations to our community as well as eliminate the impacts of investigations on the other services of the FMO. FINANCIAL IMPACT No new financial impacts. Staffed with one FTE from the current assignment to the FMO. No other financial impact will be incurred outside of the discussion points above. RECOMMENDATION The Interlocal Agreement will be presented for Committee review and a recommendation next month. ATTACHMENTS None. ILA to be shared next month following full legal review.
