This easement is for the sole purpose of the construction, use and maintenance of a Utilities and Private Sewer Easement. 3. Grantee shall install any improvements in said Utilities and Private Sewer Easement at its sole cost and expense and shall continue to maintain and shall continue to bear all cost of repair and maintenance or repair of said Utilities and Private Sewer Easement. 4. Grantee shall hold Grantor harmless from and against any and all claims which may be made against Grantor arising out of the installation, operation, maintenance or repair or said Utilities and Private Sewer Easement. 5. The herein easement and agreement may be amended only with the written agreement of the Grantee herein, his heirs and/or assigns. This easement agreement shall run with the land and shall be binding on all parties having or acquiring any right, title or interest in the land descried herein or any part thereof.
