And is for the benefit of the Grantor's and Grantee's properties. For and in consideration of the mutual covenants, an agreement hereinafter expressed and other good and valuable considerations, in hand paid, receipt of which is hereby acknowledged. the parties hereto agree that Grantor grants an exclusive perpetual Ingress/Egress and Utilities Easement over, across, along, in, upon and under that portion of said Grantor's land described as follows: UTILITY EASEMENT The West 10 feet of the East 30 feet of the West three-quarters of Lot 21, EXCEPT the East 80 feet thereof and the East Half of Lot 22, Block 4, FIRST ADDITION TO ADAMS HOME TRACTS, according to the plat thereof recorded in Volume .12 of Plats. page 50, records of King County, Washington; EXCEPT that portion lying within a 25 foot radius curve for ingress, ingress and utilities abutting North Margin of S. 152nd Street and west of East 20 feet of said parcel. INGRESS, EG.RESS AND UTILITY EASEMENT The East 20 feet of the south 82.12 feet, as measured along the East Line thereof, of the West three-quarters of Lot 21, EXCEPT the East 80 feet thereof and the East Half of Lot 22. Block 4, FIRST ADDITION TO ADAMS HOME TRACTS, according to the plat thereof recorded in Volume 12 of Plats, page 50, records of King County, Washington; TOGETHER WITH a 25 foot radius curve lying west of said East 20 feet and abutting the North Margin of S. 152nd Street. This easement is for the sole purpose of the construction, use and maintenance of an Ingress/Egress and Utilities Easement. 3. Grantor and Grantee shall install improvements in said Ingress/Egress and Utilities Easement. Grantor and Grantee shall continue to maintain and bear all cost of repair and maintenance or repair of said Ingress/Egress and Utilities Easement. 4. The herein easement and agreement may be amended only with the written agreement of the Grantee herein, his heirs and/or assigns. 5. It is the intent of the Grantor that this agreement shall not be extinguished by the doctrine of merger. This easement agreement shall run with the land and shall be binding on all parties having or acquiring any right, title or interest in the land descried herein or any part thereof.
