Premises and exterior property shall be maintained free from weeds or plant growth in
excess of 12 inches. Noxious weeds shall be prohibited. Weeds shall be defined as all
grasses, annual plants and vegetation, other than trees or shrubs provided; however, this
term shall not include cultivated fiowers and gardens.

TMC 8.45.080 Repeat Violations
A. DEFINITION: "Repeat violation" means a violation of the same or similar regulation in
any location by the same person responsible or on the same property for which either:
(1) voluntary compliance previously has been sought within two years; or (2) a Notice of
Violation and Order has been issued within two years.

Corrective Acion: Trim back overgrowth to a height of 12 inches or less on entire property and remove
trimmings from the property. Always maintain the property to this standard at all times.

This is a notice that your property is in violation of the Tukwila Municipal Code. You must complete the corrective
action noted above by the compliance date indicated.
THIS IS A REPEAT VIOLATION SUBJECT TO IMMEDIATE ISSUANCE OF A NOTICE OF VIOLATION PURSUANT TO
TMC 8.45.080(B). FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY
PURSUANT TO TMC 8.45.080(C) AS FOLLOWS:
1. For the first repeat violation, the penalty may equal upto$1,000per day;
2. For the second repeat violation, the penalty may equal up to $2,000 per day;
3. For the third repeat violation, the penalty may equal up to $3,000 per day;
4. For the fourth repeat violation, the penalty may equal up to $4,000 per day; and
5. For each additional repeat violation that may occur beyond the fourth repeat violation, the
penalty may equal up to $5,000 per day.

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1.The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.

STOP WORK
All persons engaged in doing or causing work to be done are hereby ordered to
immediately STOP WORK. See required Corrective Action(s) below. Please contact the
Permit Center at 206-431-3670 between the hours of 8:30 am and 5:00 pm and a Permit
Technician will assist you through the process to submit your application(s)
successfully.

Location at: Parcel: 0040000715 - Vacant Land. Adjacent to (west of): 4219 S 146th St
VIOLATION: Clearing & Grading without an issued Public Works Grading Permit
CORRECTIVE ACTION REQUIRED:
1. Immediately stop all land clearing: blackberry, weeds, & grass removal & grading
activities.
2. Remove from the property all debris created from the vegetation removal and
dispose of properly. Debris cannot be left on the property.
3. Install erosion and sediment control measures including but not limited to slit
fencing and 3" to 6" straw mulch over all disturbed soil.
4. Remove all equipment used to clear and grade the property.
Corrective measures #2, #3, & #4 must be completed by November 4, 2021.
5. Submit a complete Grading permit application and plans by November 30, 2021.
Any violation of a Stop Work Order may be prosecuted with a Notice of Violation and Order and is
hereby declared to be a public nuisance, subject to the assessment of penalties of $250.00 per day
for each violation and costs and legal fees necessary for abatement (See TMC 8.45.090 and TMC
8.45.120.A.2.a).
